1 SUBJ: Consider Certificate of Compliance for McGlynn Park 2 Addition

1 Staff has received a request from the developer, Mr. Dan McGlynn, for a Certificate of Compliance for
the conditions set forth in the development contracts for McGlynn Park 1" and 2 Additions. Staff has
reviewed the site and finds the subject properties are in general compliance with the requirements of
1 said development contracts except as conditioned in the certificate. Attached is a Certificate of
Compliance for each development.
1 It is therefore recommended that the City Council approve the attached Certificates of Compliance for
McGlynn Park and McGlynn Park T Addition.

CERTIFICATE OF COMPLIANCE
CERTIFICATE OF COMPLIANCE granted
CHANHASSEN, a Minnesota municipal corporation ( "City").
WHEREAS, the City entered into that certain Development Contract dated September
11, 1996, between the City and SHAMROCK PROPERTY PARTNERS L.L.P. filed
November 21, 1995, as Abstract Document No. 187964 in the office of the County Recorder,
Carver County, Minnesota (the "Development Contract ").
WHEREAS, the City has been requested to issue a Certificate of Compliance pursuant to
that certain Development Contract concerning Outlots A and Lot 1, Block 1, McGlynn Park 2 °d
Addition, Carver County, Minnesota (hereinafter "subject property"); and
WHEREAS, the development work has been completed and the City has determined that
it is appropriate to issue such a certificate.
NOW, THEREFORE, BE IT RESOLVED BY THE CHANHASSEN CITY
COUNCIL:

1. Except as set forth in Section 3 of the Certificate, the subject property described above is
in compliance with the requirements of said Development Contract. '
2. The subject property is hereby released from the financial obligations created by the
aforementioned Development Contract with the exception of unpaid park charges and '
special assessments that have been levied or are pending against the subject property, if
any.
3. The following requirements by the Development Contract have not been completed as of '
this date: '
a) As -built construction plans of the public improvements.
b) The developer's surveyor shall submit a written notice to the City certifying that the t
property corners have been installed pursuant to Minnesota Statute 505.02,
Subdivision 1. '

c) Payment of outstanding development inspection fees or attorney's fees.
d) Two -year maintenance bonds for street and utility improvements from the contractor
(acceptance date of September 23, 1996).

WHEREAS, the development work has been completed and the City has determined that
it is appropriate to issue such a certificate.
NOW, THEREFORE, BE IT RESOLVED BY THE CHANHASSEN CITY
