Approval of Policies for the Chanhassen Recreation Center; Response to
Questions Raised at the November 12 City Council Meeting
Attached is the original report on this item prepared by Patty Dexter dated October 25, 1996. Per
your directive, I have responded to the questions raised by Councilman Senn at the November 12
city council meeting. The minutes from that meeting are also attached.
Three areas of interest were raised:
1. Rental classifications and the reasoning behind them.
2. The economic effects these policies have on the Recreation Center.
3. The basis for a $15 set up /take down charge.

1. Rental Classifications and the Reasoning Behind Them: The separation of user groups is
integral to the operation of the Recreation Center. The four classifications which we
currently operate under are easily discernible from one another. These categories represent
the best interests of the taxpayer while not being overly complicated. In response to the
statements of Councilman Senn on November 12, I offer the following.
"I guess I'd like to have some discussion about that because I don't quite understand why
we're cutting the line that way. "
Simplistic and comprehensive are key concepts in making the cuts between user groups. All
user groups must fall under one of the categories. Once the cuts are made it must be obvious
where everyone fits. There are hundreds of user groups and it is tempting to specialize or
"water down" the split creating numerous smaller categories. I do not advocate this
approach.

"There's public agencies that service effectively broad areas other than just Chanhassen. "
Agreed. For example, under this policy, the Carver County Soil and Water Conservation
Board can hold a meeting at the Recreation Center free of charge. The board serves not only
Chanhassen, but the entire county. Is this "free rent" a subsidy or an investment? What
would bring the board to the Recreation Center? Perhaps a meeting with Philip Elkin, the
city's water resource coordinator to discuss a water quality project which affects Chanhassen.
As in this example, it is my belief that in the majority of these instances direct benefit will be

realized by the City of Chanhassen.
"We're not going to charge them yet we're going to charge our own residents and
businesses. "
Under the recommended policy, this statement is correct. The council should be aware that
staff has cons charging considered char in government users. I do not advocate charging the city council,
park and recreation commission, school districts, etc. The down side is just too great. If the
city council feels differently, please let me know.
"Yet we aren't going to charge a professional group. "
The complete description under Group I reads "non- profit professional groups with city
_-
representation." "Professional" is a poor descriptive in this context. By omitting this word,
the policy will read "non -profit groups with city representation."
"I mean it quite honestly just doesn't make any sense to me and I would like to see sbme
more work done on it and talk about it a little bit more in terms of how it's set up and w iat
we charge for and don't charge for. "
If Councilman Senn has additional questions, I will be pleased to address them prior to or at
next Monday's meeting.
2. The Economic Effects These Policies Have on the Recreation Center: The attached chart
depicts the "economic impact" of this policy on Recreation Center revenues. Free rentals
valued at $10,498 have been logged through October 31, 1996. This compares to $89,723 in
"cash" sales. With two months to go we are $27,400 short of our revenue goal. Factor in the
value of free rentals and this number drops to $16,902.

A "set up" fee of $15 or $25 accurately reflects the investment made by the Recreation
Center staff in administering the rentals noted in the fee schedule.
Example: Community Room set for 40 people: Two staff members invest 20 -30 minutes
prior to and after the meeting setting up and taking down chairs and tables, vacuuming, and
conducting any spot cleaning. Total staff time invested will equal 80 -120 minutes, valued at
$16 to $24.
RECOMMENDATION
It is recommended that the city council approve the Chanhassen Recreation Center Rental Policy
as presented by Patty Dexter, Recreation Supervisor in her memorandum of October 25 with the
noted amendment in Group I omitting the word "professional."

approval policies for the Chanhassen Recreation Center. Mark.
G. APPROVAL OF POLICIES FOR THE CHANHASSEN RECREATIONA CENTER.
Councilman Senn: As I understand the staff report and through discussions what I've been told by staff basically.
'
There are several different categories that effectively have been created as far as rentals from the recreation center.
The categories break down into basically public, I don't know it treats government separately meaning effectively
city government. And then it breaks down into Groups I, II and III. Group I includes public agencies, school
districts, civic organizations, non - project professional groups, and Chanhassen based groups which contribute to the
well being and betterment of the community. And then the next group is Chanhassen residents and businesses and
then the next group is non- residents, community groups from other cities, commercial/businesses from other
communities, and non - profit organizations from outside the city. In relationship to that, it is setting it up on the basis
that there be no charge for the group of, well basically the government group as well as Group I and there would be
charges for Group II and Group III. I guess I'd like to have some discussion about that because I don't quite
understand I guess why we're cutting the line that way. eye's u 'c a encies that service a ectivel broad areas

the fact that it was supposed to be increasingly covering the operating costs down there as a

going to covermg ess and less from rental facilities. In here also there's a discussion of a fee as it relates to set -up
charge. It basically says when we're not going to charge a group or we are going to charge a $15.00 set -up charge,

which I'm just having problems with because I can't understand how you could possibly put
up and take down and cleaning of the facility after a use. I just can't see anything comparable in that as to what's

Mayor Chmiel: Okay. Don, would you like to address that?
Don Ashworth: I had anticipated questions as it might deal with 112 versus 276 with really the comment being that

we're treating both equally. Councilman Senn's list is quite extensive and I think we might be better served to table
the item and allow Mr. Hoffman to listen to the tape and make a response to each of those items. Because I heard at
least several.
Councilman Mason: I agree. I was going to make that motion to table this until we can get a written response to the
issues raised.
Mayor Chmiel: Okay.

Recreation Center until staff can provide a written response to the issues raised by Councilman Senn. All
voted in favor and the motion carried.
Mayor Chmiel: We'll move those other three items back to 6(a) for the requests of information provided and we'll
■ address them at that time.

PUBLIC HEARING: CONTINUATION OF HEARING, CERTIFICATION OF DELINQUENT UTILITY
BILLS.
' Don Ashworth: State law provides a procedure by which delinquent utility bills can be certified to the County
Auditor for collection with the following year's taxes. There's a very stiff penalty that goes along with that process.
I continue to see in disbelief as to the number of people that are on that list, but it is the one way to ensure that the
City does recoup it's full cost of operating the utility system. Accordingly staff would recommend that the City
Council adopt a resolution which allows for certification of delinquent utility accounts as included in your staff
report.

Mayor Chmiel: Okay. Are there any questions? Steve?
Councilman Berquist: Well I'm surprised at the number of people there is too. What's the certification fee Don?
How does it cost? What's the fee that we tack on to have to do this?
Don Ashworth: Each quarter there's a 10% charge that goes with the accumulative balance so you're up between
45, around 45% by the time you get to this point in time. And then an additional 20% is added.
Councilman Berquist: Say that, 10% goes to 45% plus 20?
Don Ashworth: Correct.
Councilman Berquist: So the thing's end up almost doubling by the time the certification process is over.
Don Ashworth: 65 %.
Councilman Berquist: 65 %. Well it disturbs me to see all the names in here and I can't imagine why they do it, if
only to have it show up on their property tax and be deductible from that sense. I noticed in the Accounts Payable
we were refunding a gentleman for a landscape escrow on two lots that he, or one lot that he was developing and he
owes us under $200.00...
Don Ashworth: I don't think there's any legal way by which you can take one check deposited for one purchase and
try to use that to pay some other type of bill.
Councilman Berquist: Okay. That's all I have.

Since the opening of the Recreation Center, several questions regarding fees and policies
have arisen. Although many of these issues were discussed at previous meetings and
were seemingly settled, additional questions have been brought forth that need
clarification.
On September 24, the Chanhassen Recreation Center Rental Policy was presented to the
Commission. They asked for revisions to the policy. On October 22, the revised
Chanhassen Recreation Center Rental Policy was presented and approved.
Key points of the policy include:
1. , Priority Rental Classifications
• Government: Any activity related to the operations of Chanhassen City
government, including, but not limited to city council, board and commission
meetings, city programs and events, and city sponsored public meetings. This
group will not be charged.
• Group I: Public agencies, school districts, civic organizations, non - profit
professional groups with city representation and Chanhassen based groups
which contribute to the well being and betterment of the community may use
the Recreation Center free of charge.
• Group II: Chanhassen residents and businesses.
• Group III: Non - residents, community groups from other cities,
commercial/businesses from other communities, and non - profit organizations.

Center Rental Policy.

CHANHASSEN RECREATION CENTER I
POLICY STATEMENT I
The intent of this policy is to promote regular and active use of the facility. It outlines scheduling
procedures, group classifications, rental charges, and sets rules and regulations for use of the
facility. Rental charges are based on the staffing, set -up and maintenance costs, as well as the
market rates for similar facilities.
The rental facility includes community meeting rooms, conference room, and gymnasium. The
Recreation Center is handicapped accessible.
REGULATIONS OF THE CHANHASSEN RECREATION CENTER RENTAL
FACILITIES — SCHEDULE, LIABILITY AND DAMAGE DEPOSIT
• Groups or individuals wishing o use the Recreation Center facilities shall make ,

arrangements through the Chanhassen Recreation Center front desk.
• Scheduling will be on a first -come first -served bas is following the priority classification
outlined in this policy. The minimum age to rent facilities is eighteen (18). A minimum
notice of 24 hours is required.
• Groups II, III and Government may schedule any room(s) up to 1 year in advance. Group I
may schedule up to 2 months in advance for all rooms excluding the gymnasium, which may
be scheduled up to 6 months in advance.
• Group I is required to have a minimum of 8 people in attendance to reserve the conference
room and a minimum of 15 people in attendance to reserve the community room.
• Rental hours shall be figured from the time the renter enters the space to the time of ■
departure.
• Residents may Y not reserve an rooms for a non - resident and /or business. The city reserves '
the right to restrict the number of dates an individual or group may reserve. This is to ensure
that one group does not dominate use of a particular room or facility.
• If deemed necessary, the city reserves the right to substitute a meeting room other than that
stated on the building permit, in order to minimize conflicts of compatibility, space, and
scheduling.
RESERVATIONS, SPECIAL USER FEE, AND DAMAGE DEPOSIT
• The reservation fee is required for all chargeable rentals. This fee can be paid prior to the day
of the rental or your group may be billed.

A $200 damage deposit shall be made by Groups I, II & III if the rental involves food,
beverages, or gym equipment. This fee shall be returned within one (1) week after the event
if no deductions are necessary.
CANCELLATION POLICY
• A set up fee will be billed to the user if a cancellation notice is received less than 48 hours in
advance of the scheduled event.
• In the event of an emergency, the city reserves the right to cancel activities. Reservation fees
will be returned accordingly.
LIABILITY AND DAMAGE
• All organizations, groups, or individuals using the Recreation Center will be required to sign
a waiver of liability.
• The city will not assume liability for loss or damages to property belonging to an organization
or group.
• Any organization, group, or individual reserving space shall be fully responsible for any
damage to that space or equipment and any unlawful acts associated with the user's program
or event. Any damage to facilities or equipment must be reported immediately to staff on
duty. The city reserves the right to cancel future reservations.
ROOM REGULATIONS, SUPERVISION AND SECURITY
• General hours of operation are: Monday through Friday -6 a.m. to 10 p.m.; Saturday-
8 a.m. to 10 p.m.; and Sunday -10 a.m. to 8 p.m.
• Summer (Memorial Day through Labor Day) hours of operation are: Monday through
Friday -6 a.m. to 9:00 p.m.; Saturday -8 a.m. to 8 p.m.; and Sunday -10 a.m. to 6 p.m.
• The Chanhassen Recreation Center is a tobacco and alcohol free building and grounds. The
city reserves the right to close or reject a user in the case of regulation abuse.
a • Every user of the facility must be under competent adult leadership. The user shall assume
full responsibility for the group's conduct and for any damage to the building or equipment.
Children must be kept under direct supervision of adults at all times and kept confined to the
reserved area of the user group. The city will not assume liability for unsupervised children.
The city will be paid for any damages or additional cleaning costs incurred as a result of
unsupervised youth.
• If deemed necessary because of the type of function or activity, the city reserves the right to
assign a room attendant and/or licensed police officer for a user group and the cost will be
paid by the user.

• Meetings and activities must be confined to the areas reserved for their use.
• Disorderly conduct shall be grounds for immediate termination of the activity /event without a
refund. This will be determined by city staff.
• Rented space and common areas must be left in an orderly condition. If additional time
beyond normal cleaning is required, an additional charge for personnel and cleaning supplies
will be made.
FOOD AND BEVERAGE SERVICE
• Arrangements for catering services shall be made directly between the renter and Chanhassen
Recreation Center list of catering services or the users own caterer.
ALCOHOLIC BEVERAGES
• No alcoholic beverages are allowed on the premises.
DECORATIONS '
• A decoration plan and installation methods must be pre- approved.
• The Chanhassen Recreation Center reserves the right to remove all decorations which do not
meet a pre- approved plan. Decoration time must be included in the rental hours.
• Drafting tape only shall be used on flat painted walls. No tape shall be used on the ceiling.

may not be stored in the Chanhassen Recreation Center facility, shall be brought in during
rental hours, and must be removed from the facility at the end of the rental time or at the

beginning of the first business day following the event.
• Labor and tools are not available to assist putting up decorations, extra set -up, and props.

• Only candles secured within a chimney to ensure no open flame are permitted.
• The user is required to clean up all decorations.
• Neglect of these requests can require an additional fee for damages and clean up done by city
personnel and may negate any future use of the Chanhassen Recreation Center facility.
