Preliminary and Final Plat Approval for Lotus Lake Woods 2nd Addition and
Vacation of Utility and Drainage easements, located at 7500 Frontier Trail
I BACKGROUND
On August 28, 1995, the City Council approved the final plat (93 -10 SUB) to subdivide 4.47
' acres into 7 single family lots, Lotus Lake Woods, as shown in plans dated received May 15,
1995, with the following conditions:
' 1. All utility and street improvements shall be constructed in accordance with the current s
edition of "City's Standard Specifications and Detail Plates. Detailed street and utility
construction plans and specifications shall be submitted for City Council approval.
2. The applicant shall apply and obtain permits from the Watershed District, DNR and other
appropriate regulatory agencies and comply with their conditions of approval.
3. The applicant shall enter into a development contract with the city and provide the
' financial security to guarantee compliance with the terms of the development contract.
4. All areas disturbed during site grading shall be immediately restored with seed and disc -
mulched or wood fiber blanket within two weeks of completing site grading unless the
city's (BMPH) planting dates dictate otherwise. All areas disturbed with slopes of 3:1 or
greater shall be restored with sod or seed and wood fiber blanket.

construction, maintenance and cost sharing of the storm water improvements as detailed
in the feasibility study prepared by Bonestroo & Associates dated April, 1993.

6. The conservation easement shall permit pruning, removal of dead or diseased vegetation
and underbrush. All healthy trees over 6" caliper at 4' height shall not be permitted to be '
removed.
7. Extension of utility service stubs to Lots 4 and 5 shall be in the same location to
minimize disruption and tree removal. Those two lots shall share a common driveway.
The driveway shall follow the utility service alignment. The shared portion of the
driveway shall be built up to a 7 ton design and 20 feet in width. The applicant shall '
prepare a cross - access - agreement for Lots 4 and 5 to maintain and provide the shared
driveway.
8. The front yard setback can be reduced to 25'.
9. All lots shall be custom graded and shall provide a tree preservation plan for staff
approval prior to issuance of a building permit. Staff shall have the right to require a
change in house pad and location if it will result in saving significant vegetation. A snow '
fence shall be placed along the edge of the tree preservation easement prior to grading.
10. Park and trail fees shall be paid in lieu of dedication as required by City Ordinance '
11. In lieu of the applicant paying the City's Surface Water Management connection fees, the
developer shall construct a stormwater pond in the plat of Lotus Lake Woods in
accordance with the feasibility report prepared by Bonestroo, Rosene, Anderlik &
Associates dated April of 1993. The developer shall convey to the City, without cost, an
easement for the ponding facilities. Following completion of the stormwater and ponding
improvements area by the developer and acceptance of the pond and storm drainage
facilities by the City, the City shall reimburse the developer for certain construction costs.

The plat has been filed and construction has begun on the site. As the applicant began designing
potential house layouts, they realized that Lot 3 was going to cause problems trying to
accommodate a home with a three car garage. To remedy the situation, the applicant is shifting the
property lines for Lots 2 and 3, clockwise, a distance of 10 feet. Such application could have been
processed administratively since the applicant is not creating new lots, however, this could only be
accomplished through legal descriptions. Legal descriptions tend to be lengthy and confusing at
times. The applicant chose to replat the three lots impacted by the shifting of the lot line. The City
Ordinances require all plats to be reviewed by Planning Commission and City Council. Hence, this
application is before you. Staff is recommending approval of this application with conditions.
' ANALYSIS
The applicant is requesting preliminary and final plat approval to reconfigure the layout of three
lots into three lots. It is zoned Residential Single Family (RSF). The area of the three parcels is
1.59 acres. The site is located east of Del Rio Drive. Access to the subdivision will be provided
from an extension of Del Rio Drive's cul -de -sac.

All of the proposed lots meet or exceed the minimum requirement of the Zoning Ordinance. The
average lot size is 23,100 square feet. Sewer and water service to this area is available.
The majority of this site is heavily wooded. The applicant has used design measures to preserve the
majority of the trees. As part of the first addition, the Planning Commission and City Council
approved a reduced front yard setback from 30 to 25 feet. This resulted in preserving additional
trees. All areas outside grading limits are protected by this preservation easement. The easement is
in place and recorded with the county. This subdivision will have no impact on it. The plans are of
high quality and in compliance with city ordinances.
Park and trail fees will be required in lieu of park land as permitted by ordinance.
We are recommending that it be approved with conditions outlined in the report.
VACATION OF UTILITY AND DRAINAGE EASEMENT
Typical Drainage and Utility easements were dedicated on the plat with the first addition. These
easements run parallel to the lot lines. Since the interior lot lines are being shifted, new easements
are being dedicated. The old easements on the interior lines on Lots 1, 2, and 3 will need to be
vacated. Vacations require action by City Council only. Staff included this item in the staff report
for the Planning Commission's information. Staff is recommending approval of the vacation of the
drainage and utility easements.

The City Ordinance allows lots to have a reduced frontage at a cul -de -sac, however, they
must meet the 90 foot width at the front setback line. Lot 2 fronts on a cul -de -sac and meets
the width requirements.
PLANNING COMMISSION UPDATE
On November 20, 1996, the Planning Commission reviewed and approved this application
unanimously.
STAFF RECOMMENDATION:
Staff recommends the City Council adopt the following motion:
"The City Council approves Preliminary and Final Plat 93 -10 SUB to replat 3 lots into 3 lots, and
vacation of Utility and Drainage Easements, Lotus Lake Woods 2nd Addition, as shown in plans
received October 23, 1996, with the following conditions:
1. The applicant shall enter into an amended Development Contract.
2. The existing drainage and utility easements in Lotus Lake Woods, specifically Lots 1, 2,
and 3 shall be vacated and replaced by those shown on the plat of Lotus Lake Woods 2nd
Addition.

Upon review of the final plat for Lotus Lake Woods 2 Addition, I offer the following comments
and recommendations:
This is a very straightforward replat of the 1S Addition. The minor adjustment of lot lines will not
affect utility improvements within the development. Due to the restructuring of lot lines, the
existing drainage and utility easements should be vacated on the I' Addition. The 2n Addition is
providing the appropriate drainage and utility easement in return.
RECOMMENDED CONDITIONS OF APPROVAL
1. The applicant shall enter into an amended development contract.
2. The existing drainage and utility easements in Phase I, specifically Lots 1, 2 and 3, Block 1,
should be vacated.

Chairwoman Mancino called the meeting to order at 7:10 p.m.
MEMBERS PRESENT: Nancy Mancino, Alison Blackowiak, Bob Skubic, and Craig Peterson. ,
Ladd Conrad and Kevin Joyce arrived at the meeting after item 1.

Mancino: Thank you. Any questions for staff at this point from commissioners?
Peterson: Are any of the recommendations, as far as approvals, been changed since the original '
one? 1 through 5, other than, like I say has any of then changed is my question I guess.
Aanenson: Not really, no. They're being consistent with, but because we... original plat so really
all we need to do is just ... shift the lot lines.
Peterson: Okay.
Mancino: So it's the short hand form. '
Skubic: Is the compliance table on page 4, is that supposed to be the lot size rather than the
home size? Home width? Home depth? '

Aanenson: Correct. It's the lot width.
Mancino: So on Lot 2, the ordinance 90 feet and Lot 2 is 52.23 feet? Is that a?
Aanenson: That's at the cul -de -sac line. It has to be 90 foot at the setback, which it does meet.
There should be an asterick there that clarifies that...
Mancino: So if you could include that in so that City Council knows that. It's not a variance at
that point. Any other questions for staff at this point? Okay, is the applicant here and do they
wish to make a presentation? Okay, then let's go ahead and may I have a motion to open this for
a public hearing, followed by a second please.
Peterson moved, Skubic seconded to open the public hearing. The public hearing was
' opened.
Mancino: This is open for a public hearing. Anyone wishing to address the Planning
' Commission on this issue, please come forward and state your name and give your address.
Seeing none, may I have a motion and a second to close the public hearing.

Planning Commission Meeting - November 20, 1996
Peterson moved, Skubic seconded that the Planning Commission recommends approval of
Preliminary Plat #93 -10 SUB to replat 3 lots into 3 lots, Lotus Lake Woods 2n Addition, as
shown in the plans received October 23, 1996, with the following conditions:
1. The applicant shall enter into an amended Development Contract.
2. The existing drainage and utility easements in Lotus Lake Woods, specifically Lots 1, 2 and
3 shall be vacated and replaced by those shown on the plat of Lotus Lake Woods 2nd
Addition.
3. Park and trail fees shall be paid in lieu of land in accordance with City Ordinances.
4. All areas disturbed during site grading shall be immediately restored with seed and disc -
mulched or wood fiber blanket within two weeks of completing site grading unless the
City's (BMPH) planting dates dictate otherwise. All areas disturbed with slopes of 3:1 or
greater shall be restored with sod or seed and wood fiber blanket.
5. The front yard setback shall be reduced to 25 feet.
All voted in favor and the motion carried.
