Dear Mayor Jansen,
My name is Mike Miller, and I live along Hwy. 101 at 71 Choctaw Circle. This is the first time I have written to
an_.._.~La_0_A in public service, but I do feel strongly about the proposed Hwy. 101 bike trail.
We have lived on Choctaw Circle for more than 22 years. When we purchased our home in Chanhassen, the
Hwy. 101 bike trail connecting us to the rest of the proposed trail system was already being discussed.
Since moving here, we have had three kids of our own. While they were growing up, Hwy. 101 was always off-
limits to them for biking - we simply did not want to endanger our children. However, for 20 years it seems that
there was always a plan on the table to 'solve' the Hwy. 101 trail issue. We continued to hope that our city
leaders would step forward and solve this problem. Now my kids are off to college and, sadly, nothing has been
resolved.
Although the urgency for me no longer exists, there are many families in my neighborhood with young children
who would greatly benefit from a Hwy. 101 bike trail. I would like to see their children have the opportunity to take
advantage of all the city resources that my kids could never safely access.

14, 2001. From this report I gather the trail can be constructed this

for the allotted dollars that are available. This trail would have

impact on the residents and environment, it's within the guidelines of
the
!-A road proposal accepted by the Chanhassen city council and can be
completed this year. Whau are we waiting for? I understand ~here i's a
desire
by some to put the projec~ on hc!d until the turn-back issue is
resolved.
Please remember, we have been pusuing it on hold for 20 years. If the
trail ~
had been constructed 20 years a~o, as was first proposed, it would have
cost
much less money. We are still living with the mistakes of those early
city
fasters to wait and see. We residents continue to need this trail for
our
safety and the safety of our children. Please help us make this dream
come
true. The gca! has never changed; a slow, safe 10i, with a trail within
the
existing ?~-DOT right of ways. E am also in favor of the boardwalks in
the
wetland areas.

Per our telephone conversation, I am following up with this email in order for you to include our current
input in y( documentation to the city council. Thank you for explaining the overall picture of the trail process, at
least as know it to be so far. The property impact issues we see as being relevant to our property at 31 Hill
Street an on page 3 of the Feasibility Report. They are numbers 2-5:

As you wi see on map A-2 of the report, all three of these items significantly impact our property and will very
directly ~ct our home and lives. Making sure that they are designed and executed with the best possible
solutions i~ our goal.
Towards ti at end, please note the following input regarding our property. We have had water shed issues in the
past. The itch alongside of our property and 101 prevents water from flooding our backyard and flowing to the
front and ashing out landscape rock. A couple of years ago, it was filled with debris so that during heavy rains,
water flool our property. We contacted Hennepin County and they cleaned out the ditch. This resolved the
issue. If th area will become a level surface again, the watershed issue will resurface. The drainage design must
accommo( ~te this issue.
Also, we u derstand that as soon as the city knows about enlarging the turnaround, we will be contacted and the
negotiatior will begin. We also understand that when plans to remove any shrubs on our property are known, we
will be noti in advance should we decide to relocate the shrubs. We would like to know officially what the
maximum ;nce height is for the "sight/distance" area and what portion of our property falls into that
"sight/dist~ ~ce" area.

Teresa: Just a note to say thank you for your efforts regarding the 101 Trail. I have attended numerous meetings
and have found your knowledgeable input to be a breath of fresh air when compared to the politics of the City
Council. Being an engineer myself, I know you deal in facts; now if we can get the politicians to do the same!
I am 110% supportive of the trail, and from my view sooner is better. I understand the limitations we're under, but
I also realize that some of the issues can be used as an excuse for a lack of progress. I would suggest to you,
and the City Council will be asked for this as well (by either me or someone else), is to continue to publicize the
project timeline and indicate, either in the printed media or minutes of the Council meeting, if we are on schedule
or late, which of course would require an update to the projected completion. This way the "surprise" factor will
be left out, and the people can know where the project stands regularly.
Again, I heartily thank you for your efforts and supply of information. Keep up the good work!

As President of the Lotus Lake Estates Homeow'ners Association (LLEI-L~.), the homeow'ners and
residents have appointed me to share with you our unified position on the recently proposed
construction project for Chan_hassen Road known as Highway 101.
The officers and residents of LLEHA have attended the informational hearings, listened to the
engineers and considered the various proposals as presented. We ovelwcheLmingly a~ee that Highway
101 is a significant safety concern. The road is in need of immediate repair and is extremely hazardous.
The Council must act ~vith a sense of urgency, as improvements to Highway 101 are long overdue.
However, the 'concepts' presented by the planners are NOT acceptable. Their proposals contain
modifications which result in the severe degradation and character of our residential nei=hborhood
community including: ~
· Decreased properr?' values
· Increased traffic volumes
· Increased noise levels
· Loss of wetlands, vegetation, and mature trees
· Severe encroachment of existing property lines
Further. the information disseminated to community residents, specifically the document prepared by
SKF Consulting Group, Inc. titled, 'Comparison ofcot~ceprs 1,2,3 and 4' contains deceptive
statements including results of' the impact study which are clearly based on opinion rather than fact.
LLEHA as well as the neighborhoods of Kurver's Point, Colonial Grove. Near Mountain and Fox
Hollow have recommended an acceptable, alternative 'concept' to the er~gineers knov,'n as 'Plan IA'.
We have made it clear to the planners during our individual formal hearings; Plan lA is the only
alternative the neighborhood communiw will support and accept. Brieflv,'~he essential points o~Plan

· Maintain existing easements
· Install a minimum impact bike path immediately
· Install traffic signals at Pleasant View and Valley View immediately
· Lower the speed limit

Mayor Jansen, Honorable Council Members, Staff of the City of
Chanhassen:
I want to thank you for taking time to solicit and accept input on
Highway 101 and the 101 trail issues. I know that this is a difficult issue for
all of the staff and council, as well as the citizens who live along 101.
Let me say first of all, that I am in favor of a safe, slow two-lane highway
with a trail and traffic lights at Valley View and Pleasant View. Many call
this plan 1-A. Of all of the plans submitted, this is still the best. I have heard
from some that this stand is against progress. We need to stand aside to
allow for more traffic because of development in the western side of the city
and county. We can use state money to "fix" the problem, freeing
Chanhassen's money to address other issues. Well I can tell you we have
lived with progress. The traffic has increased mightily in th~ 14 years we
have lived here, and even though that may not be our ideal, it's reality.. Our
city and surrounding area have changed, some for the better, some not. But
forcing a wider right of way into such a narrow corridor as 101 is not the
answer. The corridor was never designed for anything but a two-lane
highway. All six proposals put forward by Hennepin County are too
aggressive, too destructive, too self-serving, and all take easements for a
minimum of four lanes. I'm not against progress: I'm against unrestricted,
unreasonable progress.
Twenty-five years ago there wasn't much out here in Chanhassen. City
Council could easily have done whatever they wanted to do with the 101
corridor. They built homes and neighborhoods here. folks' The taxes these
homes have paid, have been the base of growth and expansion for the city of
Chanhassen. You taxed us heavily. We are among the hizhest taxed areas
in the State. Now, we are asking for something in return. ~e are asking for a
safe, sane 101; managed, safe traffic; and a trail as soon as possible. We are
asking you to think of this concept; the western end of 62 as it exists now,
continuing to be a feeder for 101 north, Dell road south, Townline and
Pleasant View roads as well as 101 south. We are happy to deal with the
traffic levels on that two-lane Highway 101. If Hennepin County needs a
four-lane outlet for 62, why don't they take that four-lane concept north on
101 into there own county as well as south? They can run it at least to
Highway 7, but why not all the way to Rogers to the north and to Shakopee
the south? Yet, why did they just complete a two-lane bridge over Grey's
~y instead of a four-lane bridge? And what about four lanes down Dell
>ad also? It's all in Hennepin County and it also goes to Highway 5. Why
Chanhassen need to be Hennepin's stooge? We all moved to
hanhassen because it wasn't Hennepin, it was better!
n the issue of the trail, everyone ag-tees there should be a trail along 101.
issue carried by a vote of 5-0 in October, including the votes of Mayor
and Council member Labatt. In a recent city council meeting and
s~ tbsequent articles in the Chanhassen Villager, the sums of $1.3 million and
000 have been bantered about. First let's talk about the $1.3 million
c~ instruction costs figure. How could the trail jump from $800,000, the
budgeted, to $1.3 million in just 5 months? Was the old staff that
competent? Was City Council fooling itself?. If the trail had been built
it was first proposed, what would the cost have been? Maybe
$ 00,000, maybe $200,000? Who do we blame for that cost difference? If
wait, what will happen to construction costs? Certainly they will not go
d ,wn! Most importantly, what is the value of one life possibly lost or
~gically altered due to inaction on this issue?
It also stated that the 400+ homes in the area have only contributed
S~ 5,000 toward the trail construction, a small percentage o'f the actual cost.
Si we have no idea from where that figure came, it is hard to argue. But
u~ ing that same logic, should citizens with no children be forced to pay taxes
the school system? Should we as citizens be taxed for projects we don't
u: :? We have a pedestrian bridge over Highway 5, Where did the money
c~ to pay for that project? Certainly not just from the citizens directly
~ from it. (I would be interested in a count on how many people
ually use that bridge, and your cost analysis on it.) We as citizens, pay
ta .es into a pool to make our city, county, state and countrY better places to

phone call I did not realize how long it had been. We have contacted XCel today and told them we
need the information so we can get it to you.
As for the trail'
1. At this time no right of way acquisition is anticipated from your property. Any trees that will be
removed will be identified during the design phase of the project. Right of way acquisition will also
be finalized at that time. If the project is approved by the Council, an open house will be held
during the design phase so that property owners can view the plans and make any comments. A
notice of that meeting will be mailed once the date and time is set.
2. The City also has concerns about the condition and safety of the existing Hwy 101. The City is
continuing to negotiate and pursuea turn-back project with Mn/DOT. Representative Workman is
assisting the City with this effort. However, the City Council has madea commitment to geta trail
for trfis neighborhood and for that reason we are continuing to pursue both projects. City Staff will
continue to try to negotiate a reasonable turn-back solution until a resolution is reached.
3. Existing fences wi'Il be addressed during the design phase. Property owners with existing fences
or trees in the right of way will be informed so they have an opportunity to remove or relocate
them prior to the City project. The Feasibility Study recommends that property owners thai: abut
the project be given the option of additional landscaping or fencing if desired, but that the expense
of those be paid by the property owner either through an assessment or pre-payment. The City
does not typically install fence along City trails.

101. Please be advised that I strongly support this initiative. Additional comments follow...
First of all, shame on me for remaining "politically silent" on this topic for so many years. Instead of voicing my
opinion to governing bodies, I have reserved my comments for social circles. Frankly, this is the first time I've ever
raised my head above the "silent majority" to clamor for a cause. I'm driven there because this topic hits so close
to home. It's personal and it's something I've grown passionate about.
In 1989 my wife and I relocated back to Minnesota from Louisiana (a state that provided me with yet another
perspective of the political process!) and chose Chanhassen as the place we wanted to settle and raise a family.
When we purchased our home in Lotus Lake Estates, we immediately fell in love with the areas ambiance and
sense of community. The only thing missing was a safe non-motorized outlet to the surrounding communities.
Several of the neighbors told us at that time that the trail was eminent; that the need had already been identified
and that the political process was already in motion to bring this needed asset to the then 6,000 residents of
Chanhassen.
Fast forward 12.5 years. We have been blessed with three children now ages 10 and 8 (twins). While there has
been.tremendous change globally, nationally, throughout our state and even locally in Chanhassen, a final
soluti'~n for the 101 trail is still outstanding. Weekly, when my wife and I take our walk around our neighborhood
and then venture out onto the shoulder of 101 to walk through neighboring Colonial Grove, I'm reminded of this.
On wet mornings we incur the splash from passing motorists, on other days we trudge through snow
accumulation slowly progressing from point A to B and, on all mornings that we walk, we do so with trepidation
and a sense of "second class citizenship". Where the shoulder narrows along the creek, we walk a tightrope with
motorists, often wincing at the proximity of steel hurdling past at 45+ m.p.h.. Silently I curse the political paralysis
that has impeded a resolution to this impasse.
The same emotions overcome me each time I am forced to load up all five bikes so that we might drive to another
nearby community to enjoy family time on one of the many trail systems provided other communities. I loathe
politics at these times. From these experiences has sprung my passion for this project.
I've attended meetings at city hall regarding the over-all 101 debacle (debate). My wife and I have also signed a
petition supporting proposition lA. Our position in a nutshell: if the communities to our north can find working
solutions within the current easement, I'm hard pressed to accept that we cannot as well. I resent the turnback
leverage being applied and view this as something akin to duressful manipulation or even blackmail.
My over-all sense is that select political appointees do care about this project while others support it only because
it appears to be the right political decision. Regardless of one's motivation, it's now time for commitment and
accountability. It's time to show one's integrity and display the courage to assure of meaningful progress.
Ultimately, it's time to move the process quickly to implementation of solutions.
Some of my neighbors have been embittered by their lost opportunity to share such a resource as a trail with their
children. I surely hope this too will not be my own fate. Teresa (and council members), can I count on your
passion, courage and commitment to see this through to a timely and successful resolution?

Thank you for your e-mail. The distance between the trail and the road
will vary as it travels the route to best fit the existing ditch and
berm. In most places the trail is on the back of the existing ditch.
The City intends to limit the number of trees removed, however, it will
not be possible until during design to determine the full extent of tree
removal. The City does do tree replacement in keeping with the City
Tree Removal policy but that would only address trees over 6" in
diameter. Property owners would be informed as soon as it was
determined that trees would need to be removed as soon as possible both
as a courtesy to the property owner and also to allow those trees that
can be saved to be relocated.
The trail closely follows the ditch. The City is required to maintain
and in some cases improve the drainage of the area as the trail is
installed. Because of this, it is not possible to put the trail
ccmplete!y in the ditch.

1) Until detail design is started it is difficult to state what the
impact to your property would be, however, the feasibility study shows
the trail being completely on the Mn/DOT right of way in the vicinity of
your property. There would need to be some tree removals in this area,
but they are located on the right of way.
2) It does not appear at this time that there would be any need to
acquire easements from your property. If that changes, you will be
contacted directly_, to negotiate the acqulsition_ . The City will make an
offer based on market value of the property and the amount of property
required.
3 & 4) The current proposal does not include any changes to the

In response to your questions:
a) No easements are anticipated at this time. If during design easements are determined to be necessary you
will be contacted by the City to negotiate acquisition. The City will make an offer based on market value of the
property being acquired. Market value is based on area sales and easement settlements.
b) The City will follow the City's Tree Replacement policy. The tree replacement policy requires that 2 caliper
inches be installed for every 1" removed. Trees less than 6" in diameter are not included in the count of tree
removal. No dollar compensation will be made for trees removed from the existing right of way. Trees removed
in easements will be negotiated as part of the easement acquistion. Property owners will be informed prior to the
tree removal so that they may relocate any plantings in the right of way to private property.
c) The City does not typically install screening along its trails. The feasibility study recommends that those
property owners that desire screening installed as part of this project pay 100% of the cost through an
assessment agreement.
d) The City will hold an Open House for people to have a chance to review the draft plan. This is typical for City
Improvement Projects.

This is in response to the request for comments regarding "Highway 101 Trail from West 78th Street to
Pleasant View Road".
1. The Feasibility Report indicates a proposed catch basin at location 26+00 which feeds into a proposed
storm sewer. We would like to emphasize the importance of maintaining this catch basin and storm
sewer in the final plan. Currently, run-off from this area flows through the back of our yard toward
Lotus Lake. While we are concerned about the current run-off situation, we want to ensure that it is not
worsened by any trail construction. We presume that the proposed catch basin/storm sewer adequately
addresses this issue.
2. The proposed trail takes a sharp turn up the berm at location 26+00 and then moves back down the
berm at location 29+00. We have consistently requested that the trail stay as low on the berm as
possible. We ask you to consider all possible means of straigtening the trail in this section so that it
stays at the bottom of the berm. The bend in the trail in the feasibility design appears to be correctable.

Hwy 101 Turn Back Project, City Project 97-12
On January 22, 2002, Mayor Jansen, City Manager Todd Gerhardt, and City
Engineer/Public Works Director Teresa Burgess met with Representative Tom
Workman, representatives of Mn/DOT, and Frank Mendez to discuss the status of
the Hwy 101 Trail and the Hwy 101 Turnback. The following is a status update:
Hwy 101 Trail Project, City Project 97-12-3:
· Feasibility Study
.
. Council is scheduled to accept the feasibility study on 1/28/02.
This item is on the consent agenda as all Council Members have
expressed support and no discussion is anticipated.
· DNR Grant ($500,000)
. The $500,000 grant from the DNR for the trail is one of the cuts
being recommended by the Ventura Administration for deficient
reduction. The cuts will need to be approved by the Legislature;
however, it will be at least March and possibly April or May
before the decision is made.
- Representative Workman is working to keep the funding.
- Representative Workman has been sent copies of the feasibility
study. A file search has been initiated for any other information
that would support him in keeping the funding.
· Limited Use Permit (LUP)
- The City Council has passed a resolution to submit the feasibility
study for Mn/DOT review in the LUP process. This process can
take 30 days or longer. The last LUP review took 90 days and the
request was denied. The city cannot build a trail in Mn/Dot's
right-of-way Without an LUP.
Hwy 101 Turn Back Project, Ci.ty Project 97-12:
· The City's Consultant is working on the traffic analysis to show that a 2-
lane road with turn lanes, shoulders, and traffic signals meets the required
Level of Service "D" to qualify for turn back. The initial analysis should
be completed by Monday, January 28, 2002. Information will be shared
with the Chanhassen Villager and posted on the City web site as soon as it
is available.
· With or without the grant, the turn back still remains the most cost
effective for the City of Chanhassen, an estimated $120,000 - $200,000
' comnluniO, with clean lakes, qua/itl, schools, a charming downtown, th~ivin~ businesses, and beauti/:al /)arks. A ~reat /)lace to live, work, and

verses $800,000 in taxpayer dollars. It would also result in a low impact
trail, as requested by the neighborhood, because it can be kept directly
adjacent to the roadway instead of having to fit to the existing grade.
· MnfDOT has expressed support for a turn back project with funding in
Fiscal Year 2004 with construction to maybe start as early as June 2003
for a turn back assuming that a turn back agreement can be reached. Both
Chanhassen and Representative Workman have explained that June 2003
may be too late. Mn/DOT will look for alternative ways to accelerate
funding and construction of the project.
· Mn/Dot will be setting up a meeting next week with Hennepin County,
Eden Prairie, Carver County, and Chanhassen to discuss the new traffic
count information and to solicit their support and approval of
Chanhassen's turn back proposal.
· If the $500,000 grant is cut, the turn back may represent the best option for
getting the bike path completed.
A meeting is scheduled for February 11, 2002 for everyone at the original meeting
to report the status of the project and plan the next steps.
