' Phase I of the Coulter Boulevard improvement project (from Galpin Boulevard to 1600 feet east)
adjacent to the school site is substantially completed with the wear course to be paved next
summer. It now appears that there is a great deal of interest from adjacent landowners to have
' the remaining segment of Coulter Boulevard between Phase I and the existing segment adjacent
to Pillsbury constructed to an urban roadway section with municipal utilities. In fact, the City
has received petitions for this public improvement project from four property owners amassing
more than 120 acres in the southwest quadrant of Section 10 and north half of Section 15 (see
attachments).
The project scope anticipated at this time would consist of the following primary elements:
1. The construction of Phase II of Coulter Boulevard from 1600 feet east of Galpin
' Boulevard to existing Coulter Boulevard adjacent to the Pillsbury site to a urban collector
roadway segment with concrete curb and gutter, storm sewer, sanitary sewer and
watermain.
2. The construction of Stone Creek Drive (from its current terminus in the Creekside
' development north to Trunk Highway 5) to an urban collector roadway section with
concrete curb and gutter, storm sewer, and municipal utilities.
3. The extension of trunk sanitary sewer from the Creekside development north under Trunk
Highway 5 to serve the southwest quadrant of Section 10.
4. The construction of a pedestrian underpass /culvert under Coulter Boulevard on the east
branch of Bluff Creek.

The completion of this project would provide for an east/west roadway thoroughfare between
Galpin Boulevard and Audubon Road, provide municipal watermain looping in Section 15 of the
City and provide the extension of trunk sanitary sewer through the northern portion of the Upper
Bluff Creek sewer district. In addition, the City has been granted Federal ISTEA funding in the
amount of $240,000 for the construction of the pedestrian underpass /culvert. The Federal ISTEA
Transportation Enhancement Program (TEP) funding year is 1996 which requires that all funds
associated with the underpass work be obligated prior to December 31, 1998.
I have asked one of the City's municipal engineering consultants who is familiar with the Upper
Bluff Creek sewer district and also has provided design and inspection support on the Phase I
portion of this improvement project to submit a cost proposal to conduct the feasibility study and
necessary supporting documents such as the environmental assessment worksheet (EAW) and
project memorandum document which is necessary for the federal ISTEA project documentation.
The cost to complete the scope of services as outlined in a letter dated November 2, 1995 from
Bonestroo totals $41,000.
In accordance with City policy on similar petitioned projects in the past, it is recommended that
the petitioning properties be required to secure the cost for preparing the feasibility study. If a
project is ordered, the security amounts will be applied towards the special assessments against
the property. Cost sharing for the feasibility security has been pro -rated based on the acreage
owned by the petitioning property owner. This methodology results in the following security
cost sharing:

At this time it is staff's recommendation that the City Council authorize the consulting
engineering firm of Bonestroo, Rosene, Anderlik & Associates to prepare the feasibility report,
EAW, project memorandum, soil investigation and survey work with a not -to- exceed amount of
$41,000 for the Coulter Boulevard Phase 11 Road and Utility Improvement Project No. 93 -26B
conditioned upon the petitioning property owners, Bluff Creek Partners, Heritage Development
of Minnesota, Inc., Hi -Way 5 Partnership and Dr. Lars T. Conway, securing the cost of the
feasibility study on a pro -rated share basis as described above.

Manner's Comment - Funding commitments for 1996 are starting to mount. Extension of
Coulter Boulevard (this project) should be a priority in light of the eligibility for both state aids
and ISTEA, in recognition that few industrially zoned lands are left, and the fact that time
continues to click on our tax increment district. Other 1996 projects include:

Lurking in the woods is the Powers Boulevard project at a cost of $4 million. [The 10 million
bonding limitation per year continues to exist.] We will continue to try to get the county to front
end as much of that project as possible so as to preserve bonding authority should the park
referendum pass. Before bringing back the Powers Boulevard project for consideration, we will
have developed a plan under which both projects can become a reality in `96/'97.
Approval of authorizing the feasibility study is recommended.

As requested, we have reviewed the necessary tasks and estimated costs to complete the
predesign phase of constructing Coulter Boulevard between the Chanhassen Recreation
Center and Pillsbury (McGlynn Bakeries). We have also prepared an estimated schedule to
complete the tasks.
The tasks that need to be completed include a Project Memorandum for the FHWA
funding of the trail/creek underpass, an Environmental Assessment Worksheet (EAW),
soil borings, right -of -way /easement descriptions, and a Feasibility Report. A brief
discussion on each task and a proposed schedule is presented below.
Project Memorandum. This document is necessary as part of the funding and review of
the Trail/Creek Underpass. The document includes Project Information, a Social Economic
and Environr.cntal rcviev ✓, and a Design Study. The cost or the Pr *ct Mcmorandum will
be approximately $7,500. In addition, approximately $ 7,500 of the design fee will be
encumbered to prepare the preliminary plans required with the Project Memorandum. This
amount is credited back to the City during the final design phase.
Environmental Assessment Worksheet (EAW). A state Environmental Assessment
Worksheet will be required since the project involves new road construction more than 0.5
miles long. The cost for the EAW could vary greatly depending on how controversial the
project becomes and how much information can be provided by the adjacent developers. It
may be possible to have the developers complete the entire document. The costs for an
EAW for similar projects range from $3,000 to $20,000. The additional costs come up if
the reviewers require air and /or noise analysis. For this project we estimate the EAW costs
to be $9,500.

Soil Borings. Soil borings for the street and sewer work should be completed by a separate
geotechnical consultant. We will coordinate the work for the City. We will also coordinate
the work with the adjacent developments in an effort to share information and costs. the
estimated costs for the soil borings is $5,000.
Right- of- Way/Easement Descriptions. Right -of -Way acquisition and easements will be
required for the work. Most of the right -of -way should be acquired as part of the adjacent
developments. However, to avoid delays, the City may want to acquire the right -of -way
prior to the platting of the adjacent property. Preparation of the descriptions will be
completed by an independent registered land surveyor. We will coordinate the work for the
City. The estimated cost for this task is $3,200.
Feasibility Report. A feasibility report for the project should be prepared to outline the
estimated project costs and assessments. This report can be partially prepared using
available information from recent projects in the area. The most difficult part of the
Feasibility Report will be addressing the necessary storm sewer and ponding improvements.
The estimated cost to prepare the Feasibility report is $4,500.
Topographic Survey. A final task that should be completed is the topographic survey
necessary for final design. It would be best to complete this work before snow cover. The
estimated costs for this work is $3,800. This amount would be credited back to the City
during the final design phase.
Proposed Schedule. The estimated time to complete the tasks is shown below. The dates
shown indicate an aggressive schedule.

I have recently been talking with our contact for the Bluff Creek
development site, Liv Horneland. She tells me that the City is
uncertain as to whether they plan to extend the south access road to the
Bluff Creek property and to supply the utilities required for building
an industrial plant.
I wanted to convey to you the fact that Osmonics is presently building
an additional 130,000- square -foot facility in Minnetonka. We considered
putting this facility at the Bluff Creek site, but could not do so
considering the lack of utilities and a suitable access road. We do
hope that prior to the time that we consider another expansion, the
Bluff Creek site will have the south access finished.

In this letter, RLK Associates represents the following developers and landowners in the City of
Chanhassen:

Liv Homeland, Land Group, Inc.
Each of the above developers and landowners are actively pursuing development in a part of the
City of Chanhassen known as the Chanhassen Corporate Centre area. In early 1994 this
development team petitioned the City of Chanhassen to serve the Chanhassen Corporate Centre
area with public improvements of sufficient size and capacity to serve planned land uses. One of
these improvements is the construction of an east -west collector roadway between Galpin Blvd.
and Audubon Road.
We understand that the City will soon take official action on what roadway projects to fund in
1995. We understand that City staff will recommend to the City Council a roadway funding
package that does not include Phase II of the east -west collector road. We are requesting the
City place a high priority in 1995 on Phase II of the east -west collector roadway for the
Chanhassen Corporate Centre area. From previous conversations with you and the City's
engineering consultant, we understand that the City could commence with construction on this
project in 1995 and complete the project by fall, 1996.

The purpose of this letter is not to question the legitimacy of public improvement projects
currently recommended by City staff to the City Council. We want to make sure the City clearly
understands the reasons why it is important to commence with construction of the Phase II east -
west collector road in 1995. Our ultimate desire is to work with the City in finding a way to
begin this construction schedule, and to complete the roadway project by fall, 1996.
The following are reasons we believe Phase II of the east -west collector road should be funded in
1995, and why the City should commence with construction in 1995.
Extension of existing roadway
The collector roadway serving the Chanhassen Corporate Centre area is really an extension of an
existing roadway. Construction for Phase I of the collector roadway is planned to commence in
the spring, 1995. Phase I must be completed by the fall, 1995 in time to accommodate the new
Chanhassen Elementary School. We believe it is most efficient for the City to continue with
Phase II of this roadway project, rather than wait to construct the remainder of the roadway. We
also believe that, by completing Phase II of the east -west collector road to Audubon Road as
early as possible, will ultimately provide a safer transportation system for the Chanhassen
Elementary School.
Commitment to developing
The development team has demonstrated a genuine commitment to developing in the Chanhassen
Corporate Centre area. Since fall, 1993, RLK Associates has worked with Barton- Aschman on
the alignment of the east -west collector road. Currently, the two consulting firms continue to
evaluate the roadway alignment and profile ensuring the greatest benefit to adjacent landowners
and to the City. We understand that final design for Phase II of the road could be completed by
summer, 1995. Both the City and the development team have already made a significant
investment in Phase II of the roadway.
As mentioned, we have submitted a petition to the City for public improvements to the area. We
continue to support this request for public improvements, and we are prepared to pay all
reasonable special assessments for the construction of the public improvements. We recognize
that our ability to market our properties is dependent in large part on the timely provision of
public roadway and utility improvements.

Proposed development
The development team is also committed to developing now in the Chanhassen Corporate Centre
area, and the City recently granted preliminary approval for a development in this area. Heritage
' Development submitted a development proposal in early 1994 for a single family subdivision
lcro�ti-r: as Creekside. Tbis area wa o ^gin Ry:p rt. of the Chanhassen Corporates Centre area, and
the proposed development recently received preliminary plat approval from the City Council.
Secondary access is available to the Heritage development, but the collector road will serve as a
fundamental transportation link.
' In March, 1994 a preliminary Planned Unit Development (PUD) submittal was made to the City
for the Chanhassen Corporate Centre area. This proposal was withdrawn for several reasons.
Each member of the development team is currently evaluating site design and land use related
issues and it is likely that several development proposals for parts of the Chanhassen Corporate
Centre area will be submitted in 1995. One user in particular, is a major Minnesota corporation
that needs to occupy approximately 100,000 square feet by the end of 1996. This type of
development can only occur, however, if the City makes a commitment to constructing Phase II
of the collector roadway in 1995 and 1996.
Private - Public Partnership
' In addition to the above, we believe the City's commitment to constructing Phase II of the east -
west collector roadway is a good example of private and public sector interests working together.
The development team desires the collector road to support planned land uses. The City will
benefit from additional residential and commercial property tax base, increased employment
opportunities, and additional housing supply.
' We are prepared to develop our properties in the near future. We are committed to paying for the
public improvements necessary to serve the Chanhassen Corporate Centre area.
' We are also requesting an opportunity to appear before the City Council and present our position
in favor of the east -west collector road. We believe it is important the City Council knows we are
' committed to developing in the Chanhassen Corporate Centre area and that the collector road is
needed for any development to occur in this area. Please advise us of the City Council meeting
where this matter will be considered.

Phase II East -West Collector Roadway Improvements
' Dear Charles:
We the undersigned, are developers and landowners in a part of the City of Chanhassen known as
the Chanhassen Corporate Centre area. In early 1994 we petitioned the City df Chanhassen to
serve this area with public improvements of sufficient size and capacity to serve planned land uses.
One of these Improvements is the construction of an east =west collector roadway between Galpin
Blvd. and Audubon Road.
' We understand that the City will soon take ofIicia.1 action on what roadway proj6ots to fund in
1995. We understand that City stafrrnay.recommend to the City Council a roadway funding
package that does not Include Phase Ir of the east -west collector road.. Wa ere requesting the
' City place a high priority in 1995 on phase 11 of the east -west collector roadway for the
Chanhassen Corporate Centre area. From previous conversations with you and the City's
consultant, we understand that the City could co"mmenoe with construction on this project in 1995
' and complete the project in 1996.
The following are reasons we believe Phase II of the east -west collector road should be funded in
1995, and why the City should commence with construction in 1995.
Extension of existing roadway

existing roadway. Construction for Phase I of the collector roadway is planned to continue in the
' spring, 199S. Phase I must be completed by the fall; 1995 in time to accommodate the new
Chanhassen Elementary School. We believe it is most efficient for the City to continue with
Phase 17 of this roadway project, rather than wait to construct the remainder of the roadway. We

also believe that depending on where the City chooses to end Phase II, access may be ufer to

Commitment to developing
The development team has demoristrated a genuine commitment to developing in the Chanhassen
Corporate Centre area. Sitict fall, 1993, our engineering'and planning consultant„ RLK
Associates has worked with Barton- Aschman on the alignment of the east -west collector road.
Currently, the two consulting Ems continue to evaluate the roadway alignment and profile
ensuring the greatest benefit to adjacent landowners and to the City. Ws understand that final
design for Phase 11 of the road could be completed by spring, 1995. Both the City and the
development team have already made a significant investment In Phase 11 of the roadway.
As mentioned, we have submitted a petition to the City for public improvements to the area. We
continue to support this request for public improvements, and we are prepared to pay all
reasonable special assessments for the construction of the public improvements. We recognize
that our ability to market our properties is dependent in large part on the timely provision of
public roadway and utility improvements.
Proposed development
The development team is also cuminittod to developing now in the Chanhassen Corporate Centre
area, and the City recently granted preliminary approval for a development in this area. Heritage
Development submitted a development proposal in early .1994 for a single family subdivision
known as Creekside. This area was nriginally part of the Chanhassen Corporate Centre area, and
the proposed development recently received preliminary plat approval from the City Council.
Secondary access is available to the HedLaSt development, but the collector road will serve as a
fundamental transportation link.
In March, 1994 a preliminary Planned LTnit Development (PUD) submittal vans made to the City
for the Chanhassen Corporate Centre area. This proposal was withdrawn for several reasons.
]each member of the development teal" is wtTeAtly evaluating site design and land use related
issues and it is likely that several development proposals for parts of the Chanhassen Corporate
Centre area will be submitted in 1995. One user in particular, is a moor Minnesota corporation
that needs to occupy approximately 100,000 gqustre fp,o by the end of 1906. This type of
development can only occur, however, if the City makes a commitment to constructing phase II
of the collector roadway in 1995 and 1996.

Private - Public Partnership
In addition to the above, we believe the City's commitment to constructing Phase II of the east -
west collector roadway is a good example of privite and public sector interests woridng together.
7%e development team desires the collector road to'support plarmed land uses, The City will
benefit from additional residential and commercial property tax base, increased employment
opportunities, and additional housing supply.
We are prepared to develop our properties in the near future.' We are committed to paying for the
public improvements necessary to serve the Chanhassen Corporate Centre area. We are also
requesting an opportunity to appear before the City-Council and present our position in favor of
the east -west collectur road. We believe it is important the City Council knows we are committed
to developing in the Chanhassen Corporate Centre area and that the collector road is needed for
any development to occur in this area,
We look forward to the City's support for constructing Phase II of the collector road in 1995.

acceptable to all development team members. Please proceed developing the roadway plans using
this horizontal alignment.
