' The public improvements associated with the Lake Riley Area Trunk Utility Phase I Improvement Project
No. 93-32A have been completed. The major funding source for this improvement project is special
assessments to benefiting properties. Attached is the proposed special assessment roll for the project.
Minnesota state statute 429 regarding special assessments for public improvement projects requires that
advance notification of a public hearing be made in the local newspaper and directly to the affected
' property owners. Typically this necessitates a minimum of a few weeks lead time. In the past, it has been
found to be of benefit to provide the City Council with the proposed assessment roll at the time that the
public notification is being made, in advance of the public hearing, so that if they should receive phone
' calls or comments, they have some information in their hands to work with. Therefore, the only action by
the Council necessary tonight is to formally receive the assessment roll and to set the assessment hearing
date. A formal presentation of the project and subsequent assessment roll will be made at the public
hearing. Staff would propose to set the assessment hearing date for the City Council's regular meeting on
Monday, September 23, 1996.
' It is therefore recommended that the City Council formally receive the assessment roll for the Lake Riley
Trunk Utility Phase I Improvement Project No. 93-32A dated September 4, 1996 and that the assessment
hearing for the set project be set for Monday, September 23, 1996.

NOTICE OF ASSESSMENT HEARING

PROJECT NO. 93-32A
Notice is hereby given that the Chanhassen City Council will meet at 7:30 p.m. on Monday,
'
September 23, 1996 at the City Hall Council Chambers to pass upon the proposed assessments
for the Lake Riley Area Phase I Trunk Utility Improvement Project No. 93-32A. Abutting
properties and those properties deriving benefits from this project are proposed to be assessed.
Specifically, properties in Section 13 and the north half of Section of 24 are proposed to be
assessed which include:

The proposed assessment is on file for public inspection at the office of the City Engineer. The
total amount to be assessed is $607,000. Written and oral objections will be considered at the
meeting, but the Council may consider any objections to the amount of the proposed individual
assessment and adjourn the meeting upon such further notice to the affected property owners as it
deems advisable.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute '
§429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen
within 30 days after the adoption of the assessment and filing such notice with the District Court
within 10 days after service upon the Mayor or City Clerk. No appeal may be taken as to the
amount of any assessment adopted unless a WRITTEN NOTICE signed by the affected property
owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding
officer at the hearing.
Residents who are 65 years of age or older, or retired by reason of permanent and total disability, '
may apply to have payment of the assessment deferred. The application shall be made to the City
Clerk within 30 days after the adoption of the assessment roll by the City Council.
