"The City Council approves a resolution for a MnDOT Limited Use Permit to construct,
operate, and maintain a pedestrian trial within the right -of -way of TH 101 north of
Pleasant View Road."
City Council approval requires a simple majority vote of the City Council present.
BACKGROUND
On June 28, 2010, Council directed staff to apply for State of Minnesota grant funds for
Roadway and Trail Improvements at the TH 101 and Pleasant View Road intersection.
On December 13, 2010, MnDOT notified the City the grant application would be funded.
On February 14, 2011, staff reviewed the Pleasant View Road /TH 101 Roadway and
pedestrian trail improvements with Council at the work session.
DISCUSSION
MnDOT is requesting the City approve a resolution for a limited use permit for the 101
pedestrian trail improvements. The proposed trail improvements are on the west side of TH
101 right -of -way and extends from Pleasant View Road to Town Line Road. This trail
section is a missing gap in the City's trail system for connecting to other regional trails.
MnDOT requires a Limited Use Permit for construction and utilization of trail improvements
in their right of way. The permit is for construction, operations and maintenance of the trail.

CONSTRUCT, OPERATE, AND MAINTAIN A PEDESTRIAN TRAIL
WITHIN THE RIGHT -OF -WAY OF TH 101 BETWEEN PLEASANT VIEW
ROAD AND TOWNLINE ROAD
PROJECT NO. 11 -05
WHEREAS, the City of Chanhassen is working on a plan to construct a pedestrian trail
within the right -of -way of Trunk Highway 101 between Pleasant View Road and Townline Road to
promote orderly and safe pedestrian travel adjacent to the highway; and
WHEREAS, the State of Minnesota Department of Transportation (MnDOT) requires a Limited
Use Permit for the construction and utilization of said pedestrian trail.
NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council:
1. Hereby enters into a Limited Use Permit with MnDOT to construct, operate, and maintain a
pedestrian trail within the right -of -way of Trunk Highway 101 of the State of Minnesota. The City
of Chanhassen shall construct, operate, and maintain said trail in accordance with the Limited Use
Permit granted by MnDOT.
2. Hereby executes the Limited Use Permit and any amendments to the permit.
