Approved Revised Easement Agreement for Parcel 9

REQUESTED ACTION
Approve the revised easement agreement and payment of $7,582.30 for a
temporary easement for the BC 7 & BC 8 utility extension project.
DISCUSSION
During the utility extension project, the City needed to divert traffic from
Tanadoona Drive to a temporary bypass road. The City acquired a temporary
easement over an existing driveway as part of the bypass route. As part of the
easement negotiations, the City agreed to reconstruct the section of driveway used
for the temporary bypass route.
The propel~ry owner has contacted the City and desires to do the entire driveway
instead of just the section used as a bypass. In addition, the property owner's
schedule does not match the City's project schedule. Therefore, the property
owner has requested a cash payment equal to what the City would have paid for
the reconstruction and has agreed to release the City from reconstructing the
driveway.
Approval of this revised agreement will not increase costs to the project since the
amount calculated is based on the actual bids to do the work. The City will
process a separate change order to reduce the quantities on the Construction
Contract equal to the amount being paid out in this settlement.
In addition to better accommodate the property owner's needs, this agreement will
also release the City from any warranty issues related to the new driveway.
