Mayor Furlong called the work session meeting to order at 5:40 p.m.
COUNCIL MEMBERS PRESENT: Mayor Furlong, Councilman Labatt, Councilman Ayotte, .
Councilman Peterson and Councilman Lundquist

CITY CODE REVIEW.
Bob Generous reviewed page by page, beginning with Chapter 10 of the' City Code, the changes
being proposed by staff and asked the council members for questions. Under Article IV
concerning Peddlers, Solicitors and Transient Merchants Councilman Lundquist asked which
groups are not covered. Mayor Furlong had questions if the fees being charged were covering
expenses for ID's and enforcement, and asked what other cities were charging. Councilman
Labatt stated his pet peeve was when one person comes in to get a permit and then photocopies
off a number of additional permits and will these changes help to curtail that from happening.
Councilman Ayotte asked how big of a problem, criminal activity was this.: Todd Gerhardt stated
it is hard to enforce, but it sends a statement to people that it's difficult to commit fraud in the city
of Chanhassen because they have to go through background checks, and wear a badge which will
deter some people.
Discussion regarding curfew, Councilman Labatt suggested making it consistent with the County,
having it tiered by age. Councilman Ayotte asked to see consequences for curfew violations
addressed and asked that Sheriff Jim Olson explain during his law enforcement presentation.
Under the liquor licensing section, Todd Gerhardt suggested that the issue of adding wine along
with the license for 3.2 beer be sent to the Park and Recreation Commission for review.
Regarding the noise ordinance, Councilman 'Ayotte had a concern with the changes and the
ability to enforce or not enforce the ordinance. Councilman Labatt asked if there was going to be
a public hearing held on the ordinance changes, and if affected businesses were going to be
notified. There was discussion regarding noise from snowmobiles.
The amount of money charged for petty misdemeanOrs, allowing the game of paint ball to be
played in the city, changing the wording of "service dog" to "service animal", and 'regarding
recycling, the council asked to get the haulers who work in the city's input. On snow removal on
sidewalks in front of residences, there was discussion over the amount of snow before it had to be
shoveled and how long a person should be given to .accomplish the task before the city steps in
and does it for a fee.
The City Council did not finish the City Code review and will review it at another work session.
Mayor Furlong recessed the work session at 6:55 p.m. The work session was reconvened at 8:55
p.m.

WATER TREATMENT DISCUSSION.
Teresa Burgess gave a power point presentation on the status of the Master Water Study
recommendations and was looking for direction from council on how to proceed. She provided
additional information on water quality trends for iron, manganese and arsenic levels, as well as a
visual, a jar of city water showing the amount of rust in the system. Kelly Janes showed on a city
map specific areas where water problems are occurring presently. Mayor Furlong asked why
these neighborhoods were having problems. Staff discussed the need for additional wells to meet
city demand as additional residential development continues. Councilman Labatt asked where
Well //9 was being proposed and how was it proposed to be funded, individual or city wide
assessments. Teresa Burgess stated that. hopefully the University of Minnesota Landscape
Arboretum would participate in the cost of running water in that area of the city. There was
discussion over painting or abandoning the back-up water tower located on West 76th Street, and
staff indicated they would provide a cost benefit analysis for the council. Staff discussed the
projected capital improvement over the next 5 years. Councilman Lundquist asked what the cost
was for a new well. Councilman Ayotte stated he would like to see fighter figures on cost. Staff
indicated that was the purpose of the feasibility study. Regarding the historical water rate
increases, Councilman Labatt asked for clarification on the amount of revenue lost due to not
increasing fees. Council and staff discussed well construction and the cost of a water treatment
plant. Mayor Furlong commended staff on a good presentation. He stated it breaks down into
wells and distribution. New wells should be paid for through development. He stated he would
like to see a complete financial projection for the next 5 years on capital investment, cost vs. debt,
and build in some different scenarios for council to discuss. Todd Gerhardt asked for clarification
on how the council wanted to proceed, and with what consultant. Councilman Peterson stated he
would like to see a treatment vs. non-treatment scenario brought back for review. Mayor Furlong
summarized direction to staff, to address distribution and the Minnewashta loop, construction of
Well//9, Study Well//4 and see if it can be moved from 2004 to 2003, and prepare a "do nothing"
study. It was decided that since SEH has already done some work reviewing the Black and
Veatch study, to ask them to continue working with staff to address the council's concerns.
Mayor Furlong adjourned the work session meeting at 10:15 p.m.
