SCOPE OF WORK
Task 6 - Water Quality Modeling
Objective. To determine the effect on water quality from enlarging the knife - shaped
pond west of Powers Boulevard.
Approach. Montgomery Watson will prepare a P8 model of the contributing watershed
to the knife- shaped pond under existing conditions and with a fully enlarged pond to
determine the effect on water quality. The parameters to be analyzed are total phosphorus
and total suspended solids.
Work Products.
• P8 models on disk for the existing and fully enlarged pond conditions and a one -page
memorandum discussing the results.

Enclosed find a copy of the most recent notice sent to Lowell Carlson. As we discussed during
our meeting on January 10, 1996, upon receipt of my letter, you were to send Mr. Carlson and /or
his attorney a notice of the city's intent to enter the property and construct a fence and assess the
costs back to him, as provided in the terms of the Stipulation signed by Judge Goggins on March
15, 1994. I will begin soliciting bids so that we may proceed with installing the fence as soon as
the frost is out of the ground. With the large residential development going in adjacent to Mr.
Carlson's property, it is prudent that we obtain compliance with the terms of the Stipulation.
Upon review of my notes, I discovered that on May 1, 1995, 1 spoke with Janet Carlson who
informed me that Lowell was in the hospital and was unable to work on the building and fence.
On June 21, 1995, Mr. Carlson submitted a registered survey of the property showing the
proposed building. During the month of July, Mr. Carlson contacted staff several times in
regards to revising the proposed building. As of this time, it is unclear as to what type of
building, if any, Mr. Carlson will construct on the property. Mr. Carlson's intention was to
construct the building prior to erecting a fence on the property.
Mr. Carlson originally agreed to have the fence in place by June 6, 1994. The city staff
tentatively agreed to several extensions provided that Mr. Carlson made an effort to clean up the
property and remove the unnecessary materials so that the fence could be installed. As of today's
' date, very little, if any, work has been done to comply with the terms of the Stipulation. Pursuant
to the terms of the Stipulation, staff will begin to solicit bids for the construction of the wood
' portion of the fence, which should help screen the equipment and materials from adjacent
parcels. The chain link portion of the fence will be dealt with at a later date.

Thanks for your help and referral in obtaining our permit from The Carver County
Sheriffs Dept, for the winter driving school we ran on Lake St. Joe on Sunday Feb. 4th. It
was very successful and a good year for that kind of driver training.

SPRING ROAD RESTRICTIONS
February 20, 1996
Dear Licensed Refuse Hauler:
' Each year during the spring thaw (typically early -March to mid -May) State, County, and Local highway
authorities impose axle weight restrictions to protect their roadways. Enclosed please find a City map
indicating the weight limit restrictions which will be imposed on local streets with the City. This letter is
' also intended to serve notice that the City of Chanhassen will not be granting weight restriction waivers and
encourages you to take into account all measures necessary to fully comply with the seasonal road weight
restriction limits.
I also want to inform you that recent pavement management evaluations are indicating that many of the
newly constructed roads within the City are showing signs of destructive failure much earlier than
anticipated. We believe that a significant contribution to this problem are the overweight loads being
carried on these roads, particularly during the spring thaw season. Therefore, the City has recently
acquired its own weighing scale and intends to work cooperatively with the Carver County Sheriffs office
' to provide comprehensive surveillance and enforcement throughout the City this spring. With nearly a
$100,000,000 replacement value, it is imperative that the City protect its investment in local roads.
Therefore, I would ask that everyone do their part and abide by the seasonal weight limit restrictions.

I would like to bring to your attention an innovative. by our Fire Department to benefit City staff,
while saving the City money. As part of our Risk Management Program, we have fitness evaluations for
members of the Chanhassen Fire Department, with resources made available to individuals that have fitness
issues. This has been primarily carried out by a private health services business, which was not cheap.
Two members of our Fire Department who are also on the Firefighter Combat Challenge Team (Greg
Hayes & Joe Brennan) volunteered to attend a fitness coordinator training program on their own time, now
being certified to carry out the fitness program in- house, for no fee. I commend these firefighters, under the
direction of the Fire Chief, for pursuing a manner of getting the job at a less expensive rate.

The Metropolitan Council Environmental Services Division has
completed the assignment of flows for 1995. The total flow for the
city was measured to be 776 MG for 1995. The estimated flow for
' the city for 1995 was 726 MG. Thus, the Council will be billing
the city for the flow differential in the 1997 cost allocation.
The final cost allocation information will be submitted to the city
later this year.
The estimated flow for the city in 1996 is 780 MG. Attached is a
' copy of a graph and table showing only metered flow, by month, for
the city between the years 1992 and 1995. The Council will provide
the city with more information throughout the year as it becomes
available.

Re: Trunk Highway 101 Turnback/Official Mapping/EA - PW333
Dear Roger:
Given the current development pressures along the Trunk Highway 101 corridor, particularly south of Trunk
Highway 5, it is important that the alignment and associated right -of -way for the revised Trunk Highway 101 be
established so that these considerations can be implemented in land development proposals along the corridor.
Therefore it is the City's desire to have this corridor be officially mapped as soon as possible. One major step
which needs to be completed in order to officially map the corridor is to complete the environmental assessment
(EA) document. The City of Chanhassen has retained the services of the Hoisington Koegler Group (HKG) who is
familiar with the Trunk Highway 101 corridor and has performed some initial studies along Trunk Highway 101 in
recent years. HKG estimates that it may take up to $25,000 to complete the EA which includes conducting an air
quality and noise impact analysis, engineering and surveying by Orr- Schelen- Mayeron & Associates, and
biological analysis. This figure does not include dollars that the City has already spent to date on preliminary
studies for the corridor.
Based on discussions from our recent meeting with MnDOT and Hennepin County on January 26, 1996, it is the
City of Chanhassen's understanding that the costs for preliminary studies and EA reports conducted on the Trunk.
Highway 101 corridor during this calendar year, in advance of an officially executed turnback agreement
(anticipated to be completed by late 1996) will be eligible for reimbursement through the County Trunk Highway
Tumback Account as a part of a future improvement project.
It is the City's desire to complete the Trunk Highway 101 EA (south of Trunk Highway 5) this spring and official
mapping during the early summer. The City is proceeding with the understanding that it will be reimbursed by
Carver County through the MnDOT County Trunk Highway Turnback account upon the letting of a roadway
improvement project along this corridor. If I am overstating or improperly assuming any points in this letter,
please let me know as soon as possible. Thanks, Roger.

This letter is to inform you of the actions of one of your
employees, mechanical inspector, Randy Debner.
On 01 -21 -96 Randy Debner's fishhouse on Lake Waconia was broken
into. Mr. Debner, through his own initiative, did some
investigative work and came up with the names of two suspects in
the case. Mr. Debner gave me the names. With that information
approximately twenty cases of fishhouse thefts and vandalism were
cleared up. This would probably not have been accomplished
without Randy Debner's assistance.
It is indeed a pleasure to work with the City of Chanhassen and
observe the way the various departments interact with a feeling
of good will and pass information along to each other.

Dear Don Ashworth,
Your request for three signs to be removed, because they will become off premise
signs, and therefor creating a non- confonning use will not be triggered by the filing of the
plot.
I agree that once the use of the land changes and it is no longer used as a Nursery, the
signs may become non - conforming.
The dividing of the land into many lots does not change it's use until the growing of
agricultural products ceases and the land is sold for housing.
Please be assured that I will remove the signs when the land on which they reside is
no longer used for agriculture.

Following a visitor presentation by Mayor Cluniel at your January 23 meeting, staff was directed to prepare a
report concerning the future of the Pauly's Building. The following report answers the six questions prepared
by the Commission.
Q1. Discuss what the original intent was for the HRA purchasing the building.
Al. The HRA acquired the Pauly /Pony / Przymus Buildings with the intent of razing them and
redeveloping the property. The Pony and Przymus Buildings have been razed. Alternative ,
plans for this site have included a park, office space or a library.
Q2. Discuss the success /failure of similar centers.
A2. Brooklyn Park considered a teen center a few years ago. The proposal was community driven '
(Grass Roots) but failed to materialize. The City is currently working on the Zane Avenue Youth
Center (see attached article).
Hutchinson opened a teen center in 1989, named Dry -Dock, in a vacant bar. All of the fixtures,
decor and video games were intact upon occupation of the building. A permanent part-time

within 6,200 apartment units in Brook-
lyn Park, we would like to thank the
Minnesota Recreation and Park Asso-
ciation for the donation to support the
Zane Avenue Youth Center summer
recreation program in Brooklyn Park.
The Zanewood Park community
building will be transformed into a
youth center headquarters during the
summer months and will be an exten-
sion of the already existing Community
Resource Center which is located just
around the block. The youth center will
contribute towards a stronger and more
empowered community within the Zane
Avenue corridor and will house recre-
ation programs for preschoolers, youth,
and teens. The City will be working
together with other youth serving
agencies in Brooklyn Park in order to
maximize each other's resources for
youth and teen summer programs in our
community. Other agencies, such as
YMCA, Tree House, Boy Scouts, and
Girl Scouts will also use the center as a
location for bus pick -ups and program
locations. The city's programs —Our
Kids, Our Little Ones, and Our Teens —
will be conducted at the center. Field
trips and special events will be planned.
The programs offered will provide
positive recreation activities and
increase participants' awareness of the
benefits of making positive choices with
what to do with their leisure time.
Through participation and interaction
with adults, se - eenr Mffincrease in
ns and youth. By teaching life skills,
children will become more self- confi-
dent and have a greater sense of feeling
safe'and secure in their neighborhoods.'
Children and their parents will have
opportunities to build positive relation-
ships with their neighbors instilling a
stronger sense of community spirit and
civic responsibility within a socioeco-
nomically depressed area.
The funding will provide staff,
supplies, and bus transportation for
special events, classes, sports programs,
art and music, cooking, and family
activities for 10 weeks during the
summer. The total budget for the
summer program is $14,000. Many of
the activities will be free or very low
cost to participants. With MRPA as a
collaborative partner, we plan to
recognize your organization by includ-
ing your logo on all publicity. MRPA
will be promoted throughout our
program as a contributing partner. An
evening family picnic is planned as a
kickoff for the center on the last day of
school.
Without the financial support of the
MRPA for this project, we would not be
able to proceed with this program.

The Chanhassen Elementary Parent /Teacher Organization has committed to a second
phase of playground equipment on the "west" playground. They raised approximately
$7000 through recent candy and wrapping paper sales, which they have designated for the
equipment.
I attended a meeting with the APT, Principal Helen Merchant, and Dave Owen, a
playground sales representative on Monday, February 12, 1996.
The committee reviewed the playground plan and decided to recommend the purchase of
the equipment. The committee is asking that the Commission confirm your intention to
provide matching dollars for this project.
Recommendation -
It is recommended that the Commission recommend the City Council designate up to
$7500 in matching funds for the purchase of a phase II playground expansion at the
Chanhassen Elementary/City Center Park "west" playground. These dollars to be drawn
from a fund 410 - Park and Trail Acquisition and Development reserve established for
this purpose. By this action, the Council shall amend the 1996 Park & Trail Acquisition
and Development budget to include this expenditure.
A playground plan will be on display at the Commission meeting.

I would like to take this opportunity to provide you with some information on an investigation we
conducted in response to a concerned resident regarding the legitimacy of the attached solicitation from
Hale House in New York. The mailer appears to be something for an organization within the City, if not
the City itself.
Because I received no response from Hale House, I worked with the Minnesota Attorney General's office,
learning that Hale House was not licensed to conduct solicitations in Minnesota. They pursued the matter
with Hale House.
I later received a response from a representative of Hale House further explaining their position, including
the fact that they actually are a charitable organization assisting poor families with premature infants, HIV
infected infants, cocaine babies, etc. While the purpose sounded noble, I explained that this situation could
have been alleviated had they responded to my initial request.
As a result of these efforts, Hale House and their fund raising representatives have changed their
solicitation approaches, and are working things out with the Attorney General's office. This entire process
took well over three months, and exemplifies how a situation can be pursued to the benefit of the city at
large.

I have received your November 28, 1995 letter to the Attorney General concerning a Hale
House Center, Inc. charitable solicitation received by Chanhassen resident I
apologize for the delay in providing you with a response. We appreciate it when citizens and
other government officials take the time to apprise our office of issues that concern them.
Minnesota law requires charitable organizations that solicit contributions in this state
register with the Attorney General. Registration does not constitute approval or endorsement.
Rather, it means potential donors can evaluate whether or not to give to a charity by reviewing
the program and financial information on file with a public office.
Hale House Center, Inc. located at 154 West 122nd Street, New York, NY 10027, is not
presently registered to solicit contributions in this state. The Attorney General will contact Hale
House Center to seek its compliance with state charity registration laws. As you may be aware,
while states may require a charity register, the United States constitution affords free speech
protections to the organization.
According to a representative of Hale House, the reference in the solicitation to the
"Chanhassen Annual Fund Drive" merely means the appeal is being mailed to a person in
Chanhassen. Unfortunately, we did not receive the entire mailing and cannot evaluate whether it
falsely represents that money raised through the appeal somehow benefits the City of
Chanhassen. It appears donations go to a New York charity that has no apparent programs in
Minnesota. This practice of localizing appeals is unfortunately somewhat common. The
.Attorney General,recentl.y . fi.led -an-action against-a- Norida:.eharity that, -among other problems,
used localized appeals that were alleged to be deceptive. If further information develops on Hale
House's solicitations, it will be evaluated for legal violations.
