BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937 -1900 • FAX (612) 937 -5739 MEMORANDUM TO: Mayor and City Council FROM: Don Ashworth, City Manager DATE: February 13, 1997 SUBJ: Board of Review The city council was concerned that participation at the local Board of Review on the Tuesday following the Memorial Day holiday might be low and requested that that date be switched to May 19. As can be seen from the attached chart, May 19' conflicts with the City of Chaska's meeting. I have not contacted the County Assessor, Orlin Schafer, but I am sure that he would prefer being personally present to discuss the overall property tax process at our first public hearing. [Note: The assessor will hold an initial meeting on April 7 which typically handles 90% of the owner's wishing to protest their valuation.] In light of the fact that 90% of the property owners do avail themselves of the first hearing date and the fact that the date selected by the council conflicts with the date selected for the City of Chaska, this office would recommend that we re- establish April 7 as the date the assessor discusses the process with citizens; May 12 as the last day to accept appeals and to hear any citizens that wish to speak to the board; and May 27 as the date the council acts on the assessor's recommendations for each appeal. gAmgr \bor97.doc Office of U County Assessor Orlin H. This listing puts each jurisdiction on the same night of the week as previous years. If there is a problem with any of your meeting dates, please call me immediately and we will try to reschedule that meeting. As in the past, there is little room for any changes. The dates that are still open are being consumed by other meetings or obligations, and are not available for Boards of Review. The only other options may be day -time hours. We are going to be using the same forms as in recent years, so we will be asking each person appearing before the Board to submit in writing their appeal. This has helped tremendously to speed the process and we have a good record of who wants what looked at. We are trying to expand the ability of taxpayers to work with us on their individual properties. If any of your residents are asking for appeals before your meeting dates, please have them call the office and we will try to set something up so that by the meeting, you can be informed of what we have documented. WHEREAS, the City desires to enter into an agreement with the County to provide for the assessment of property in said City by the County Assessor's Office; and WHEREAS, the County desires to cooperate with the City in that regard; and WHEREAS, M.S. 273.072 and M.S. 471.59 permit such an agreement for joint assessment; NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is agreed as follows: 1) That the City of Chanhassen, which is situated in the County of Carver and which constitutes a separate assessment district, shall have it's property within Carver County assessed by the Carver County Assessor for the assessment dates January 2, 1997 and January 2, 1998. All work done necessary to the establishment of the estimated market value for each Carver County parcel in the City of Chanhassen shall be performed by the Carver County Assessor or by one or more of the licensed assessors under his /her direction and supervision. 2) It is hereby agreed that the City and all of it's officers, agents, and employees shall r^. full ccop erati on and ass i stance to the County to facilitate the provision of the services contemplated hereby. 3) The City shall pay to the County for the assessment of property within Carver County the sum of Seven and 35/100 dollars ($7.35) per valuation (for the assessment of January 2, 1997) and the sum of Seven and 35/100 dollars ($7.35) per valuation (for the assessment of January 2, 1998) existing or created before the closing of the relative assessment year. 4) Full payment of all claims submitted by the County Assessor for relative assessment dates shall be received by the County no later than November 15th of the respective years. 5) The County agrees that in each year of this Agreement it shall, by it's County Assessor or one or more of his /her deputies, view and determine the market value of at least twenty -five percent (250) of the parcels within this taxing jurisdiction. It is further agreed that the County shall have on file documentation of those parcels physically inspected for each year of this agreement. 6) Data Privacy. Pursuant to Minn. Stat. Chap. 13, the parties agree to maintain and protect data received or to which they have access. No private or confidential data developed, maintained or received by the City under this agreement may be released to the public by the City. The City agrees to indemnify and hold the County, its agents and employees, harmless from any and all claims or causes of action arising from or in any manner attributable to any violation of the Minnesota Government Data Practices Act by City or its agents, assigns, or employees, including legal fees and expenses incurred to enforce this provision of this agreement. 7) Mutual Indemnification. Unless otherwise addressed in this Agreement, each party shall be liable for its own acts to the extent provided by law and hereby agrees to indemnify, hold harmless and defend the other, its officers and employees against any and all liability, loss, costs, damages, expenses, claim or actions, including attorneys fees which the other, its officers and employees may hereafter sustain, incur or be required to pay, arising out of or by reason of any act or omission of the party, its agents or employees, in the execution, performance, or failure to adequately perform its obligations under this Agreement. 8) It is understood by the parties that, pursuant to M.S. �.,.-, � fo r .,r A ss essment ?;rust be app�^.'eC7 her }ha 273 .
