City staff went on to receive an additional 24 calls concerning either the watermain and/or sewer back up. City Utility staff were on site by 7:25 PM. The water flooding the sewer system was throttled down to a point to stop the sewers from backing up at 7:40 PM. The watermain was repaired and back on to the affected areas before 3:00 PM, February 24, 2011. The main was dewatered for the repair and a total of 10 main valves were closed to achieve isolation. Thirty single - family homes were out of water service for about 15 hours. The entire repair process took 21 hours due to the deep frost in the area. Errant information from leak detection equipment regarding the actual location of the main break made the break repair take longer. When repairs were done, the main was filled in small sections and air was bled and flushed from four hydrants. The break was in the street near 8628 Chanhassen Hills Drive North. The cause of the break appears to have been frost heaving of the soil. When frost penetrates deep into the soil, it can cause the soil to shift along with anything else in the soil. Pipes that are buried 7' /z feet deep or more (as this pipe was) does not require insulation. The water pipe was not installed by the City but by a contractor that constructed the development. The 12" ductile iron pipe was in good condition both inside and out with no signs of corrosion. The pipe broke in a radial fashion exposing an unusually large 3 /a" gap that showed signs of deflection as the two separated sides of pipe were at a different angle when exposed. This suggests that uneven downward loading forces on the pipe. The water from the break could not penetrate the 4+ feet of frost in the street and traveled laterally under the frost line to a sanitary manhole in the street. The water then forced its way between the concrete manhole adjustment rings and instantly flooded the area's collection system. The rate of flow at the break was estimated by the City water system flow monitoring equipment at over 1,500 GPM. This volume far exceeded the design flows capacity of a 8" gravity sewer main and the main pressurized sending grey water into approximately 25 homes from lower level floor drains, showers and toilets. lq�"Atv� 4 ) cAdocuments and settings \toddg \local settings \temporary internet files \content.outlook \jirgifjk \final investigative report.doc In terms of system maintenance, the last time the main was flushed via fire hydrants was October, 2010. All hydrants are flushed twice a year, in spring and summer. No documentation is done for flushing individual hydrants as Chanhassen maintains almost 2,000 hydrants. The age of the watermain in question is 24 years, installed in 1987. All sewers are jetted at least once every 3 years. The sewers in this area were last jetted in 2008 under a sewer infiltration and inflow investigation project. There was no material in the sewer that caused a back -up. This incident was a "sewer inundation" due to large scale water inflows from a watermain break. In the days following the incident, staff discovered some grout from the adjusting rings that were damaged by the break in the sewer lines and conducted jetting and vactor operations to remove the debris. Questions Raised By Residents Since The Incident: 1 — Response time was not adequate and contributed to severity of damage. The watermain break and subsequent sewer back -up were very fast acting. City staff did some door knocking the night of the incident, but we did not reach all affected houses. Because of the nature of the incident, most of the damage to individual homes was done in the first few minutes. Essentially, there would not have been time for anyone to move belongings or to change the outcome. The general location of the watermain break was identified very quickly and the water was shut off within 55'minutes of the break. Generally, industry standards are to have these types of situations contained within an hour are considered good in terms of performance. A sub - contractor for the City used sonar detection to locate the leak location. It took several hours to get through the 4 -5 feet of frost at this location. When they reached the main, they discovered they were about 10 feet way from the actual break. It took several more hours to reach the actual break location and fix the main. During the digging operation, no additional property damage was occurring since the water had already been turned off. Finding and fixing the break only delayed restoring the water service. 2 — The design of the sewer and water system was faulty. The sewer and water lines are separated by 10 feet, which is the standard set by several agencies, including the Minnesota Pollution Control Agency. Staff does not believe the design of the system contributed to the incident. 3 — City staff was aware of a problem during the day and was working in the area on the water or sewer system. City staff was not aware of any issues or the potential for the watermain break and subsequent sewer inundation prior to the initial phone call at 6:44 pm. A utility employee, Charlie Chihos, did conduct a final meter read in the neighborhood on the day of the incident. City staff cannot specifically account for other city vehicles that may have been in the area during the day, but Odocuments and settings \toddg \local settings \temporary internet files \content.outlook \jirgifjk \final investigative report.doc obviously, there would be many reasons why they may have been in/going through the neighborhood. 4 — The water pipe was defective (possible manufacturer issue — US Pipe). There was no evidence that the pipe was defective in any way. The condition of the pipe was in good condition inside and out, with no corrosion present. Pipes this deep are not expected to be insulated in this area of the country. The claim rep from Travelers Insurance has advised that she does not see the claimants having success in pursuing the contractor who did the installation either. 5 — The cause of the sewer back -up /inundation was related to the failure and/or lack of manhole maintenance. The rate of flow into the sewer was estimated at over 1500 GPM. This volume far exceeded the design flows of an 8" gravity sewer main. A manhole, of any design, would not be expected to hold up under those conditions. The manhole adjustment rings appear to have been properly grouted however the grout was meant to keep out infiltrating ground water or surface water not a mass flow of water under pressure. In that I capacity, we acknowledge receipt of your claim. 1 j Based upon the information received and our investigation of your claim, we have found that our insured is not, responsible for your damages. The reason for our denial is that the City of Chanhassen had no actual. or constructive knowledge of there being an issue with the water main prior to the date of your incident. A governmental authority must have had prior knowledge of a problem and -then must not have addressed the said problem in a reasonable and timely manner in % order to be held negligent. The simple control of public property does not constitute negligence. Records reflect that the city maintains both the water main and the sewer main in a non- negligent manner. in addition, reflects reflect that, once they were notified of this situation, their response was both reasonable and timely. Please understand that our obligation is to pay claims submitted to us for which our insured is legally liable. I have reviewed the maintenance records and determined that the City of Chanhassen inspects and maintains the sanitary sewers on a regular basis. This- event - occurred due to a pipe - freezing and subsequently thawing. This Leas— unforeseeable, and there was -no prior notice of similar issues. I cannot assess any negligence against the City of Chanhassen, as they responded to the crisis in a timely fashion.
