SUBJ: Truth in Taxation Dates and Adopt 1997 Proposed Maximum Levy
Our previously approved "special meeting dates" calendar (see attached) included guestimated
dates for Truth in Taxation hearings. State statute requires that cities choose a date between
November 29 and December 20, but cannot pick a date chosen by the county or school district
(certain other "continuation date" requirements must also be met). As we have two school
districts and two counties, dates available to us for each of the two meetings become very
limited. In fact, it is my belief that the only dates open to the City of Chanhassen would be to
establish December 4 as the official Truth in Taxation date with Thursday, December 12 being
set as the continuation date (see attached calendar).
It is recommended that the city council establish three special meeting dates; i.e:
December 4: Official Truth in Taxation Date
December 12: Continuation meeting (if necessary)
December 16: Official adoption of the 1997 Budget
The second portion of this item Adopt 1997 Proposed Maximum Levy — sounds like it's an
attempt to set the levy at the maximum extent possible under state law without considering why
you are making the levy. That would be an incorrect interpretation of what we are attempting to
do Monday evening. The "maximum" referred to under state statute recognizes that each
jurisdiction must submit to the county a levy amount for inclusion in the Truth in Taxation
notices. Again, the amount set at the initial hearing Monday night is the amount that cannot be
exceeded in December, which is the basis for this evening's action being labeled "maximum
levy." Again, I should have the actual growth rate that has occurred during the past year by
Monday evening (see "Administrative Presentations "). The amount which will be report °A
Monday evening will be a levy which will approximate the current tax rate.

A RESOLUTION ESTABLISHING TAX LEVIES FOR 1996
AND SETTING TRUTH IN TAXATION HEARING DATE
WHEREAS, the State of Minnesota has mandated the Truth in Taxation process requiring cities to certify
a proposed property tax levy by September 15 for the ensuing year tax collections; and
WHEREAS, aforesaid "proposed" property tax must not be increased but may, in fact, be decreased
in the forthcoming budget preparation and adoption process; and
WHEREAS, said state mandated Truth in Taxation additionally requires cities to set, at this time,
scheduled dates for public hearings to consider adoption of the ensuing year budget, giving consideration to the
scheduling of said dates so as to not conflict with similar public hearings scheduled by the county and school
district for the same purpose.
NOW, THEREFORE, BE IT RESOLVED that the City of Chanhassen hereby certifies a proposed gross
property tax levy for collection in 1996 of $4,625,000, reduced by anticipated Homestead and Agriculture Credit
Aid (HACA) of $939,443 producing a net property tax levy for collection in 1996 of $3,685,557; and
BE IT FURTHER RESOLVED that the City of Chanhassen hereby schedules the Truth in Taxation
hearing for consideration of the 1996 Budget and property tax levy to be held on Wednesday, December 6th at
7:00 p.m. in the Council Chambers of Chanhassen City Hall, 690 Coulter Drive and the Council will reconvene on
Wednesday, December 13th, if necessary. Final action and adoption of the 1996 Budget will occur on Monday,
December 11, 1995, at 7:30 p.m with an alternate date set for December 18, 1995, at 7:00 p.m. if the Council is
required to reconvene on December 13th.

continuation hearing is held, the levy adoption hearing could be held no earlier than one day after the
continuation hearing.
