Petit/oner must show that the performance of the discretionary act Was so arbitrary and capricious as t~ constitute a clear abuse of discretion. ~ Minn. Stat. §375,025 Subd, 3, states in relevant part that, "No district shall vary In population more than ten percent from the average for all districts In the county..." In this case, ~he Carver County Board of' Commissioners looked at several redistricting options. They Mad statistical analysis done. They took part in a workshop and did individual work on the issue. They reduced the percentage of popular;ion variation among the districts from ten percent ~o five percent, They held a meeting ti~at was open to the public for comment. They took written comment from the public. They took several votes and Option A was adopt:ed. The .Board's conduct was not unreasonable, unauthorized, arbitrary or capdd0us. Here, there is no "gross inequality" in population among the districts under the option adopted by ~:he county, The Courl: in/-/ether/n_ato_._4?., further stated that, ., "Undoubtedly the board of commissioners in redistricting are vested with a broad discretion to effect as nearly as practicable an equal population for the various districts, Mathematical equality of course is not required." id, at 302. The district~ do not have to be equal in number. Here, there are minor differences in the division of the cQunty's population.
