RELEASE AND TERMINATION OF
TEMPORARY CONSTRUCTION EASEMENT
' The undersigned, being the holder and owner of a 100.00 foot
temporary construction easement as described in Document No.
3887952, dated May 13, 1971, and recorded June 8, 1971, in the
' office of the Register of Deeds in and for Hennepin County,
Minnesota, between Kenneth E. Beiersdorf and Sally Beiersdorf,
Husband and Wife, Grantors; Charles E. Kerber and Elinor W. Kerber,
' Husband and Wife, Grantors; and the Metropolitan Council, successor
to Metropolitan Waste Control Commission, successor to Metropolitan
Sewer Board, a public corporation and political subdivision of the
State of Minnesota, Grantee; and the City of Chanhassen, successor
' to the Village of Chanhassen, A Minnesota Municipal Corporation,
Grantee; covering the premises lying and being in Hennepin County,
Minnesota, and described as:

Meridian, except a strip of land one rod wide across the
East side of said North 1/2 of the Northwest Quarter,

Dear Mr. Hempel:
We are preparing for closing on our acquisition of a portion of the
Datasery site and have reviewed title to the property. The
property is affected by an Easement granted on May 13, 1971, and
recorded as Document No. 3887952 to the Met Council and the City of
Chanhassen for sanitary sewer purposes (copy enclosed) . The
Easement included both a permanent and temporary construction
easement for installation, but did not specify the expiration of
the wider construction easement. Carol Johnson of the Met Council
confirmed that the temporary easement is no longer necessary, and
prepared the enclosed Release and Termination of Temporary
Construction Easement which will terminate the temporary
construction easement granted. Please arrange for review of the
Release for City signature as the original easement was granted to
the City (Village) also.
As execution on behalf of the Met Council is in process, your
prompt attention to this matter will be appreciated. Feel free to
contact Joan Kuschke of CSM or me in the event you have questions.
