SUBJ: Authorize Appraisal, Notermann Property at Lake Ann Park
' The city council briefly discussed the plight of the Notermanns in light of the growing traffic counts in
front of their property at Lake Ann. It is virtually impossible to get out of the Notermann's driveway, or
' Lake Ann Park, between 4 p.m. and 6 p.m. One of the problems is cars caught in the merge section west
of County 17 that must come to a halt because of the number of vehicles in the thru lane. They are not
able to merge until after the light has turned red and thru traffic clears. As they start to merge, they are
' also holding up the vehicles that have stacked off of County 17 also attempting to head west on Highway
5. The final result is that there is absolutely no opening for Lake Ann users or the Notermanns.
Compounding the situation is the fact that the Notermanns operate a daycare facility in their home.
t Assuming that the frontage road is approved, the city council can assuredly expect a request from the
Notermanns to reconnect their driveway to the frontage road. I find this to be a Catch -22 in that the city
needs to look to the long range solution for all of the properties along Highway 5; i.e. we need to
complete the second and third phases of the, frontage road, which would require the taking of the
Notermann's property. The existing value of the property is assuredly depressed because of the inability
to gain access to .or from the property. By contrast, once a reconnection is made to our frontage road,
' that impairment would no longer exist.
(A.h <vs as
The Notermanns have continuously scat eir desire to see the city or state purchase their property.
' Accordingly, I would recommend thA. city council authorize an a raisal of the p=ertv with the
intent that we would be able to en ter into aurchase areemen providing a relatively small n a eed to f — e2 - -5 - years - .' initial

purchase agreement could be achieved, the city /state would have a relatively small'investment in
property, with full knowledge that a reconnected driveway would not significantly affect our long term
ability to see the frontage road continue to the west.
' RECOMMENDATION
Authorization to prepare an appraisal of the Notermann property is recommended continLyent unon the
city approving construction of the frontage road.

Subject. Highway wa Five Rush Hour Picnic '
Dear Representative Workman: '
I would like to thank you for two things:
1. Your hospitality for the invitation to the Rush Hour Picnic. '
2. Your efforts to bring a focus to the serious congestion and '
Safety issues along Highway Five.
Unfortunutely, I am not available on June 27th for the picnic.
n Thunk Highway Five in it's existi condition is difficult, and the Minnesota '
I know that living along g y g
Department of Transportation (MnDOT) continues to be deeply concerned about this corridor. Our
negotiations with Carver County and Chanhassen for the jurisdictional transfer of T.H. 101 have resulted in '
MnDOT funding being established for Chanhassen to construct a frontage road along the north side of T.H. 5
in the vicinity of Lake Ann. Presumably, the frontage road could be extended to help relieve the Notermann's
access problems. My office has not yet received plans for the frontage road, but will continue to work closely '
with City staff through the upcoming months to provide the improvement.
The proposed fiscal year 1997 -99 Transportation Improvement Program (TIP) currently under consideration '
by the Transportation Advisory Board (TAB) includes funds for the completion of T.H. 5 out to T.H.41 in
fiscal year 1998. 1 anticipate that the T.I.P. will be approved.
If you have questions about the frontage road, you may call Mr. Robert S. Brown, Metro Division State Aid
Engineer at: (612) 582 -1351.
Sincerely,
0

You are invited to attend the HighwW S Rush Hour Picnic being hosted by Representative Tom Workman
and his constituents, Ray and Lisa Notermann.
The details of the gathering are as follows:
Date: Thursday, June 27, 1996
Time: 4:00 p.m.
Address: 1450 Arboretum Boulevard
Excelsior, NIN 55331
Map Enclosed
Your attendance is requested as an opportunity to see first hand the difficulties the Notermann's have
getting in and out of their driveway. The concerns the Notermann's have include the high safety risk of a
stationary vehicle pulling out into traffic that is moving 50 -60 mph, as well as, the hassle of waiting for long
periods of time before being able to turn in and out. In effect, they are risking their lives every day just to
get in and out of their driveway. Their situation is unique in the area and deserves your attention.
Please R.S.V.P. by calling Mary Cummins at 296 -3244 on or before June 21, 1996. We look forward to
seeing you there.

RE: TH 5 Frontage Road
North side in the vicinity of Lake Ann Park
Dear Mr. Ashworth:
RECEIVED
CITY OF Ch" If, ,-
I want to take this opportunity to express my appreciation for your efforts regarding the
jurisdiction changes contemplated for roadways in Chanhassen. Through continued
cooperative efforts we can implement the changes proposed.
I also want to convey the Metro Divisions commitment to funding of the frontage road near
Lake Ann Park along TH 5. Metro Division realizes this is an integral part of the overall
jurisdiction package and, in anticipation of the jurisdictional transfer, has included $660,000 in
our State Fiscal Year 1998 program for this improvement. The funds will be available from
July 1, 1997 until June 30, 1998. To proceed, please call Kevin Hoglund, Cooperative
Agreements Engineer, at 582 -1370.
