SUBJ: Ordinance Amending Chapter 9 Concerning
the Volunteer Fire Department
This memo is to recommend that the City Council adopt the attached ordinance regarding the
Chanhassen Fire Department. This amendment is merely a "house- keeping" change, recommended as
part of the two year effort by the Fire Department to compile a new Operations Guidelines manual. The
primary changes are in defining the roles of the Chief and incorporating the Public Safety Director into
the process. Attached please find a copy of the existing ordinance.
RECOMMENDATION It is the recommendation of staff that this be adopted by the City Council.

Update (9- 9 -96): First reading of the attached ordinance was approved by the
city council on August 26, 1996. Approval of final reading is recommended as well
as approval of the summary ordinance for publication purposes.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 9
OF THE CHANHASSEN CITY CODE CONCERNING
THE VOLUNTEER FIRE DEPARTMENT
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
SECTION 1 . Section 9 -16 of the Chanhassen City Code is amended to read as
follows:
The Chanhassen Volunteer Fire Department, existing since May 9, 1966, is hereby
established and confirmed as the Chanhassen Fire Department.
SECTION 2 . Section 9 -18 of the Chanhassen City Code is amended to read as
follows:
(a) Composition. The Fire Department shall consist of such number of officers and
members as deemed necessary for efficient operation, with that number to be established with
the approval of the City Council. The Fire Department shall promptly notify the Public
Safety Director of the Fire Department's election of officer results and of any subsequent
changes in those positions.
(b) Age. All new Fire Department applicants shall be at least 18 years of age.
SECTION 3 . Section 9 -20 of the Chanhassen City Code is amended to read as
follows:
(a) The Chief of the Chanhassen Fire Department shall have general supervision of
the Fire Department.
(b) The Chief shall be elected by the members of the Chanhassen Fire Department.
This elected member shall be considered the Fire Department's nomination for the position
of Chief and shall be submitted to the Public Safety Director as the Fire Department's
recommended candidate for the position of Chief. The Public Safety Director shall forward
the Fire Department's recommendation to the City Council for review and final appointment

as Chief. The Fire Department's election of Chief is understood not to be effective until
such time as City Council resolution approves said election.
(c) The election of Chief shall be for a period of two (2) years.
(d) The Chief shall serve as the head of the Chanhassen Fire Department Board of
Fire Officers.
(e) It shall be the duty and responsibility of the Chief to report personally to the
Public Safety Director. Such meetings shall include, but are not limited to:
(1) Fire Department status.
(2) Budget review.
(3) Current membership levels, needs, problems.
(4) Past quarter activity.
(f) The Chief may be removed by the City Manager for good and sufficient cause.
Such dismissal must be submitted to the City Council for review and final decision.
(g) The Chief shall be required to serve as a member of the City's Public Safety
Commission. The Chief, or the Chief's designated representative in the event the Chief is
unable to attend, shall attend monthly meetings of that Commission.
SECTION 4 . Section 9 -23 of the Chanhassen City Code is amended to read as
follows:
The members of the Chanhassen Fire Department are hereby authorized to answer
calls outside the City limits. When so doing, whether by Mutual Aid request or other cause,
members shall be deemed to be serving as firefighters of the City of Chanhassen. At no time
however, shall the Fire Department dispatch such equipment and personnel that the Chief
cannot afford adequate protection for this City.
SECTION 5 . Section 9 -25 of the Chanhassen City Code is amended to read as
follows:
The City of Chanhassen acknowledges the need and desire to establish and maintain
the Chanhassen fire Department Rescue Squad.

SECTION 6 . This ordinance shall be effective immediately upon its passage and
publication.
