Award of Bid, Marsh Glen Trail and Pedestrian Bridge
On Friday, September 6 at 12:00 p.m., bids will be opened for the Marsh Glen
Trail and Pedestrian Bridge. The advertisement for bid sheet, bidder information
sheet, and bid schedule are attached. I will present the results of the bid opening
at Monday night's City Council meeting. Assuming a good bid is received, I will
also be recommending that an award be made that evening.

NOTICE OF
ADVERTISEMENT FOR BIDS
MARSH GLEN TRAIL AND PEDESTRIAN BRIDGE
The City of Chanhassen Park and Recreation Department will receive sealed bids for the
construction of the Marsh Glen Trail and Pedestrian Bridge. The trail is located east of
Highway 101 and travels from Mission Hills Lane north to connect to an existing trail.
The scope of' work includes, but is not limited to: approximately 1100 lineal feet of
bituminous trail and a 10' wide by 20' long pre-fabricated pedestrian bridge. Both the
trail and bridge will be built on or near ~ existing sanitary sewer line.
Sealed bids will be received at the office of the City Clerk until 12 Noon on Friday,
September 6, 2002, at the Chanhassen City Hall, 690 City Center Drive, P.O. Box 147,
Chanhassen MN, 55317. Bids will be opened and publicly read aloud at 12 Noon that
same day. Proposals shall be made on the Bid Form furnished in the Project Manual,
with the Bidder's signature in longhand. No oral, telephone or faxed proposals or
modifications will be considered.
All proposals shall be accompanied by a cash deposit, cashiers check, bid bond, or
certified check made payable to the City of Chanhassen for not less than five percent
(5%) of the base amount with each bid in accordance with the Instructions to Bidders.
The successful bidder will be required to furnish a one hundred percent (100%)
Performance Bond and Labor and Mater/als Payment Bond.
The City of Chanhassen reserves the fight to reject any and all proposals, to waive
technicalities and to award the contract in the best interest of the City. No Bidder may
withdraw a bid within sixty (60) days after the scheduled time of bid opening, without the
written consent of the City.
Contract Documents will be on file after the bid opening at City hall. Copies of
Construction Documents may be obtained at the office of the Landscape Architect for a
non-refundable processing fee of $40.00 (forty dollars): Hoisington Koegler Group Inc.

Bids will be received bythe City of Chanhassen (herein called the Owner) at the office ofthe
City clerk, Chanhassen City Hall, until 12:00 p.m. CDST, September 6th, 2002 and then at
said office publicly opened and read aloud at 12:00 p.m. CDST that same day.
Each Bid must bc submitted in a sealed envelope, addressed to The City of Chanhassen and
received prior to the time stated in the advertisement for Bids. Each sealed envelope
containing a Bid shall be clearly marked on the outsid~ of the envelope as a Bid for:
"Marsh Glen Trail and Pedestrian Bridge"
Faxed Bids will not be accepted.
Bids must be submitted on a duly executed copy of the Bid Form obtainable at the office of
Hoisington Koegler Group Inc. 123 North Third Street, Suite 100, Minneapolis, Minnesota
55401. Use the extra copy of the bid form for submitting bids instead of the bid form bound
with Specifications.
All blank spaces for bid prices must be filled in, in ink or typewritten, and the Bid form must
be fully completed and executed when submitted. Only one copy of the Bid form is required
as a submission.

Each bidder shall state on the bid form the Bidder's name, place of business, and exact post
office address. Anyone signing a Bid as an agent for another must file acceptable evidence
xvith the Bid of authority to do so.
If any person who contemplates submitting a Bid fOr this contract is in doubt as to the true
meaning of any part of the plans, specifications, or other proposed contract documents, they
may submit to the Landscape Architect a written request for an interpretation thereof. The
person submitting the request will be responsible for its prompt delivery. Any interpretation
of the proposed documents will be made only by addendum, duly issues, and a copy of such
addendum will be mailed or delivered to each person on record as receiving a set of such
documents. The Owner and/or Landscape Architect will not be responsible for any other
explanations or interpretations of the proposed documents.
The Owner may waive any informalities or minor defects or reject any and all Bids. Any Bid
may be withdrawn prior to the above scheduled time for opening of Bids or authorized
postponement thereof. Any Bid received after the time and date specified shall not be
considered. No Bidder may withdraw a Bid within sixty days after the actual date ofopening
thereof. Should there be any reason why the contract cannot be awarded within the specified
time period, the time may be extended by mutual agreement between the Owner and the
Bidder.

The Owner reserves the right to award contracts based on the various Bid Schedules
contained within each Bid Package, and to do so at any time within sixty days after opening
of Bids.
Bidders must satisfy themselves of the accuracy of the estimated quantities in the Bid
schedule by examination of the site and a review of the drawings and specifications,
including Addenda. After Bids have been submitted, the Bidder shall not assert that there
was a misunderstanding concerning the quantities of work or the nature of the work to be
performed.
The Contract Documents contain the provisions required for the construction of the Project.
Information obtained from an officer, agent or employee of the Owner or any other person
shall not affect the risks or obligations assumed by the contractor, or relieve him from
fulfilling any of the conditions of the Contract.
The bidder shall base the Bid on materials and equipment complying with the Plans and
Specifications, and will be responsible for furnishing materials and equipment which do So
conform.

Any Bid which stipulates that the work will be performed in a greater period of time than
that specified in the Special Conditions shall be deemed ineligible to receive the award of the
Contract.

The Owner shall provide to the Bidders prior to Bidding all information, which is pertinent
to and delineates and describes, the land owned and rights-of-way acquired or to be acquired..

Each Bid must be accompanied by a Bid Bond payable to the Owner for five percent of the
total amount of the Bid. As soon as the Bid prices have been compared, the owner will
return the Bid Bonds of all except the three lowest responsible Bidders. When the
Agreement is executed the Bid Bonds of the two remaining unsuccessful Bidders will be
returned. The Bid Bond of the suCcessful Bidder will be retained until the Performance Bond
and the Payment Bond have been executed and approved, after which it will be returned. A
certified check may be used in lieu of the Bid Bond.

Before the award of the Contract, the successful Bidder may be required to supply a
statement voicing their experience and competence to construct the work and as to his
integrity and reliability to carry out the provisions of their performance Bond and to their
resources for its vigorous prosecution.

A Performance Bond and a Payment Bond, each in the amount of 100 percent of the Contract
Price, with a corporate surety approved by the Owner, will be required for faithful
performance of this Contract.
15.0 State Sales Tax. Materials and equipment incorporated into this project are not exempt from

the payment of sales tax under the laws of the State of Minnesota, and such sales tax shall be
included in the bid amount.
Safety. The Contractor shall comply with all the latest requirements of the Occupational
Safety and Health Act, as directed by the U.S. Department of Labor, while perforating work
under this contract.

Conditions of the Project Manual.

Executive Summary - Variance to Allow a Single Family Home
Expansion to Encroach into the Required Setback of Rice Marsh
Lake
In 1982, staff approved a building permit for the construction of a single family
house to be located 139 feet from the OHW of Rice Marsh Lake (the ordinance
requires 150 feet). We believe that the measurement (186') was taken from the edge
of water rather than from the Ordinary High Water mark (139').
The applicant is proposing an addition to the house, which will maintain 125'
setback from the OHW.
On July 16, 2002, the Planning Commission reviewed and recommended approval
of this item with a vote of 4 to 3. Commissioners who voted to approve this request
found the close proximity to Highway 212/312 to be a hardship, there is a
preexisting standard of homes encroaching into the required setback within the
neighborhood, and the site is a unique spot.
Staff continues to recommend denial of this applicati°n.

STAFF RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council denies the requested 25 foot variance allowing a structure to
encroach into a lakeshore setback for the expansion of a home based on the negative variance
findings (a.) in the staff report."
Should the City Council decide to approve this application, staff recommends the following motion:
"The Chanhassen City Council approves the requested 25 foot variance allowing a structure to
encroach into the lakeshore setback of Rice Marsh Lake for the expansion of a home as shown on
plans dated June 6, 2002, with the following conditions:

Show grading limits on the registered land survey.
A tree preservation fence shall be installed at grading limits prior to commencement of
construction.
Maintain natural drainage patterns."
