SUBJ: Assessment Hearing for Lyman Boulevard Road & Utility Project No. 93 -32B
The Lyman Boulevard Road and Utility Improvement Project No. 93 -32B is substantially
completed and the only work remaining on the project is some minor punchlist items, including
some additional property restoration dealing with property owners. Therefore, the final cost of
this project can now be defined very closely and, accordingly, the assessment hearing can be held.
Attached is the assessment roll as prepared by the project engineer, David Mitchell of OSM.
Formal notice of this assessment hearing has been published in the local Vill ter newspaper as
required and individual assessment notices detailing the proposed assessment have been mailed to
each affected property owner accordingly.
The resulting assessment rates for trunk sanitary sewer and watermain, lateral sewer and
watermain, and street reconstruction have remained relatively the same as that estimated in the
feasibility report. Trunk charges have been held at those which were the standard charges when
the feasibility study was approved. The lateral sewer and water charges have remained the same
and the road and storm drainage improve costs have been established at $1,632 for the frontage
unit rate for properties fronting on Lyman Boulevard and $800 per unit for properties along Lake
Riley Boulevard and Quinn Road which do not front on Lyman Boulevard but must use Lyman
Boulevard to ultimately access their property. This practice of establishing a reduced, area -wide,
off -road assessment is consistent with similar reconstruction projects that have taken place in
recent years.
As of the printing of the Council packet, three letters of objection have been formally received by
the City. The first objection received from the Jesberg's at 8407 Great Plains Boulevard, PID No.
R25- 01.35900, is associated with the possible future acquisition of their property with the Trunk
Highway 1.01 alignment. The Jesberg's do not believe that the watermain improvements made
along their property will benefit them in the future. One could argue that the value of the
property in an acquisition is higher with city utility improvements versus a private septic and well.
The proposed assessment to the Jesberg's amounts to $1,375 for one trunk watermain unit and
$2,500 for one lateral watermain unit. As a compromise, staff might suggest that only the trunk

watermain need be assessed at this time for the area of benefit and that the lateral charge -not be
collected unless the Jesbergs actually connect to City water. However, this decision staff will
leave to rest with the City Council.
The - second letter was received from the Prewitts at 4121 Lyman Boulevard, PID No. R25
0241100. Most of the objections that the Prewitts have stated in their letter relate to work that
has not been Y
completed et in terms` of restoration and such with regard to the property and minor

details ( see attachment). Staff will be checking with the city attorney on the status of the
easement payment and a formal written response to each of the work items listed in the Prewitt s
letter will be sent to the Prewitt's and a copy given to the Council at the meeting on Monday,
night.

1. Non - developing homestead parcels are assessed at a rate of 1 unit per 10 acres for utility improvements.
Remaining units will be collected at the time of development as hookup and connection charges.
Street assessments are fully assessed based on anticipated ultimate development.
2. Street and storm sewer assessment includes $24,820.38 for storm sewer through the Sunnyslope area

Assessment may be paid in full without interest or other charges within thirty (30) days after
the assessment hearing date. These payments may be made in person or may be mailed to
Chanhassen City Hall, 690 Coulter Drive, P.O. Box 147, Chanhassen, MN 55337, Attention:
Treasurer. Please indicated the parcel number on your check. Partial prepayment of the
assessment is permitted.
If you elect not to pay the full amount within thirty (30) days after the hearing date, the
assessment will be spread over eight (8) years, with installments appearing on your real estate
taxes beginning next year. Interest will be included at the rate of eight percent (8) of the
unpaid balance.
The proposed assessment roll is on file with the City Clerk. Written and oral objections to
the proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a written
objection signed by the affected property owner is filed with the City Clerk prior to the
assessment hearing or presented to the presiding officer at the hearing.
All written objections to the assessment not received prior to or at the assessment hearing in
the above matter are waived, unless failure to object prior to or at the assessment hearing is
due to a reasonable cause.

Chanhassen within thirty (30) days after the adoption of the assessment and filing such notice
with the District Court within ten (10) days after service upon the Mayor or City Clerk.
Residents who are 65 years of age or older, or retired by reason of permanent and total
disability may apply to have payment of the assessment deferred. The application shall be
made to the City Clerk within thirty (30) days after the adoption of the assessment roll by the
City Council.
City staff will be available between the hours of 8:00 a.m. to 4:30 p.m. weekdays until the
time of the public hearing to answer questions about the proposed assessments. You may also
telephone City staff at (612) 937 -1900 extension 106.
You will be notified by mail of any changes adopted by the City Council in interest rates,
prepayment requirements, or the amount of the adopted assessments from those contained in
this notice.

In response to your letter notifying us of the public hearing on September 8, 1997 we are
submitting this written objection to the special assessments that.are being made on our
property, Parcel No. R25- 0135900.
The reasons we are objecting to the assessments are mainly because of something that is
out of our hands. The city of Chanhassen is going to buy out our property for the future
realignment of Hwy. 101. Making improvements to our property makes little sense since
the house is not going to be there for long. The lateral water main will never be needed
because there will be not be a house in which to connect a water line. Also, we are certain
that our existing well will last for as long as the house is going to be standing in its
present location. Furthermore, we feel we should not have to pay for the trunk water
main for the reason that we will never be able to realize the benefit (we question the use
of the word benefit) of having the city water. Lastly, at the public meeting that was held
prior to the start of the project, we brought this up and were told that something will be
worked out when the time comes, which is now.
We will be at the public hearing on Sept. 8th to discuss this further unless you would like
to meet with us privately since this seems to be a special 'circumstance. You can reach us

Dear City Clerk:
We received the assessment notice for our Parcel No: R25- 0240700. We
understand and agree to the charges for the Trunk Water Main of $1,375
and for the Lateral Water Main of $2,500. This summer we "hooked up" to
city water and in the process, signed an agreement with the cit_y to_ pay
these two charges.
We do not understand the Street and Storm Sewer charge of $800. We live
on Lake Riley Blvd. and no improvements were made to our street, nor
,were any improvements made to the storm sewer system on our street.
Therefore we object to the charge of $800. We expect that sometime in

the future Lake Riley Blvd. may be improved, and should that occur, we
would expect an additional assessment at that time.
We would appreciate a written response to this objection. If you cannot

Dear Mr. and Mrs. Sitter:
I received your letter dated August 31, 1997 as a written objection to the road assessments associated with Project
No. 93 -32B. I have included your letter in the City Council's packet. You also asked for a written response to
your objection. Therefore, I am sending you this letter.
With regard to the proposed $800 assessment to your property for the Lyman Boulevard road and storm drainage
improvements, this was the same amount that was shown with the feasibility study dated October 24, 1994 and
approved by the City Council. This proposed road assessment to your property is considered an area assessment.
Even though your property is not located on Lyman Boulevard, you, as well as all of the other property owners
along Lake Riley Boulevard by nature of the area road system, must make use of Lyman Boulevard in order to get
to Lake Riley Boulevard and ultimately to your property. It has been the City Council's policy on similar road
improvement projects in the past to establish an "off- road" area assessment. to all properties who must make use of
the improved roadway to access their properties. This off -road area assessment is less than the assessment being
paid by properties who actually have frontage and take access off of Lyman Boulevard. The lesser, off -road area
assessment rate takes into account the fact that you and the other property owners along Lake Riley Boulevard will
someday be responsible for additional special assessments associated with improving the street on which you are
located.
In conclusion, properties fronting on Lyman Boulevard are paying approximately double the road assessment rate
that off -road properties are paying. This road assessment methodology was discussed in great detail at the
neighborhood meetings and at the public hearing when the feasibility study was approved by the City Council and
the road assessment amount proposed to be levied against your property is the same as that estimated with the
approved feasibility study. Therefore, I must continue to recommend the assessments accordingly.
