Valuation/ )ned property was approved by the city to the council on the 13th of February , the city attorney's office was rsuant to Minnesota Statute Chapter 117 iled with the District Court date of November 16, 1995, was The city's initial offer of $30 /acre was consistent with other transactions being made within the city. The Oaks at Minnewashta plat and the Forest Meadow are two comparables. Both of these projects includ64he`° acquisition of parkland in:excess?of what could be acquired through the city's dedicat, ordinance.- L•ike Heritage plat ( Creekside), bath plats at some point in their development identified the parkland as platted home sites. At present, the city holds a signed pur "chae`agr eement for The Oaks�at 1VIinnewashta parkland priced at $30,000 /acre. The purchase agreement fob the Forest Meadow parkland is on the council's November 27, 1995 agenda priced at,k, 000 /acre. To qualify these comparables, Swenson & Associates was retained by the city, prepare a limited appraisal /consultation report. The cover pages of this report dated December 7, 1994 are attached. As of November 25, 1994, it was Mr. Swenson's opinion that the subject 2.3 acres was valued at $27,000 - $29,000 per acre. Future assessment costs which are not reflected in this value would also be assumed. Mr. Don Ashworth November 20, 1995, ' Page 2 Since that time, the months of December, 1994; and January, February, March, April, May, June, ' July, August, September and October, 1995 have passed. The court hearing date of November 16, 1995, was established and a full appraisal was ordered by the city attorney's office. In the resulting appraisal, Mr. Swenson's opinion of the current "as is" market value of the 2.3 acres is $198,000 ($86,000 /acre). It appears the passing of time has crippled the city's ability to acquire this property. This past September, I again took the time to walk the property. This visit reassured the city's position —Ahis land and the experience it affords is worthy of preservation. Unfortunately at $86,000 /acre the price is too high. Recommendation , It is the recommendation of this office that the condemnation proceedings on Outlot F, Creekside Addition be terminated. The following excerpt taken from the motion made that evening pertains to park and trail acquisition and development,(the entire motion is attached for your reference): y 9. Park and Recreation conditions as a. The land bounded by Bluff Creek on;the east, the railroad on the south, the extension of Stone Creek Drive and Outlot B on the west, and the arm of'Bluff Creek on the north be shown as parkland. The alignment of the 8�fo6 bituminous trail be amended to reflect the direction given the applicant by staff, specifically that the trail shall depart the creek corridor, enter the parkland and meet the road extension at the southern wetland prior to its connection with the railroad underpass. Said trail to be constructed with the first phase of improvements completed by the applicant with a lump sum cost for the trail being reimbursed by the city. Note: The applicant shall supply the Mr. Don Ashworth February 7, 1995 Page 2 city with three quotes for the construction of said trail with the final alignment being staked for approval by the City's Park and Recreation and Engineering Departments prior to construction. Item 9a requires that an area of land (2.62± acres) on the southern end of the plat be acquired for park. Said property to be purchased through a combination of park dedication, fee credit and cash. If a resolution cannot_ be reached on this item to proceed with condemnation. This office has extended a proposed purchase price to Heritage Development of $30,000 per acre. Heritage Development has rejected this offer and has not proposed a reasonable counter offer. The City Attorney's office has now informed me that counsel for Heritage Development would like to move this process forward. RECOMMENDATION Staff has exhausted its resources in an attempt to draft a development agreement which includes the acquisition of the subject park area and trail corridor through conventional means. Therefore, this office recommends that the resolution authorizing condemnation of property interests for park purposes from Heritage Development Company be approved as drafted. ATTACHMENTS 1. I have drafted this Resolution as best I can to identify the parcels to be acquired. I do not have a legal description of the property nor of the Creekside Subdivison and so the description of the property to be acquired in this Resolution is the best I can do for the time being. The description will suffice for resolution purposes but will not be sufficient in the event I start condemnation. In that event, a specific legal description (probably metes and bounds) will be necessary. I checked with Bob Generous before drafting this Resolution and understand that the property to be acquired for park land purposes has not yet been identified as any specific outlot. It is possible that approval of the preliminary plat would give us an outlot description to use. Please have this Resolution placed on the next City Council agenda. I am getting phone calls from the attorneys' representing Heritage Development and understand that there is some interest in seeing this matter proceed as quickly as possible. People have a habit of calling us on Friday you know because the meetings coming up Monday night and unfortunately if we're out of town, there's nothing we can do about it. Councilwoman Dockendorf: And the problem is, yeah. We get our Council packets Thursday evening. We start reading them, I start reading them on my lunch hour on Friday and you spend ... it becomes, yeah. I mean you saw what our agenda was like. Separate it and we're going to go to condemnation because it ' was real obvious we weren't even in the same ballpark. Is there something different that we're dealing with now? Todd Hoffman: No, there is not. We're going forward with the condemnation process... Councilman Senn: Is there something different in your mind? John Dobbs: My name is John Dobbs, Heritage Development. I'll make this really fast. I guess for me still the question I've got is just the clarify in the terms of the resolution and ... It was our understanding... Councilman Senn: What I tried to do in my motion, and if anybody looks at it a different way, please let me know but what I tried to do with the motion was just purely separate the issue which was here. You know, plat your project. Now I think... John Dobbs: ...our thoughts, after talking about it, we'd like to have that really stated... His assumption out of his rough estimate was that we did not now have, after we took this area of the condemnation, we did not now have enough land to satisfy our requirements for a subdivision of 44 lots, which is... That has since been clarified. That's where I think the ... number popped out in Roger's letter. I'm sorry, my brain has left me. ...this forward and doing this plat and I'm just trying to get some clarification as to what it actually does. What it's supposed to be before I get to final plat. Councilman Senn: Do you have that? Roger Knutson: I'm not sure I do, I'm sorry. I want to be very clear, because I don't know why this is an issue but it appears to be. The only thing you authorize tonight is the condemnation resolution which says you can condemn this property of 2.35 acres. That's the official act tonight. Clarification wise, we're taking the 30 feet corridor unless we're not entitled to take much and you have to narrow it down a little bit for park dedication. Councilman Senn: Correct. That's my understanding. Mayor Chmiel: Everybody's in the same ballpark? Is there a motion?
