may reduce this need. All flagging must be in compliance with the 2001 edition
of the Minnesota Flagging Handbook.
Hours of operation shall be limited to dusk tilt 10:00 p.m. with the exception of
November 27th, December 24th, December 25th, and December 31st, when the
hours of operation shall be limited to dusk till 1:00 a.m.
7. The loud speakers shall not be audible from any of the adjoining properties with
the windows and doors shut.
8. The property oxvners shall provide contact information where someone can be
reached 24 hours, 7 days a week during the display.
The property owners will sign an agreement acknowledging the conditions of
approval and that violation of any of these conditions may result in immediate
revocation of either or both of the temporary parking permit and the loudspeaker
permit. In addition, the property owners may be held liable for costs incun'ed by
the City for enforcement of the conditions or the agreement.
A public hearing is not required for this item; however, prior Council discussion of the
Christmas display had directed that the neighbors be given an opportunity the next time
this item came before the Council for public cornment. A notice was sent to all
properties within 500 feet. Written comments that xvere received by the time the staff
report was mailed are attached. Any comments received after that will be handed out at
the City Council meeting.
RECOMMENDED MOTION
Move to approve the temporary lifting of no parking restrictions as shown on the parking
permit for November 27, 2002 through January 12, 2003 with conditions 1-9 listed in the
report.

TEMPORARY LIFTING OF NO PARKING RESTRICTIONS
o
GENERAL REQUIREMENTS
Complete an application to allow parking in a no parking zOne. Applications should be
submitted to the City at least 2 weeks prior to the planned event.
2. The City will review the application to see that the following criteria are met:
a. The applicant has obtained consent of the properties abutting the designated area. The
applicant shall provide documentation that this requirement has been met.
b. The parking does not create a hazard to public safety or violate any State or Municipal
ordinances or requirements.
c. The parking will occur on only one side of the street if both sides have been designated as
"no parking" areas.
3. The parking shall only occur on the days and times designated on the approved application.
4. No parking shall he allowed in the following:

a. On a sidewalk.
b. Within 5 feet of a driveway.
c. Within an intersection.
d. Within 10 feet of a fire hydrant.
e. On a crosswalk.
f. Within 20 feet of a crosswalk or intersection.
g. Within 30 feet of a stop sign or traffic control device.
Applicant shall be responsible for the pick up of trash and garbage resulting from the lifting of
the no parking restriction within 12 hours of the end of the event.
The City reserves the right to revoke or limit the number of permits allowed for any given area
based on problems observed by the City or excessive complaints.
The permit allows for lifting of no parking restrictions for periods up to one week at no charge.
Periods longer than one week require City Council approval and a $20.00 per week fee to cover
the cost of a weekly site visit by City Staff.
8. The City of Chanhassen reserves the fight to approve or deny any request.

christmas display and parking Lake Lucy rd
I live directly across the street at 1630 Lake Lucy rd. I have many
reservations regarding the parking issues. Whether the ban is lifted or
not
people will continue to park where they want when they want. It's always
been a
huge issue in the past. My.driveway is usually a hot spot as well. I
think if a
display to this magnatude is to go on the City needs to moniter trafic
every
night the lights are on, especially if the parking ban is lifted. Trafic
on
Lake lucy rd is already as you know at a very high level. On a regular
day it's
hard to get into my driveway or to the mail box without being hit by a
car. I
respect the right to have the christmas Display but again the cars, tour
busses
and limos are a problem. We need to look at the whole trafic picture
before any
judgements are made to lift the parking ban. I also have a firehydrant
in front
of my home that in the past was continually blocked. I will not make the
October meeting but would appreciate your comments on what I have said
here. If
the ban is lifted and the road is not monitered I think we will have a
big
problem as we have in the past. Thankyou for considering my comments.

Dear Teresa,
We have a driveway adjacent to the Kendall's property (east side) on Lake Lucy Road as well as a
home and driveway on Steller Court. Under no circumstances would we like to see the No Parking
ban temporarily lifted for the Christmas display. The reasons for this position have to do with
access, safety, congestion and privacy. Sandy and Bob are wonderful neighbors who choose to
show their Christmas spirit with a large display. However, lifting the No Parking ban crosses the
line between having a private display in a residential neighborhood to putting on a public exhibit
that should be held in a park or commercially-zoned area.
Thank you for considering our opinion in this matter -- the fact that you ask is one of the things we
like most about Chanhassen.

P.S. Why not have the Kendall's set up the display at Lake Ann Park where more people could
either drive by on the frontage road or park in a parking lot to view the display on foot? The viewers
would benefit from the safer venue, the city would benefit from more visitors, the neighbors would
benefit by less congestion when driving or walking along Lake Lucy Road, and the Kendall's would
probably receive more contributions for their donation to Little Brothers Frie/~ds of the Elderly.

Christmas Display
We are submitting this letter and petition to you to obtain permission to apply for whatever
waivers or variances are necessary to do our annual outdoor Christmas display.
As most of you know, our display is quite large--we believe it to be one of the largest in the
Twin Cities. As such, it takes literally months to put it up which is why we are trying to address
all concerns at this point. Due to some health and other reasons, we could not do the display last
year; however, we received literally hundreds of cards, letters and calls from people both lo~ally
in Chanhassen as well as in other cities telling us how much the display means to them and has
become a holiday tradition, so we are hoping to again be able to do it this year.
Due to the nature of our lot and type of display, however, there are certain issues we need to
address in order to do the display at all...which is the reason for this letter:
1)
There is presently an ordinance for a 50-foot front setback. Without a variance for this. we
could not do the display. The topography of our lot is such that it is level in the right-of'way
area and then steeply slopes downhill to a gully-like area, after which is rises agai~ far back
to the rear where the manger is displayed on the hill. The only place we have to put figures
is within this level area--which is within the right-of-way and definitely within 50 feet. If
this were not waived, we could not do the display as the }0 feet would end going down the
hill and at the bottom of the hill where no one could see anything from the street. Within this
front area to the east of our driveway, we decorate the large pine trees and intermittently
place wooden figures which are lit by spotlights to the front of them/pointing toward th~ rear
of the yard. Within this front area to the west of our driveway, is our little village of lit
houses (the Bear House, the Gingerbread House, S'puds' House, the Three Little Pigs Houses,
and--farthest down to the west--Christmas Around the World. In all instances, this is the
ONLY area level enough to put these things. In fact, the pig houses and Christmas around
the World are all put UP the hill due to the topography of the land (after which there are large
trees), so this is again the ONLY place these things can go. The spotlights to light them from
the front also need to go within this area; it is the ONLY way to light them.
We would like to point out that we own a Bobcat, and Bob is extremely proficient at
operating it. In consideration of the fact that we need to use these areas within 50 feet and
withint the right-of-way, we have always not only kept these areas clean of snow--but we
have always plowed the entire side of the street in front of our lot/these areas--always before
the count)' plows go by. We do this so that the plows will not have to slow down or give any
different treatment to our lot because the display is there.
2)
Permit for loudspeakers or music. The only areas we use music or speakers at are in 3
locations: 1--Christmas Around the World (we just have a small tape recorder and one
speaker which is only turned up loud enough to be audible from in front of the display.
Although one time it got inadvertently turned up too loud, this is the only time this happened,
and we've monitored it constantly ever since. The neighbors directly across the street from
this display have told us they cannot hear it at any time.) 2--The Manger (we have soft
music playing at the site of the manger and can only be heard when one is up there; it cannot
be heard from the street or any other part of our lot. 3--The Carousel (we have a CD that we
personally recorded from a real caliope of Christmas music. We try to turn this up loud
enough to hear from in the driveway (which is where the lighted carousel is located), by
Santa's sleigh, and in areas as you walk down our driveway.) People comment how much
they love the music and how much it adds to the happiness and festivity of the display.
3)
Parking on Lake Lucy Road. Without parking being allowed on Lake Lucy Road, we would
not be able to do the display. Due to the nature of the display and the limitations the
topography of our lot provides, parking on the street is a dire necessity. There is simply no
way we could do a display that people could only drive by...and even if this were possible, it
would be a literal nightmare due to the fact that traffic would come to a standstill and would
not move at all. The ability to park and walk around the display is the only way to keep the
traffic moving--and to see the display at all. Without parking on the street, there would be no
way to see Santa in his sleigh (in our driveway), the manger, or 90% of the rest of the
display.
It is important to '14now that we have NEVER had one incident with traffic or any type of
injury due to parking on the street. People are VERY careful when getting out of cars and
cross the street slowly. Passing cars move very slowly when the display is on and ~ee have
provided at our own cost and time huge signs fi~om MnDot comingfi~om both directions,
advising people to show down, there is a display ahead, watch for people crossing the road,
and other pertinent messages. ~JZe have these made, put them up, take them down, and
monitor them in every way every day. We even have MnDot reflective vests that we wear at
night to monitor traffic and cars. We also provide' and place at our own expense cones and
reflective blinking sawhorses to keep cars from pa~*king in front of our neighbors' driveways
as well as our own. Many Carver County deputies have spent much time at the display and
can verify how well things are monitored and that there have never been any problems at any
time.
It has always been our intent to bring smiles and happiness to people through the display in
celebration of Christmas and the birth of our Lord, Jesus Christ. We feel this is even more
important now after the events of September 1 lth and the terror and fear in the world today. We
have tried our best to be responsible citizens and to provide whatever means are necessary to
make the display a source of joy to people and pride to our city and community. We have had
people from all over the world come to our display, not to mention the Twin Cities and
Minnesota. The display has been on all local TV stations and has also been featured on the
major networks. Two years ago, Channel 11 won a national emmy award for its feature of our
Christmas display. Last year, we had people from New York call to get directions here as they
had seen it on Good Morning America and wanted to detour from the Christmas they were going
to spend in Iowa--just to come see our display (which we were not able to do last year,
unfortunately, as stated before). We have received thousands of calls, cards, and letters from
people who count on the display to be a part of their holiday tradition~and who thank us for
taking the time and expense to ~to it. And we are happy and blessed to be able to still have the
means and health to be able to do it. We just have certain limitations (as described before) to our
lot to be unable to do it any other way--and so we need the City's permission to obtain the
variances and permits necessary to be able to do the display as our lot permits.
Due to the size and magnitude of the display, people come from great distances to see it...and
these people work many schedules. It is our intention to keep the display lit until 10:15 on
weekday evenings, and until midnight on weekend evenings. We have always kept it on all night
on Christmas Eve as many people come to see it after Midnight Mass; and all night also on New
Year's Eve although this is of less importance. We strive to turn the display on starting on
Thanksgiving Eve, and off the second Sunday after New Year's. It's a huge display that takes a
long time to set up and so we try to do our be'st to keep it lit to accommodate people as best we
can. Even small lighted houses stax,' on until 10:00+ weeknights and longer on weekends.
We thank you for ),our consideration and assistance in making whatever allowances are
necessary ~br us to be able to continue to give this gift of love to our community and people from
everywhere who come to see it.
