SUBJ: Approve Resolution Vacating Existing Right -of -Way on Great Plains Boulevard
from Lake Drive East to Market Boulevard (Trunk Highway 101)

In conjunction with the final platting of Villages on the Ponds, Great Plains Boulevard between
Lake Drive East and Market Boulevard will no longer be needed. Villages on the Ponds will be
constructing a new street system in general conformance with the City's Comprehensive Plan
(Lake Drive East extension). The street is anticipated to be built sometime in 1997. Phase I of
Villages on the Ponds proposes to mass grade the entire site east of Trunk Highway 101 which
will require the removal and abandonment of Great Plains Boulevard. Effective September 1,
1996, a Commissioner's Order (8197 1) was signed by MnDOT relocating and reverting
temporary Trunk Highway 101 designation over to Market Boulevard and reverting jurisdiction
of Great Plains Boulevard back to the City of Chanhassen (Exhibit A). It is recommended that
the City Council adopt the attached resolution vacating the existing right -of -way for Great Plains
Boulevard conditioned upon final plat approval of Villages on the Ponds and execution of the
development contract for Villages on the Ponds by the applicant.

A RESOLUTION VACATING AN EXISTING RIGHT -OF -WAY ON GREAT PLAINS
BOULEVARD FROM LAKE DRIVE EAST TO MARKET BOULEVARD
(TRUNK HIGHWAY 101)
WHEREAS, pursuant to Minnesota Statutes § 412.851, the Chanhassen City
Council has conducted a public hearing preceded by two (2) weeks published and posted
notice to consider vacating the right -of -way easement as shown on attached Exhibit A, and,
WHEREAS, it appears that there is no public interest to be served by the continued
public ownership of that portion of the above - described street right -of -way.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen:
1. That the right -of -way described in attached Exhibit A is hereby vacated.
2. The City Clerk is directed to file a certified copy of this Resolution with the
County Auditor and County Recorder in and for Carver County, Minnesota.

temporary location of Legislative Route No. 187 (Marked Route 101), located in the
City of Chanhassen, CARVER County as contained in Order Numbered 8530, be
' amended to read as follows:
Beginning at the intersection of Old Temporary Trunk Highway No. 101 and
' relocated Temporary Trunk Highway No. 101, said intersection is located
approximately 850 feet west and approximately 650 feet south of the northeast
' corner of Gov't. Lot 2, section 13, township 116 north, range 23 west; thence
northerly along said relocated Temporary Trunk Highway No. 101 (Market Blvd.)
for approximately 1900 feet to its intersection with Trunk Highway No. 5; thence
' continue easterly along said Trunk Highway No. 5 for approximately 1400 feet
to its intersection with Old Temporary Trunk Highway No. 101 and there
terminating.
' Therefore, it is ordered that former Legislative Route No. 187 (Marked
Route 101) described as follows: Beginning at the intersection of Old Temporary Trunk

is located approximately 650 feet south and approximately 850 feet west of the
