The applicant ~vishes to build a residence on the property in an area that would encroach across the easement. After researching the original subdivision files, staff can find no reason for the easement's existence. There are no current or proposed utilities within the easement. Nor does the easement contain a ditch or swale for drainage purposes. As such, staff finds no reason to retain the easement. RECOMMENDATION Staff recommends that the City Council adopt the following motion: "The Chanhassen City Council approves a resolution vacating the existing drainage and utility easement located on Lot 2, Block 1 of the Kolbinger Addition plat as defined in the attached vacation description, subject to the following conditions: 1. After our topographic survey ,,,,,as completed we realized there ,,,,,as a 20 foot easement straight up through the center of the site, with no apparent purpose. After meeting with two city engineers (Dan Remer and Matt Saum) to check the city's utility maps they confirmed that the easement has no apparent use. They would support an easement vacation allowing us to respectfully locate a home within the site. This site is not unlike many that I have successfully completed homes on.
