_REOUEST
Staff has received a request from Steven Cohoon, the property owner at 7525
Bent Bow Trail, to vacate an existing portion of a drainage and utility easement
located in the rearyard of the applicant's property.
BACKGROUND
The existing drainage and utility easement was dedicated to the City as a part of
the Meadows at Longacres 2nd Addition plat. The easement was dedicated over
the existing wetland which covers the south hhlf of the lot.
DISCUSSION
The applicant wishes to build a swimming pool and retaining wall in an area that
would encroach approximately 40 feet into an existing drainage and utility
easement. The proposed easement vacation would eliminate the encroachment.
The City filled a portion of the original wetland to construct the trail which
pushed the new wetla_nd line to the south of the trail. To that, the original
drainage and utility easement adjacent to the north side of the trail is becoming
unnecessary.
RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council approves a resolution vacating a portion of the
existing drainage and utility easement located on Lot 13, Block 2 of the Meadows
at Longacres 2"d Addition as defined in the attached vacation description, subject
to the following conditions.

1. Show all existing and proposed contours on the lot survey.
2. No building shall be allowed over the drainage and utility easement.
3. Type III silt fence as per City Detail Plate No. 5300 must be used along
the north side adjacent to the existing trail.
4. Retaining walls over four feet in height must be designed by a registered
engineer.
5. A fee of $50 is required to record the easement vacation.

requirements and agency review. Therefore, the city is notifying the applicant that the city requires an automatic 60 day
extension for development review. Development review shall be completed within 120 days unless additional review
extensions are approved by the applicant.

Statement of need for Vacation of Utilit2,.' and Drainage easement
The subject easement in the area north of the public path, is not required due to the decision (attached) from
Laurie Haak that the wetlands delineation does not come north of the public path. Vacation of this
easement is required for pursuit of the homeowners' pool project.
This request does not impact the drainage and utilit-v easements on the side lot lines.
Due to the existing land contour in the area described on the survey, there is not need for either a drainage
or utility easement. --
