Assessment Hearing for Lake Riley Area Phase I Trunk Utility Improvement
Project No. 93 -32A
This is the assessment hearing for the Lake Riley Area Phase I Trunk Utility Improvement Project
1 No. 93 -32A. The project consisted of the extension of trunk watermain along Trunk Highway
101 from its current terminus at Lake Susan Drive and extending north to the new intersection
with 86`" Street and extending east into the Mission Hills development and the construction of
1 trunk sanitary sewer along Trunk Highway 101 from the Mission Hills development north along
Trunk Highway 101 to the Lake Ann Interceptor. As required by Minnesota State Statute 429,
all properties deemed benefiting from this improvement project were notified by U.S. Mail of this
1 assessment hearing date. These property owners were also notified of the project and the
feasibility hearing at the project inception back in the summer of 1994. Notice of this hearing has
1 also been published as required in the local newspaper.
To date (prior to Council packet printing), a total of four written objections to this assessment
1 have been received (see attachments and corresponding responses). The first objection received
from John A. and Judith Hruby of 8544 Mayfield Court, PID 25- 5310520, denies any financial
responsibility with regard to this assessment based on information contained in their closing
1 papers conducted by Stewart Title.
Resuonse: This is one of the new properties located in the Mission Hills development for which
1 these pending assessments were escrowed by the seller (Rottlund Homes) at the time of closing.
Therefore, these moneys will be paid directly from an escrow account. Staff assumes that this
objection letter from the Hrubys is basically confirming that point.
1 The second objection letter is from Mr. Wayne E. Holtmeier of 8524 Great Plains Boulevard, PID
25- 0135400. Mr. Holtmeier contends that his property does not benefit from this water project
1 since his property line is at least 400 feet from the trunk watermain and there is not access to it
unless a lateral watermain is brought over to his property.

Ressnonse: Mr. Holtmeier is partially correct in that, in the future, a lateral line will need to be
brought adjacent to his property in order for him to connect. At that time, a lateral watermain
charge will have to be paid by Mr. Holtmeier. However, at this time, Mr. Holtmeier's property is
within the defined trunk watermain service area and therefore the trunk water assessment is
deemed due at this time as a part of the project. Unfortunately for Mr. Holtmeier, it does not
appear that his neighbors are in support of extending a lateral watermain at this time. Staff
recommends that this trunk watermain assessment be levied.
The third objection was received from Mr. Terry Owens of 8520 Great Plains Boulevard, PID 25-
0135200. Mr. Owens is objecting to the trunk watermain assessment of $1,375 based on the fact
that a new well was put in for his property four years ago and that he will not be using the
watermain at this time. Note that Mr. Owens is a neighbor of Mr. Holtmeier who submitted the
previous objection letter.
Response: Again, this property is deemed within the serviceable area for the trunk watermain
improvement. Future connection to the City's water system will require that a lateral watermain
be extended along Mr. Owens' property (similar to Mr. Holtmeier's). However, as has been the
policy by the City regarding trunk utility improvements, the trunk assessments are levied to all
properties within the defined service area regardless of whether or not the property owner intends
to immediately connect to the system. The trunk utilities are an area -wide benefit, not an
immediate or direct connection -type benefit.
The final objection letter received to date is from David and Sharon Nickolay of 8500 Tigua
Circle, PID 25- 7400060. The Nickolay's object to the trunk watermain assessment in the amount
of $1,375 against their property based on the contention that they already paid once for the water
and sewer improvements and should not have to pay again.
Resnonse: When the Rice Lake Manor subdivision was platted back in 1980, the developer was
able to provide sanitary sewer service to the lots via an existing adjacent trunk line. Therefore,
sanitary sewer assessments were paid previously by the properties in the Rice Lake Manor
subdivision. However, trunk watermain was not available to this area. When the original street
and utility improvements were being made, the developer decided to install a dry lateral
watermain beneath the road through the neighborhood. The thought was that at some point in the
future when the City extended trunk watermain to the area a connection could be made to the dry
watermain in place without having to tear up the street. The Nickolays are correct in that the cost
of putting in the dry lateral watermain was probably paid by them through the purchase of their
property. However, the City has now invested dollars to extend trunk watermain to serve this
area and therefore the one unit area trunk charge for watermain of $1,375 is appropriate. The
Nickolays have also submitted a copy of an assessment search for the property which indicates
that they had paid for sewer beginning back in 1980; however, no trunk watermain charges have
ever been levied against this property or any of the properties located in Rice Lake Manor.
Therefore, the proposed assessment should stand.

1 The project engineer will be present at the assessment hearing to provide a presentation of the
project scope, costs and associated assessments. At the close of the assessment hearing, if there
are no relevant questions or issues which would require further investigation, it is recommended
1 that the City Council adopt the assessment roll for the Lake Riley Area Phase I Trunk Utility
Improvement Project No. 93 -32A dated SeptemberX,, 1996 with the interest rate and term to be
1 7'/6% and 8 years, respectively. 101

LAKE RILEY AREA TRUNK UTILITY PHASE I IMPROVEMENT
PROJECT NO. 93 -32A
Notice is hereby given that the Chanhassen City Council will meet at 7:30 p.m. on Monday,
' September 23, 1996 at the City Hall Council Chambers to pass upon the proposed assessments
for the Lake Riley Area Phase I Trunk Utility Improvement Project No. 93 -32A. Abutting
properties and those properties deriving benefits from this project are proposed to be assessed.
' Specifically, properties in Section 13 and the north half of Section of 24 are proposed to be
assessed which include:

The proposed assessment is on file for public inspection at the office of the City Engineer. The
' total amount to be assessed is $607,000. Written and oral objections will be considered at the
meeting, but the Council may consider any objections to the amount of the proposed individual
assessment and adjourn the meeting upon such further notice to the affected property owners as it
deems advisable.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute
§429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen
within 30 days after the adoption of the assessment and filing such notice with the District Court
within 10 days after service upon the Mayor or City Clerk. No appeal may be taken as to the
' amount of any assessment adopted unless a WRITTEN NOTICE signed by the affected property
owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding
officer at the hearing.
' Residents who are 65 years of age or older, or retired by reason of permanent and total disability,
' may apply to have payment of the assessment deferred. The application shall be made to the City
Clerk within 30 days after the adoption of the assessment roll by the City Council.

SPECIAL ASSESSMENT NOTICE
IMPROVEMENT NO.: 93 -32A
The City Council will hold a public hearing to consider proposed assessments for
Improvement Project No. 93 -32A, on Monday, September 23, 1996, at 7:30 p.m., in the
Council Chambers at 690 Coulter Drive, Chanhassen, Minnesota. The area to be assessed
includes parts of Sections 13, 14, 23, and 24 T 116 R 23. The total amount of the proposed
assessment is $697,280. Your assessment has been calculated in accordance with the City
Council's policy as follows:
1 Trunk Area Sanitary Sewer $1,050 per equivalent unit
Trunk Area Water Main $1,375 per equivalent unit
Lateral Water Main $2,500 per equivalent unit
1 Existing single family properties on estate lots less than ten acres in size will only be assessed
trunk area charges for one equivalent unit at this time. These properties will be responsible
1 for additional trunk area hook -up charges if the parcels are ever subdivided.

Treasurer. Please indicate the parcel number on your check. Partial prepayment of the
assessment is permitted.
If you elect not to pay the full amount within thirty (30) days after the hearing date, the
assessment will be spread over eight (8) years, with installments appearing on your real estate
taxes beginning next year. Interest will be included at the rate of seven and one -half percent
(7 1/2%) of the unpaid balance.
The proposed assessment roll is on file with the City Clerk. Written and oral objections to
the proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a written
objec tion signed by the affected property owner is filed with the City Clerk prior to the
assessment hearing or presented to the presiding officer at the hearing.
All written objections to the assessment not received prior to or at the assessment hearing in
the above matter are waived, unless failure to object prior to or at the assessment hearing is
due to a reasonable cause.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute
section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the city of
Chanhassen within thirty (30) days after the adoption of the assessment and filing such notice
with the District Court within ten (10) days after service upon the Mayor or City Clerk.
Residents who are 65 years of age or older, or retired by reason of permanent and total
disability may apply to have payment of the assessment deferred. The application shall be
made to the City Clerk within thirty (30) days after the adoption of the assessment roll by the
City Council.
City staff will be available between the hours of 8:00 a.m. to 4:30 p.m. weekdays until the
time of the public hearing to answer questions about the proposed assessments. You may also
telephone City staff at (612) 937 -1900.
You will be notified by mail of any changes adopted by the City Council in interest rates,
prepayment requirements, or the amount of the adopted assessments from those contained in
this notice.

1 Dear Resident:
1 Last week you should have received a Special Assessment Notice for utilities installed by the City of
Chanhassen to provide your area with sanitary sewer and water service. This letter is to let you know
that these assessments were pending at the time of your closing and should have been explained to you
1 by the title company. It is the City of Chanhassen's understanding that the funds necessary to pay
these assessments were put in escrow by the developer or builder at the time of closing and were
included in the purchase price of your home. Please contact the developer and /or builder of your
1 home and the mortgage and title company that you used to determine if there is any action that needs
to be taken on your part to allow for the release of funds from escrow to pay these assessments. We
will be sending a copy of the assessment roll to Tandem Properties and The Rottlund Companies for
1 their information.
We apologize for any confusion that the notices may have caused. Please review your closing
1 documents or contact your builder, the developer, or the title company that you used if you have any
questions as to whether or not the necessary funds were put in escrow.

We deny any financial responsibility with regard to this assessment, based on the

Dear Mr. and Mrs. Hruby:
I received your letter dated September 15, 1996 objecting to the special assessment in the amount
of $2,141 associated with the Lake Riley Area Phase I Trunk Utility Improvement Project No.
93 -32A. Given that this assessment was pending prior to the purchase of your property, it is
typically required that the seller (in this case, Rottlund Homes) would be required to escrow the
dollars necessary to pay the pending assessments prior to the transfer of ownership. Although
your letter does not come out and say this, I am assuming that your letter denying any financial
responsibility with regard to this assessment is implying this. If I am incorrect in my assumption,
please let me know as soon as possible at 937 -1900, extension 114.

1 I received your letter dated Monday, September 16, 1996 objecting to the assessment against
your property for the trunk watermain improvement project. You contend that your property line
is at least 400 feet from the trunk watermain and, therefore, there is no access to water unless it is
1 brought in from your neighbor's property. You are partially correct in the fact that you, as well
as most property owners, will not connect directly to a trunk watermain. Most often, an
additional lateral line needs to be extended to provide direct access for connection. As such,
1 when a lateral watermain is installed to serve your property, there will be a lateral cost
responsibility to your property also. At this time, since the trunk watermain has been installed and
your property is deemed to be within the benefited service area of the trunk watermain, the
1 proposed assessment of $1,375 against your property continues to be recommended. This policy
has been and is used on all trunk utility improvement projects. It is unfortunate for you that your
neighbors do not appear to have a need or desire for the lateral watermain to be extended at this
1 time. If, at some point in time, there is at least 50% of the affected property owners supporting a
lateral watermain extension, please contact me with a formal petition and I will proceed with
initiating the steps needed to be taken to undertake a public improvement project.

to the letter I received about the assessment for the trunk water
main. I would like to protest the assessment of $1,375.00 to my
property based on the fact that I just had a new well put in four
years ago and I will not be using the water main. I would be happy
to pay this assessment or a hook up charge of some sort when the
day comes that I am required to hook up to that water main.

I received your letter dated September 14, 1996 objecting to the trunk watermain assessment of
$1,375 to your property. You base your objection on the fact that you had a new well put in your
property four years ago and will not be using the watermain at this time. Your property has been
defined as being within the boundaries of the ultimate service area for this trunk watermain which
has been placed with this improvement project. This property, like many properties, does not
abut the trunk line and therefore cannot make direct connection to it. Most properties will require
that an additional lateral line be constructed to their property before direct connection can be
made. At the time that such a lateral line is placed, your property will again be responsible for its
share of associated costs with a lateral watermain and the direct connection. However, it has
been the City's policy regarding trunk utility improvement projects that assessments be levied to
all the properties deemed to be within the service area. As such, I will continue to recommend to
the City Council that the proposed assessment of $1,375 against your property for trunk
watermain be upheld.

Recently we received written notice of special assessment on improvement 93:32A.
This letter is our formal written notice of objection to the assessment made against our
property, parcel no: 25- 7400060.
Our objection is based on the fact that in 1980, when we bought our property, the
developer had installed the utilities, which included water lines and is evidenced by
the enclosed assessment search. The developer noted this in selling us the property
and included this in the price of our lot. No future outstanding assessments remained,
which was also noted in the assessment search. In 1980, it is our understanding that
there was not a trunk area water main fee. If there had been, we would have paid it at
the rates at that time, and not at today's rate.
Since we already paid once for the water and sewer improvements, we should not
have to pay the full amount being assessed against us today. Our assessment should
be based on the city's actual cost to make one connection to our existing water line
system, not the $11,000 being assessed against eight home owners as proposed.
It the city can show documented proof that the cost to make this one connection was
indeed $11,000, then they are justified in their request and, we will pay our $1,375.00
portion.
At this time, we do not plan to connect to city water because we have a private well.
Under these circumstances, are we not also entitled to an alternative payment plan on
the amount assessed?
Please give us consideration in these matters. Thank you.

I received your letter dated September 16, 1996 objecting to the special assessment amount of $1,375 for tnmk
watermain associated with Improvement Project No. 93 -32A. Your letter indicates that your objection is based
on the fact that the developer had installed the utilities, including water lines, when you purchased your property.
You are correct in that statement; however, this contention is not totally complete. When the Rice Lake Manor
subdivision was platted in 1980, the developer did install the lateral watermain and lateral sanitary sewer lines
associated with the development Since [milk sanitary sewer was adjacent to the development the lateral sanitary
sewer line installed as a part of this development was connected directly to the trunk sanitary sewer system and,
as such, direct sanitary sewer service was available to all properties associated with the Rice Lake Manor
development The lateral watermain installed, however, did not have an available City trunk watermain to
connect to. Therefore, this lateral pipe was put in the ground basically as a dry line and, as such, none of the
properties in the Rice Lake Manor subdivision had City water. All the properties were on private well systems.
With this project the City has extended the trunk watermain system to allow for connection of your lateral
watermains and service your subdivision. As such, your property is proposed to be assessed for the associated
trunk watermain area charge. No lateral watermain charge is proposed to be levied against your property since
your developer did install the lateral watermains privately. Upon review of the assessment search for your
property that you enclosed with your letter, it is clear that only a sewer assessment was previously levied against
your property. Based on the above - stated facts, I have to continue to recommend to the City Council that the
proposed assessment for trunk watermain in the amount of $1,375 continue to be levied against your property.
