SUBJ: Proposed Code Amendment to Chapter 16, Solid Waste Establishing Residential
Collection Districts and Vehicle Weight Limits
BACKGROUND
' Two of the original six residential solid waste haulers in the city no longer collect residential
wastes in Chanhassen (Admiral Waste and Waste Management). One additional residential
hauler with limited accounts has come into Chanhassen (Knutson Services).
On March 11, 1996, City Council directed staff to prepare appropriate revisions to Chapter 16 of
the City Code requiring all licensed trash haulers to limit their vehicles to a gross weight of a
certain pound limit, i.e., mini packers, to be used in all daily operations within residential streets
only. Also that collection be appointed to a certain day for each neighborhood, and to continue
with weekly recycling pickup.
On January 29, 1996, City Council held a work session with the haulers to discuss organized
collection. While nothing was resolved at the meeting, City Council did direct staff to attempt to
provide public debate about the issue. To this end, pro and con editorials were provided to the
Chanhassen Villager. City Council also left the opportunity for the haulers to present an
alternative to organized collection that addresses the issues outlined in the organized collection
study.
In February 1995, City Council tabled the organized collection contract and ordinance and
requested a meeting with the haulers at a Council work session. Previous work session dates
have been postponed and in October, City Council directed staff to try to work with the haulers to
resolve their objections to the contract or develop a hauler's alternative. In the interim, staff
completed the contract negotiations. Staff met with the haulers to review the haulers' proposed
revisions to the contract. Staff incorporated these changes and provided the haulers with a

revised draft contract (dated 12/8/95). We further requested that the haulers provide any
additional comments by January 5, 1996 on both the contract and a hauler's alternative so that '
staff could respond to them or include them in the packet to City Council for the work session
scheduled for January 29, 1996. We received no additional correspondence.
On July 11, 1994, the City Council approved a motion authorizing staff to initiate negotiations
with the existing waste haulers for organized collection. The haulers met several times to come
to a consensus on the contract language. '
On December 13, 1993, the Chanhassen City Council accepted the "City of Chanhassen
Organized Collection Study" and the "Findings and Recommendations" of the Chanhassen ,
Recycling Committee with modifications to the recommendations. The Council had directed that
the Organized Collection Program should be based upon developing reasonable districting of the
community, preparing a menu of mandatory and optional services, and developing a list of ,
requirements to define haulers eligible to participate in the program.
In May, 1993, the City of Chanhassen approved a study of the potential for organized collection '
of mixed municipal solid waste and recyclables. The City's Recycling Committee served as - a
study group to gain input from haulers and the public in order to advise City Council on waste
collection as part of Phase I of an Organized Collection Study. The Committee completed its '
initial study and made its final report, in September, 1993, recommending that the City accept the
Organized Collection Study, institute a licensing provision to limit the number of waste haulers '
to a maximum of six with a declining limit based upon turnover by haulers, adopt a resolution of
intent to organize solid waste collection, and proceed with Phase II of the Organized Collection
Study. '
DISCUSSION
The existing solid waste collection system in Chanhassen is open, often resulting in an inefficient '
overlap of services with the potential for up to six different haulers collecting garbage and
recycling each week in each neighborhood. All this excessive truck traffic has a negative impact t
on the design life of the road, particularly during "load limits" in the spring when overweight
vehicles have their greatest destructive impact on streets, resulting in expensive street repair bills.
According to the Minnesota Department of Transportation, the combined impact of one garbage
truck and one recycling vehicle is equal to 1,650 automobiles. Additionally, garbage and
recycling may be deposited at curb side each day of the work week negatively impacting the
sights and smells of the neighborhood. Alternate collection methods can reduce the number,
frequency, and damage of vehicles on Chanhassen streets.

Staff is recommending that a seven ton per axle weight limit be incorporated in the ordinance due
' to the fact that the city's standard local residential street design is a seven ton design. In addition,
the haulers would also have to comply with seasonal weight restrictions. Staff recommends the
per axle weight limit because 1) it can be done with haulers existing equipment, 2) mini packers
could be loaded so that they are heavier per axle than seven ton with less dispersement of weight,
and 3) it leaves it up to the individual hauler to determine the best way for them to meet this
' requirement.
As part of discussions with the haulers, five and nine ton weight limits were also discussed. The
' haulers stated that the five ton limit would be too restrictive and cost prohibitive. The nine ton
limit would be a continuation of the status quo.
' One of the haulers has expressed a concern regarding yard waste collection during the spring
road restriction season. They are requesting that a moratorium be established for the collection
of yard wastes during this period.
' DISTRICTS
' In preparing the districts, staff requested that the haulers recommend their preferred districts.
Two alternative proposals have been brought forward, one with three and one with five districts.
No consensus has been established yet for either alternative. The haulers have advised staff that
' during the slower periods, January and February, they will look at the logistics of the new
districts. Staff will work with the haulers over the winter to establish appropriate districts. Once
districts are established by a resolution of City Council, the haulers will be required to notify
their residential customers of the districts.
RECOMMENDATIONS
' Staff recommends that the City Council adopt the following motion:
' "The City Council approves the ordinance amending Chapter 16 of the Chanhassen City Code
concerning residential collection districts and vehicle weight limits as shown in Attachment #1."

THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
SECTION 1. Chapter 16 of the Chanhassen City Code is amended by adding Section 16 -22 to '
read:
Section 16 -22. Residential Collection Districts '
Residential collection districts shall be established by resolution of the Chanhassen City
Council. Within each district, the collection of residential solid wastes shall be limited to only '
one day per week, which shall be approved by the City.
SECTION 2 . Section 16 -33 (3) of the Chanhassen City Code is amend to read: '
(3) Vehicles; maintenance. Each licensed collector shall only use vehicles and equipment so '
constructied that the contents will not leak or spill. Vehicles shall maintain a maximum seven
(7) ton per axel weight limit when performing residential solid waste collection on local city
streets and shall abide by the spring seasonal road limits. The vehicles and equipment shall be '
kept clean and as free from offensive odors as possible, and shall not stand in any street, alley, or
public place longer than is reasonably necessary to collect mixed municipal solide waste, yard
waste, or recyclables. The licensee shall also insure that the collection site is left tidy and free of ,
litter.
SECTION 3 . This ordinance shall be effective on the 1 st Day of March, 1997, following its '
passage and publication.
