Box 125 Jordan, MN 55352 e Agreement This letter is to confirm that the City of Chanhassen will not be pursuing an ordinance amendment requiring utility companies to pay for undergrounding relocated electric utilities. The city does wish to see the utilities on Lyman Boulevard placed underground and I sincerely appreciate the concessions that occurred during our meetings. On a related subject, the city does wish to continue negotiations on renewing the franchise agreement between the City of Chanhassen and Northern States Power. As I mentioned during our meeting, this office will be recommending that that document include the city's right to establish a franchise fee. This modification would ensure that the franchise between the city and NSP is consistent with that as"approved for Minnegasco this past year. Establishment of any fee itself is anticipated to be apart of the 1997 budgetary discussions which typically start in August. It is my understanding that Minnesota Valley would be willing to reopen discussions in regards to their franchise'with the city so as to ensure that all utilities were operating under similar franchise requirements. In addition to your letter, I have also received other inquires and complaints from residents concerning this matter. I hope the following information addresses your concerns regarding dock placement on Lake Minnewashta. The City does have an ordinance which regulates the placement of docks on lakeshore property. Generally speaking, a ten foot setback is required from the extended lot lines to a dock. However, there are existing nonconforming situations (grandfather rights) which may allow for lesser setbacks. I have enclosed the applicable City Ordinances pertaining to dock setbacks. Your property is located adjacent to the Minnewashta Heights Homeowners Association beachlot. On July 13, 1992, the City Council approved Non - conforming Use Permit #92- 6 for the Minnewashta Heights Homeowners Association as shown on the attached permit. The permit allows one 150 foot long dock with up to 14 boats at the dock. The dock is located on a -fifty foot wide parcel. The City Council approved of the non- conforming use permit with the following motion, "Councilman Workman moved, Councilman Mason seconded to approve ,the Minnewashta Heights Non - Conforming Recreational Beachlot with one dock 150 feet in length. with emphasis `on stavina within the dock setback zone, two canoe racks, 14 boats docked, swimming beach with marker ' buoys if they will enhance the safety of the swimming beach, and a swimming raft. All voted in favor except Councilman Wing who abstained and the motion carried." Upon review of the minutes of the July 13, 1992, City Council meeting, my interpretation of the Council's decision is to have the dock and docking slips conform to the setback requirements as much as possible given the existing non - conforming status of the dock and 14 boat slips. Records submitted by the homeowners association at the time of permit approval show dock extensions extending to the right (west), which encroach into the setback requirement. The homeowners association is entitled to these legal Mr. Francis Harry Faber March 27, 1996 Page 2 nonconforming rights (grandfather privileges). Hopefully, the homeowners association will utilize a dock configuration that minimizes the encroachment into the setback. The City will ensure that the dock does not encroach further into the setback than what was approved through the nonconforming use permit. I will contact the homeowners association regarding the location of their dock before they install it this spring. Last summer the City investigated a number of complaints concerning beachlots, including the Minnewashta Heights Homeowners lot. On August 29, 1995, the City sent notice to the Minnewashta Heights Homeowners Association reminding them of the dock setback requirement and their nonconforming use permit. The City also requested that they clean up the lot by removing the unused dock section. Upon further inspection, it appeared that the beachlot met the conditions of the interim use permit. In addition to responding to complaints, we attempt to perform periodical reviews of beachlots to determine compliance with city code. However, due to the number of beachlots and their level of use, it is difficult for City staff to consistently monitor the activity on beachlots. We appreciate you taking the time to inform us of your concerns regarding this issue. We will be contacting the Minnewashta Heights Homeowners Association regarding these problems. This year, I urge you to see that this requirement is strictly enforced for the protection of bathers and swimmers who use the beaches of this beautiful lake from shoreline to areas 100' to 150' out into the water. In the past, this regulation has been violated and this is wrong. Maintaining a 10' distance is proper and safer. I was out -of -town visiting my parents when Nancy..called to tell me about the fire. My son Matt is the one who called 911 and witnessed how quickly Mark and the department were on the scene. Both told me repeatedly of how pro- fessionally helpful everyone was. And our insurance adjuster and clean -up people complimented your work -- not over - reacting and damaging what needn't be damaged. I realize you hear this from many people served by the fire department, and you hear it sooner than you have from me.
