SUBJ: Approve Change Order No. 2 to Lyman Boulevard Reconstruction and Lake Riley
I Area Trunk Utility Improvement Project No. 93 -32
' The attached Change Order No. 2 for the above - referenced project consists of four primary elements as outlined
in the engineer's letter dated November 15, 1996. The first two items were changes which needed to be made to
comply with other governmental agency permit approvals which were not able to be obtained prior to the
' contract letting. Had approvals been able to be obtained prior to the contract letting, this work would have been
designed into the plans and still completed as such. Item number three is a time and materials item which was
required to protect adjacent properties from ponding damage until the project's ponding and storm drainage
system was constructed. The fourth and final item is a cooperative effort change with the proposed Fawn Hill
' development and the City. It became apparent that these proposed improvements would be more appropriate to
be constructed under this improvement contract so as to disturb the existing neighborhood only one summer
rather than two (which is what would have happened if the developer installed these improvements at a later
' date). The developer has agreed to pay for their share of the additional drainage improvements which were
needed.
' The total of Change Order No. 2 amounts to a total revised contract increase of $37,228.33. Of this amount,
$14,418.17 will be reimbursed by the developer of the Fawn Hill development. The previous bonding for this
improvement project will adequately cover the cost increase associated with Change Order No. 2 since Change
' Order No. 1 actually reduced the original contract amount by some $302,000.
It is therefore recommended that the City Council approve Change Order No. 2 in the amount of $37,228.33
yielding a revised contract amount of $2,498,386.38 for the Lyman Boulevard Reconstruction and Lake Riley
Area Trunk Utility Improvement Project No. 93 -32B.

1. The first item is due to realigning the sanitary sewer and watermain at the

proposed TH 101 and Lyman Boulevard intersection. This realignment of the
watermain was precipitated during the review process with Mn /DOT. Their
comments were received after the project was bid and required the addition
'
of casing pipes and the lowering of the watermain which was in direct conflict
with the sanitary sewer.
,
2. The second item includes the outlet structure as required by the DNR
(Department of Natural Resources), and the recommendations from City staff.
This outlet structure was not designed with the original construction
documents due to lack of comments from the DNR and Army Corp. of
Engineers.
'
3. The third item is for the P P g um in of the pond located along Lyman
Boulevard. The elevation of the pond topped the high water elevation this
past spring and during the early summer rains; this was due to the failure of
the drain tile outlet. We assume this failure is due to the prior placement of
surcharge material along the south boulevard area of Lyman Boulevard. This
pond did not have a reliable outlet prior to this project and the outlet had not

been constructed at the time the high water was experienced.
4. The fourth item is for the construction of a storm sewer system through the
,
Sunny Slope Addition. This was facilitated to provide a future outlet to ponds
proposed by the development of the adjacent property to the north. At the
time the plans were prepared, it was assumed that the developer would be

installing this pipe system. The work was added to the City contract to
eliminate the need to disrupt this area again in the next year or two. The cost
of this work was approved by the developer and he will pay for 100% for the
cost of installation solely for future development and 50% of the costs for
upgrading existing storm sewer system. The developers portion of item 4 is
$14,418.17, and the City's portion is $10,642.26. The developer has agreed to
have the costs specially assessed against the plat of the Fawn Hill
Development.
I have reviewed the information and find it in order. I recommend that we present this
change order to the Chanhassen City Council for approval. I am available to present this
