Approve Construction Quote for Chapel Hill Sanitary Sewer
Realignment - Project No. 00-07
REQUEST
Staff requests the City Council approve the construction quote in the amount of $47,703
to Belair Excavating for work to be performed on the above-referenced project.
BACKGROUND
On January 8,2001, the City Council approved the construction plans and specifications
for this project. At that time, the property o;vner, Chapel Hill Academy, intended to do
the sanitary sewer realignment as a part of their site improvements. The approved plans
showed the applicant realigning the existing sewer main around the proposed gymnasium
addition.
Since then, Chapel Hill has discovered that the original easement, which covers the
existing sanitary sewer line, contains a condition which releases the property owner from
any responsibility if a building or structure is erected over the sewer line. Chapel Hill
brought this easement language to the attention of City staff who then contacted the city
attorney's office. The city attorney reviewed the easement document and concluded that
it is the City's responsibility to move the sanitary sewer line.
This project is an unbudgeted expenditUre. Payment will be made out of the utility fund.
DISCUSSION
Three quotes were received from construction contractors. The public bidding process is
not required on this project because the work is under $50,000 in cost.
Belair Excavating $47,703.00
RJ Marco Construction $50,000.00
Nodland Construction $80,360.00
The low quote by Belair Excavating, Inc. is 19% over the engineer's estimate. The
higher than normal cost can be attributed to the late time of year that the project ;vill be
built in.

Chapel Hill has recently applied for a building permit on the gymnasium so the existing
sanitary sewer line needs to be moved this fall.
RECOMMENq) ATION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council awards the construction work for the Chapel Hill Sanitary
Sewer Realignment to Belair Excavating in the amount of $47,703.00."
