PROPOSED MOTION
"The City Council is requested to approve a resolution calling a public hearing for
April 11, 2011 for the Municipal Consent process on the TH 5 Improvement Project."

• Reconstruct an 800 -foot sink hole /settlement section of road west of 78th Street in Victoria.
• Add capacity, efficiency and safety through turn lane improvements, signal modifications, ADA
improvements, access modifications and drainage improvements.
• Improve pedestrian mobility and safety with a new pedestrian underpass east of Minnewashta
Parkway near the Arboretum.
• Add safety edge and rumble strips and stripes to the center lane and shoulders at various
locations along the project.
Over the past several years, MnDOT has promoted and included rumble strips /stripes on reconstruction
and overlay projects. These improvements are thought to reduce the amount of lane departure crashes on
rural roadways. MnDOT is planning to include these improvements on TH 5; however staff does not
have a drawing that shows exactly where MnDOT is proposing these improvements. MnDOT has
indicated the desire to include these improvements on TH 5 from approximately the east entrance drive
of the Landscape Arboretum to Lone Cedar Lane. Staff is concerned about the noise impacts these
improvements may have and has asked MnDOT to include information at the public hearing regarding
the need for the improvements and address staff s noise concerns.
Two segments of TH 5 are anticipated to be closed between the Memorial Day and Labor Day holidays.
One location is for the replacement of a bridge over a recreation trail west of Rose Street and another is
for the reconstruction of pavement west of 78 Street. Loth of these closures are in the City of Victoria.
Other shorter impacts may occur throughout the construction for various pipe replacements under TH 5
and a pedestrian underpass east of Minnewashta Parkway.
MnDOT is not planning to construct a signal at the intersection of TH 5 and Minnewashta Parkway with
this project because it currently does not meet their minimum threshold, or warrant, for installing a
signal. However, a signal is the number one improvement people who live in this area have requested.
MnDOT's response to this issue is as follows:
Numerous studies conducted around the nation continue to show that traffic signals
cause more overall delay and often result in an increase in the total number of crashes
at an intersection. Studies also show that the rate of red light running at unjustified
signals is higher than at justa zed ones. This is why the crash rates at unjustified
signals are higher than at justified ones. In the past three years, at signalized
intersections in the Metro area, there have been 54 fatal and 503 "A " injury crashes
( "A " is the most severe injury). Signal justification warrants were created to limit the
installation of signals to locations where their benefits will be higher than their
negative effects.
Signal justification is based on criteria that was developed by the Federal Highway
Administration and adopted as policy by MnDOT. This criteria looks at traffic
volumes, crash history, pedestrians, school crossings, etc. The seriousness of a crash
is not a factor in the crash criteria used in the justification of a traffic signal. MnDOT
is concerned by and work to minimize all crashes. The traffic volume criteria are
based on volumes on the major street and minor street. The major and minor streets
both have to meet minimum volumes in order for these criteria to be met. For the
major streets (on State Highways) in the Metro area, the minimum volumes are
usually always met, which leaves the minor road volumes as the determining factor if
a signal can be justified or not based on volumes of traffic. The traffic volumes at the

intersection of TH 5/Minnewashta Parkway do not meet the minimum volumes at this
time.
As stated above, crash history is one of the criterion of signal justi lcation. This
intersection has had 7 reported crashes in the past three years, of which zero are
considered to be "correctable " with a traffic signal. "Correctable " crashes are right
angle crashes. The crash criteria states that a signal warrant can be met if there are S
"correctable " crashes per year.
Based on all of the above, the installation of a traffic signal at this intersection is not
justified at this time.
The Landscape Arboretum is considering adding a south leg to the intersection of TH 5 and
Minnewashta Parkway in the near future. If this leg is constructed and most of their daily trips to the
Arboretum are directed to this intersection, it is anticipated a signal may be warranted at that time.
Currently, there is not a lot of pedestrian movement from Minnewashta Parkway to the Landscape
Arboretum. However, the Arboretum wants to encourage more "walk -up" traffic and is planning to
make internal capital improvements for this to happen. The City has partnered with the Arboretum to
encourage the general public to utilize this facility. Chanhassen residents will be able to cross TH 5 at
Minnewashta Parkway with a safe grade separated connection and gain access to the Arboretum at no
cost. The pedestrian underpass will allow the Landscape Arboretum to become an extension of the
City's park system for all to enjoy.
FUNDING
Currently, the project has the following funding:
• $4.7 million in MnDOT roadway preservation funds.
• $1.25 million in Bridge Improvement or Replacement (BIR) Program funds to reconstruct the
bridge over the recreational trail west of Rose Street awarded to MnDOT.
• $900,000 in Highway Safety Improvement Program (HSIP) funds awarded to the City of
Chanhassen for turn lane improvements, shoulder widening and access modifications near TH 5
and Minnewashta Parkway (this funding requires a 10% match from the City of Chanhassen).
• $1 million in Transportation Enhancement (TE) Program funds awarded to the City of
Chanhassen for a pedestrian underpass beneath TH 5 east of Minnewashta Parkway (this funding
requires a 20% match from the City of Chanhassen).
• $362,900 in Municipal Agreement Program funds awarded to the City of Victoria for turn lane
and shoulder improvements at TH 5 and the west junction of CSAH 11 /Victoria Drive (this
funding requires the balance to be matched by the City of Victoria).
The most current preliminary cost estimate is below the funding levels. There are some final design
details to be worked out as the project continues through final design. In addition, once MnDOT fully
understand the utility impacts there may be a cost share from the City for relocations.
Based on MnDOT's latest cost estimate, the City of Chanhassen participation is roughly $180,000 for the
federal funding grant match requirements which is broken down as follows:

$70,000 (based on current estimate) for matching dollars for safety improvements (HSIP
funding) on TH 5 at Minnewashta Parkway area. The grant application was fora $100,000
match.
• $110,000 (based on current estimate) for pedestrian underpass at Minnewashta Parkway. The
grant application was for $245,000 in matching funds.
The City's cost participation will be refined as final design cost estimates are further detailed. The actual
amount may be a lump sum or may depend on the awarded bid if that is how the agreement is structured.
The City of Chanhassen did take the lead in applying for federal grants, however other agencies will
benefit from these improvements. Staff has discussed with other agencies the need to help pay for the
matching funds and indirect costs for the federal grant improvements. It is staff s belief Carver County,
the City of Victoria and the Landscape Arboretum should help pay for the trail underpass at
Minnewashta Parkway. It is proposed each of these agencies contribute 25% of the total federal
matching funds along with right -of-way and indirect costs for the pedestrian underpass. Likewise, the
City of Victoria should also help pay for the matching funds for the safety improvements on TH 5 since
some of these improvements are in City of Victoria city limits. Staff is planning to meet with these
agencies in the near future so an equitable cost sharing agreement can be worked out.
MUNCIPAL CONSENT APPROVAL PROCESS
Municipal Consent is a process that MnDOT must follow when a state construction project is proposed
through a local municipality with local cost participation. The process is outlined in Minnesota Statute
161.162 to 161.167.
The process begins when MnDOT submits plans and requests scheduling a public hearing to the local
municipality. The City received MnDOT's layout for TH 5 on February 14, 2011. According to state
law, the City must now call a public hearing within 15 days of the submittal date. The actual public
hearing, however, does not have to be held until 60 days after the submittal date.

A RESOLUTION CALLING A PUBLIC HEARING FOR THE
TH 5 IMPROVEMENT PROJECT -- PW067132
WHEREAS, pursuant to a letter dated February 14, 2011, MnDOT is requesting Municipal
Consent on State Project 1002 -89 /City Project PW067132, TH 5 Improvement Proj ect between
Highway 41 and the west junction of County Highway I INictoria Drive, and
WHEREAS, the letter provides information regarding the proposed project and the
municipal consent process.
NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council:
1. The Council will consider the improvement of such project.
2. A public hearing shall be held on such proposed improvements on the 11 day of April, 2011 for
the TH 5 Improvement Project, PW067B2 in the Council Chambers of City Hall at 7:00 PM and
the clerk shall give mailed and published notice of such hearing and improvement as required by
law.
Passed and adopted by the Chanhassen City Council this 28 day of February, 2011.

Description Total Project Cost: $9,029,000
MNDOT is planning to resurface Md make improvements to TH5 west of TH41 in 2011. These improvements include resurfacing, shoulder
improvements, turn lane improvements and intersection improvements at Minnewashta Parkway. The City will be responsible for a small portion
of the project as it relates to local access and trail and underpass improvements. The City applied for federal funding for trail and underpass
improvements along with safety improvements at Minnewashta Parkway. The trail underpass local share is estimated at $275,000. It is anticipated
the Landscape Arboretum, City of Victoria and Carver County Parks will help pay for the local share.
Justification
To improve safety and mobility along the corridor.
