Dear Mr. Ashworth:
The "quick take" condemnation proceeding we initiated in the above - entitled
matter is continuing through the statutory process. On March 51h, the initial hearing
appointing commissioners will be held.
I have met with several of the property owners in an attempt to negotiate a
settlement. As the negotiation process continues, so does the condemnation
proceedings. Pursuant to Minnesota condemnation statutes, in order for the City to
acquire the right to possession of the easement via the "quick take" condemnation
process, the City must pay the appraised damage amount to the landowners. The
following is a list of the property owners and the appraisal damages as prepared by
Lyle H. Nagel] & Co., Inc. For your information, I have enclosed a photocopy of the
first page of each appraisal.
