In conjunction with Lundgren Bros.' development, The Woods at Longacres, Outlot D has been
final platted as the Song Addition. The Songs are proposing to build one single - family residence
on the property. Sanitary sewer service for this lot and the remaining portion of The Woods at
Longacres will be extended through this parcel. The sanitary sewer extension will be constructed
as a part of the overall Woods development and paid for by Lundgren Bros. Construction.
Therefore, no development contract is necessary for this subdivision. Staff has reviewed the
construction plans and finds them in accordance with City standards and therefore recommends
the City Council approve the construction plans prepared by Schoell & Madson dated August 16,
1996.

Re: Sanitary Extension from Longacres across the Song Parcel
Dear Dave:
Lundgren Bros. Construction, Inc. desires to add to the utility plans '
for the Woods at Longacres 3rd Addition the sanitary line
extension which crosses the Song parcel. This sanitary line will
extend from an existing manhole on the Lake Ann Interceptor to the
north property line of Longacres. Lundgren Bros. would like to
install this sanitary line as soon as possible. Nodland '
Construction, Inc. has been authorized to perform the construction
work.
Please let me know if there are any questions, or if any additional '
information is needed.

' The Council may recall that at their regular meeting on June 24, 1996 a presentation was made by
MnDOT representatives regarding the proposed installation of traffic signals and improved lane
channelization at the east and west junctions of Trunk Highway 101 and existing Trunk Highway
' 212, S.P. 1013 -63. Following the presentation, the Council gave approval to the signalization and
lane channelization plans for this improvement project.
' During the presentation MnDOT representatives indicated that within the next 60 days a formal
signal agreement between the City of Chanhassen and MnDOT would need to be entered into for
' the project. This agreement basically identifies jurisdictional responsibility for the installation,
operation and maintenance aspects of the signal improvement project. In short, state and federal
dollars will be paying for the installation of the new traffic control signals, street lights, emergency
vehicle pre - emption systems, signal interconnection, and appropriate signage. The only cost
responsibility to the City involves providing and paying for the monthly electric service charges.
Local jurisdictional cost responsibility regarding power supply and monthly electrical charges is
' standard practice as the City of Chanhassen currently pays for the electrical services charges for
the existing signals on Trunk Highway 212 and along Trunk Highway 5 in Chanhassen.
Therefore, the City of Chanhassen's cost participation in this improvement project is considered
indirect and, as such, the agreement does not list any dollars owed from the City to the State of

THIS AGREEMENT made and entered into by and between the
State of Minnesota, Department of Transportation, hereinafter
referred to as the "State ", and the City of Chanhassen,
hereinafter referred to as the "City ", WITNESSETH:
WHEREAS, Minnesota Statutes Section 161.20 (1994)
authorizes the Commissioner of Transportation to make
arrangements with and cooperate with any governmental authority
for the purposes of constructing, maintaining and improving the
Trunk Highway system; and
WHEREAS, the State has determined that there is
justification and it is in the public's best interest to install
new traffic control signals with street lights, emergency vehicle
pre - emption, interconnect and signing on Trunk Highway No. 101 at
Trunk Highway No. 212 East and West Junctions; and
WHEREAS, the City requests and the State agrees to the
installation of Emergency Vehicle Pre - emption Systems,
hereinafter referred to as the "EVP Systems ", as a part of the
new traffic control signal installations on Trunk Highway No. 101
at Trunk Highway No. 212 East and West Junctions and in
accordance with the terms and conditions hereinafter set forth;
and
~WHEREAS; it is anticipated that the new traffic control
signals with street lights, EVP Systems, interconnect and signing
work is eligible for 80 percent Federal -aid National Highway
Funds; and

' WHEREAS, it is considered in the public's best interest
for the State to provide two (2) pedestal shafts and bases, a
master controller and two (2) new cabinets and control equipment
' to operate said new traffic control signals; and
WHEREAS, the City and State will participate in the
' maintenance and operation of the new traffic control signals with
street lights, EVP Systems, interconnect and signing as
hereinafter set forth;
' NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The State shall prepare the necessary plan,
' specifications and proposal which shall constitute "Preliminary
Engineering ". The State shall also perform the construction
inspection required to complete the items of work hereinafter set
forth, which shall constitute "Engineering and Inspection ".
' 2. The State with its own forces and equipment or by
contract shall install new traffic control signals with street
lights, EVP System, interconnect and signing on Trunk Highway
No. 101 at Trunk Highway No. 212 East and West Junctions in
accordance with the plan and specifications for State Project
' No. 1013 -63 and Federal -aid Project No. NH 012 -2 (068).
Anticipated Federal -aid share is 80 percent of the Construction
Cost-arid_=`SCtte materials. Anticipated State's share is
20 percent of the Construction Costs and State furnished
materials.

3. The City shall provide an adequate electrical
power supply to the service pads or poles, and upon completion of
said new traffic control signals with street lights installations
shall provide necessary electrical power for their operation at
the cost and expense of the City.
4. Upon completion of the work provided for in
Paragraph 2 hereof, the State shall maintain and keep in repair
the new traffic control signals with street lights, interconnect
and signing, at its own cost and expense.
5. The EVP Systems provided for in Paragraph 2 hereof
shall be installed, operated, maintained or removed in accordance
with the following conditions and requirements:
a) All maintenance of the EVP Systems shall be
done by State forces.
b) Emitter units may be installed and used only
on vehicles responding to an emergency as
defined in Minnesota Statutes Chapter 169.01,
Subdivision 5 and 169.03. The City will
provide the State's Assistant Division
Engineer or his duly appointed representative
a list of all such vehicles with emitter
units.
c) Malfunction of the EVP Systems shall be
reported t-o the State immediately.

d) In the event said EVP Systems or components
' Commissioner of Transportation.
6. Any and all persons engaged in the aforesaid work
to be performed by the State shall not be considered employees of
the City and any and all claims that may or might arise under the
' Worker's Compensation Act of this State on behalf of said
'
employees-while so engaged, and any and all claims made by any
third partyas a consequence of any act or omission on the part
of said employees while so engaged on any of the work
contemplated herein shall not be the obligation and
' responsibility of the City. The State shall not be responsible

are, in the opinion of the State, being
'
misused or the conditions set forth in
Paragraph b above are violated, and such
'
misuse or violation continues after receipt
by the City of written notice thereof from
the State, the State shall remove the EVP
'
Systems. Upon removal of the EVP Systems
pursuant to this Paragraph, the field wiring,
'
cabinet wiring, detector receiver, infrared
'
detector heads and indicator lamps and all
other components shall become the property of
the State.
e) All timing of said EVP Systems shall be
'
determined by the State through its
' Commissioner of Transportation.
6. Any and all persons engaged in the aforesaid work

BE IT RESOLVED that the City of Chanhassen enter into an
agreement with the State of Minnesota, Department of
Transportation for the following purposes, to wit:

emergency vehicle pre - emption, interconnect and signing
on Trunk Highway No. 101 at Trunk Highway No. 212 East
and West Junctions in accordance with the terms and
conditions set forth and contained in Agreement

BE IT FURTHER RESOLVED that the proper City officers be
and hereby are authorized to execute such agreement, and thereby
'assume for and on behalf of the City all of the contractual
obligations contained therein.

SUBJ: Approve Plans for Traffic Signal Installation and Lane Channelization
' Improvements on T.H. 212 at East and West Junction with T.H. 101 (MnDOT
Project), S.P. No. 1013 -63, City File No. PW290C
City staff has been notified by MnDOT officials of the impending improvement project to the east
and west intersection junctions of Trunk Highways 212 and 101 in Chanhassen. The primary
' project elements consist of the installation of a new traffic signal at both the east and west
intersection junctions, the construction of left and right turnlanes for both east and westbound
directions, and the relocation of a residential driveway, on the south side of Trunk Highway 212,
to the west junction intersection with Trunk Highway 101. In addition, MnDOT will be replacing
the controller cabinets, repainting the signal poles, and interconnecting the two existing signals on
' Trunk Highways 101 and 212 with the two new signals to provide timing and operation
coordination. MnDOT will also be providing emergency vehicle preemption (Opticom) for the
signals.
' Based on the MnDOT project memorandum, the need for this project is based primarily on an
increase of daily traffic by nearly 20% over the last seven years and the combination of restricted
' geometrics, high speed, and no left turn lanes causing congestion and raising the probability of
accidents, particularly rearend and left turn accidents. The project is being undertaken to improve
the efficiency and safety of the intersection and reduce congestion.
The constructivit`of this project will be funded wholly by the National Highway System (ISTEA)
and State Matching Funds. MnDOT will also be responsible for the maintenance of the signals
' including controller cabinets, painting of poles, and relamping. As is common with all of the
traffic signals along Trunk Highways 5 and 212 within this community, MnDOT asks that the City
be responsible for paying the monthly electrical service charge for the signals.

A copy of the project memorandum for this project is attached and provides more detailed
information regarding this project. Representatives from MnDOT will be present at the Council
meeting to provide an overview presentation of this project, its history, primary elements, timing
schedule, and answer any other questions that may arise.
It is therefore recommended that the City Council approve the plans for the traffic signals
installation and lane channelization on Trunk Highway 212 at the east and west junctions with
Trunk Highway 101, MnDOT Project No. S.P. 1013 -63, City File No. PW290C with the further
understanding that the City's cost responsibilities will be limited to the monthly electric charges
for the two new signals.
