Requested Action
It is recommended that the City Council receive the attached feasibility report and
deny the above-referenced project.
Discussion
This project was initiated based on a petition from adjoining property owners and
was proposed to be funded through assessments.
After receiving the report, property owners shbwed great objection to the project
with an overwhelming response of 16-2 in favor of dismissal and a 33-signature
petition against the project.
The report considers improvements to Lake Susan Drive.

I. Introduction/Summary
This report presents info~Tnation concerning the construction of a sidewalk in Chanhassen Hills.
This sidewalk is proposed to run from Highway 101 to Lyman Boulevard along the north side of
Lake Susan Drive.
Municipal improvements proposed herein include the full construction of a sidewalk. A petition
from the homeowners of Lake Susan Drive initiated this project.
The costs of the proposed construction are detailed in Appendix A. Cost allocation and a cost
summary are presented in the Cost Analysis section. Financing for the project will come from
100% property owner assessments.
The City Council authorized preparation of a report on June 18, 2002. The report examines the
feasibility of completing municipal improvements consisting of excavating existing materials
and constructing a five-foot wide concrete sidewalk in the project area.
Assessments proposed in this report are consistent with past projects of this nature. The
proposed project assessment area consists of 52 lots and is shown in Appendix C. The proposed
assessments are based on the preliminary cost estimates and may be revised at the time of the
final assessment hearing.

Proposed Improvements
Residents along Lake Susan Drive would like to have a sidewalk constructed along the north side
of their road. Excavation of the present material will take place for the insertion of a five-foot
wide concrete sidewalk.
III. Cost Analysis / Financing
Cost Estimate
The estimated project cost to complete the improvements proposed herein are presented below in
Table 1. These costs include estimated 30% indirect costs: financial (2%), legal (5%),
administrative (5%), engineering (18%). The estimated indirect costs are reviewed at the time of
the final assessment hearing. This estimate does not include easement acquisition costs.

Assessments
Assessments are proposed for the petitioning properties as shown on Appendix C. A Preliminary
Assessment Roll is presented in Appendix B. The proposed assessments herein are consistent
with past practice and previous City Council direction concerning assessment methodology.

The homeowners to be assessed for this project are listed in Appendix B and shown in Appendix
C.
IV. Summary and Recommendations
The total estimated cost for this project is $94,607.80 including both construction and indirect
costs.
The following recommendations are presented for the Chanhassen City Council:
1. A formal public hearing should be held to discuss the proposed improvements and
assessments. All properties that are proposed to receive assessment will be notified of
the public hearing.

Relocating the sidewalk from the north side of Lake Susan Drive to the south side of the
road should be considered. The north side contains many hydrants, light posts, and
shrubs that would need to be relocated or removed. The south side of Lake Susan Drive
presents fewer obstacles for the construction of a sidewalk, therefore making the project
more cost effective and feasible from an engineering standpoint. The south side also
presents access to Chanhassen Hills Park. The north side location was based on
neighborhood input during the petition process.

Feedback from the assessed properties yielded a result of 2 residences in favor of the
project and 16 in objection. There was also a petition started against the project that
obtained 33 signatures.

Due to an overwhelming response in objection to the sidewalk, it is recommended that
the project be denied.

I talked with him personally. He wanted to know the reason the sidewalk petition began.
If it was for safety reasons, he stated that there are other things that could be done to
make the road safer. He does agree that the sidewalk should be placed on the south side
of the road because there is an access to the park but does not show high support for the
project.

Mr. Koenen,
We are outraged that such an expensive, and in our opinion, unneeded project
should be forced upon our small neighborhood. The existing pathway is perfectly
functional, and ! hope you will find whoever requested this addition is quite selfish
and in the minority.
~In addition, we are a single income family and rely on a very strict budget. To make
matters worse, my husband has been activated by the military due to the September
11 tragedy, which has forced us to make some great financial and personal
sacrifices. This assessment of nearly $2,000 will rob my children of money for their
future education, and given how the rest of our property taxes increase, may force
us to leave a community that we love and have enjoyed for nearly eleven years.
~I sincerely hope whoever is involved in this decision takes these comments to heart.

After reviewing the draft we would not like this proposal to go through.
The cost for each homeowner is very high. The point of a sidewalk is to get
our children out of the way of speeding cars. I think there are many other
options that should be considered.
One option mentioned in the draft was to relocate the sidewalk to the south
side of the street where there are less hydrants and other things to move,
so the cost would be decreased. I am not in favor of this option because I
don't want the sidewalk on my side of the street. The path to Chanhassen
Hills Park is adjacent to our property and we get enough dogs and people in
our yard already.
Since the whole point of the sidewalk, is to keep the children out of the
line of speeding cars, the following are some of the options that should be
considered:
-Create a pavement path, instead of a concrete sidewalk to reduce costs.
-No sidewalk, but add stop signs at all intersections along Lake Susan Drive
to slow down traffic.
-No sidewalk, but add speed Humps (not bumps) to Lake Susan Drive to slow
down traffic.
-No sidewalk, but add a white line along one side of the road as a
walkin~biking lane with no parking on that side of the road.
-No sidewalk, but start a no speeding campaign in the neighborhood. This
could include the sign that displays your speed and increased officer
patrolling.
-No sidewalk, but reduce the speed limit to 25 mph.
Again, as homeowners that may be assessed, we are concerned about the speed
of traffic on Lake Susan Drive, but feel the proposed plan to too expensive.
There are plenty of other options 'that may be less expensive and achieve the
same result.

I own 1 of the 52 properties that would be affected. I have a few key
questions:
1) If the sidewalk will be used by all members of the Chanhassen Hills
Community why is it proposed that only the properties in which the
sidewalk runs through pay for it? If anything everybody, BUT the
properties affected should pay for the project because of the
inconvenience (both during construction, and maintenance of ...cutting
grass around it ...sump pump house underneath it...etc.)
If the answer is that the property value increases because there is a
sidewalk on it, I would say that, that is false to the point of it
decreasing property value.
2) Who will clear the sidewalk of snow and ice?
3) If it is cheaper and more useful to have the sidewalk on the South
side, why would placing it on the North side even be considered.
4) If I am paying for 100% of the cost of the sidewalk running through
my property, and assuming I am responsible for clearing snow from it,
can I set up a toll gate and charge 50 cents for each person that wishes
to cross to recoup my my expenses?
If the answer is that I can not because the sidewalk is on public
property, I would like to know then why only I am paying for it and not
the public?

Dear Jeremy,
We received the the draft feasibility study for installation of a sidewalk
adjacent to our home on Lake Susan Drive and wanted to send you our
comments.
My husband and I are against the proposal for the sidewalk. While we
certainly feel there is some good that would come out of having a sidewalk
in the neighborhood, we simply cannot afford the additional taxes that would
be assessed to our property as a result of the project. My husband was
recently laid off from his job and has not had much luck finding a new one.
This leaves us with one income to pay for our mortgage and bills, as well as
care for our family. The additional tax would be a great burden for us right
now (as I'm sure it is for many households during the current economic
conditions).
I'm not familiar with the process for such a project, but it seems more
logical to divide the costs up among all the homeowners in the neighborhood
who would probably use the sidewalk rather than assessing just those who
live along the sidewalk path. It's a public sidewalk that should be funded
in part by the city and all houses in the neighborhood (not just the houses
on Lake Susan Drive). In that way, the assessment foi' each house would go
down, wouldn't it? It just seems like $1,819.38 is quite a hefty raise in my
property tax for something that someone two blocks away on another street
will also use.
Thank you for the opportunity to voice our concerns and comments. I hope
that the city of Chanhassen will take our comments into consideration.

The Lake Susan Drive Sidewalk Project should be dropped for the following
reasons.
1. We do not want a sidewalk in our front yard. We built our house 11
years ago thinking that we would never have to worry about the problems
associated with a sidewalk next to our property. Don't make us change or
pay for something a few people want.
2. Chanhassen residents already have one of the highest property tax rates
in the metro area. This cost puts another BIG burden on the assessed
homeowners. We are a one income family with three kids and cannot afford to
pay $1800 for a sidewalk. Don't make us cut back on our already modest
lifestyle.
3. The economic climate does not support this type of "Frills" project.
Many people including myself are currently facing uncertainty in our jobs.
Don't put this burden on me and my family.
Please put an end to this project study now!

I'm writing in response to the sidewalk proposal on Lake Susan Dr. I feel I was mislead
and not completely informed of the details of this project. First of all, I specifically asked
where the sidewalk would be, and I was told on the north side. Now all of a sudden, after
the signatures, they want it on the south side. I do not want a sidewalk going through my
yard. It not only decreases the size of my property, but it increases the walking and biking
traffic directly in front of my house. Second, I was not informed of the cost and that we
would be paying for the project let alone 100% of it. Almost $2,000 is alot of money for
many of us especially with the state of the current economy. We are already one of the
highest taxed cities around, and we can probably expect a referendum come fall to raise
taxes to support the new schools needed. This is not the right time to be asking people to
dish out thousands of dollars. If the reason for the sidewalk is for our childrens safety,
that is not going to solve the problem. The problem is speeding cars, and a sidewalk
won't slow them down. If anything, they will feel more comfortable to go faster. What
happens when our children are running back and forth across the street to a friends house,
or when they need to cross the street to go to the park. Our children will still need to cross
the street at some point regardless if there is a sidewalk or not.Why not spend only
$10.00 to $20.00 on signs to caution traffic to slow down. That is called operation
leadfoot I believe and has been proven to work in other neighborhoods.Or, get everyone
to call the sheriff to set up a speed trap. Afterall, we are paying for police service in our
taxes already. Spending $10.00 to $20.00 sure is alot easier on us than spending
thousands. After re-evaluating the proposal and feeling mislead about the details, I really
do not see the need nor do I want a sidewalk being constructed in our neighborhood. We
need to slow traffic down. A sidewalk is not the answer. I appreciate people being
concerned about the childrens safety, but there are other, better and cheaper ways to solve
this problem.

Subject: Sidewalk Proposal- Lake Susan Drive
I have been out getting signatures on a NO SIDEWALK PETITION over the last
week. I have signatures from 33 home owners along Lake Susan Drive. Does
majority rule? We all hope so. I will keep going if need be. It is just hard to
catch people at home. I know I could get more signatures. I was also able to get
8 signatures from people that had originally signed the petition to get the
sidewalk. They did not realize the cost at the time they signed. Most of them
just thought the city would pay for it. Would the city clear the sidewalk of snow?
When I lived in Bloomington it was up to the homeowner to clear all snow. Not
fun when you live on a corner like I do. 150 feet of a 5 ft. wide sidewalk. Not to
mention the liability.
A sidewalk is the last thing we need in our neighborhood. Our streets are plenty
wide for walking and riding bike, plus we do not have a lot of traffic. I
know their concern is cars driving too fast. A sidewalk is not the answer. I am
not about to pay for or upkeep a sidewalk for neighbors that just want it for their
kids to play on. We have a wonderful park and park path that they can take their
kids to.
I have lived in the neighborhood for 9 years. My kids were 15 months and 5
years old when we moved in. I had to watch my kids when they were playing
outside. That is what parents do. I know that the strategy here is to be able to
let their children play outside on the sidewalk without supervision and without
worrying that they are on the street. Maybe they should think about how much
easier it is for someone to back out of their driveway and run over a child playing
on a sidewalk.

Subject: installation of sidewalk along Lake Susan Drive
My husband and I live on the north side of Lake Susan Drive,. We have lived
along this street for 11+ years. We are opposed to the installation of the
sidewalk, we feel it is a waste of money. We, also were not aware of any
petition until this information arrived in the mail. I know that the speed
of the cars on the street is a concern. Many people want to blame the drive
thru traffic from Lyman Blvd to Hwy 101 as the cause, but many of the
speeding cars are owned by the people who live in the neighborhood. Many
would like to blame it on the teens of the neighborhood, yet many of the
cars that I see barely make the curve near our house are driven by adults.
The best solution to the problem would be to slow down. This could be
achieved by extra stop signs and a few speed bumps, and of course this would

To Whom It May Concern,
I am in favor of the proposed sidewalk adjacent to Lake
Susan Dr. I would support the construction of the sidewalk
on either side of the street. I believe the sidewalk will
be an asset to our neighborhood. The sidewalk will make
it safer for our children. As it is now, the children
must walk on the street or cut through neighbor's yards to
get to the park. A sidewalk would make the walk safer.
Safety is also an issue for adults who walk and.jog
through the neighborhood as we have a problem with people
speeding on Lake Susan Dr. I believe that a sidewalk will
also raise property values. Sidewalks would make our
neighborhood more attractive to potential buyers. In
conclusion, I believe the proposed sidewalk project would
be beneficial to me as an individual homeowner as well as
the community.

We definitely do not support the installation of a sidewalk under the current proposal.
Why ---
The 52 families picking-up the expense of this project will not be the only
families/people using the sidewalk. Therefore, why are we expected to pay the entire
cost. This proposal/assessment must be revisited.
I would like to know --- Who gave the city the authority to openly publish my name and
mailing address without my written consent. There is no reason the property owner name
should be published in this letter. This is extremely disturbing.
What is the $28,000 for contingency/indirect costs for? On the surface this
seems outrageous.
How many proposals were received for this project?
