WHEREAS the State is authorized to administer the State Aid Administrative Account pursuant to MN Statute 162.06, Subd. 2; WHEREAS the Division of State Aid requires all personnel working on State Aid work be certified; WHEREAS the certification of technicians will ensure consistent inspection hereinafter set forth, the parties to this Agreement mutually agree as follows: I. Term of Agreement This agreement shall be effective upon such date as it is executed as to encumbrance by the Commissioner of Finance, and shall remain in effect until all obligations set forth in this agreement have been satisfactorily fulfilled or December 31, 1995, whichever occurs first, by which time all requests for reimbursement must be received in the State Aid Office. IL Conditions of Agreement All personnel working on State Aid work, including, but not limited to, construction inspectors, and field testers, must be certified through the Technical Certification Program on all work beginning on or after January 1, 1994. M. Reimbursement by MN /DOT MN /DOT agrees to reimburse the Recipient an amount not to exceed $5,000.00 total tuition costs incurred for personnel working on State Aid work for the successful completion of classes taken between November 1, 1992 and July 31, 1995. Recipient agrees to pay all costs not included in, or which exceed, said amount. A: Recipient must submit a resolution from the County Board/City Council approving the agreement. B: Request for reimbursement must be submitted on Recipient's letterhead indicating each participant's name, title of each course taken, and amount to be reimbursed for each course. Termination of this Agreement MN /DOT may withhold payment or terminate this Agreement at any time if the Recipient does not comply with the provisions of this Agreement. General Provisions The Recipient agrees to indemnify and save and hold the State, its agents and employees harmless from any and all claims or causes of action arising from the performance of this agreement by Recipient's participants or employees. This clause shall not be construed to bar any legal remedies Recipient or its participants have for the State's failure to fulfill it's obligation pursuant to this agreement. Any amendments to his agreement shall be in writing and shall be approved by MN /DOT and the Recipient. To begin with, we want to thank the City staff for all their effort regarding the proposed development. We particularly appreciate the finding in the staff report that states "the proposed development is consistent with the City's Highway 5 Corridor design requirements, the Comprehensive Plan, the Zoning Ordinance, and the site plan review requirements. The site design is compatible with the surrounding development. It is functional and harmonious with the approved development for this area." ' With this in mind we do offer the following comments. 1) Signage: It is our understanding that given criteria number 2a on page 14 of the staff report that the intent is to allow one monument sign per lot. 2) Landscaping: As we previously discussed CSM Corporation is not committing to a double row of coniferous plantings on the south side of the project, but that other measures will be used to screen dock areas from properties located south. Also per our conversation, a massing of coniferous shrubs will be used to screen the subject property on the east side. 3) Traffic Report: As you know, all of the traffic related issues discussed on pages 8 and 9 of the staff report have been already addressed in correspondence dated November 9, 1995 from ' Strgar Roscoe Fausch and in correspondence dated November 21, 1995 to David Hempel from RLK Associates. 4) DataSery Drainage and Utility Easement: This easement will be redirected as part of the final plat and as part of the stormwater system and pond design currently being prepared by DataSery Corporation. We assume this may occur administratively and will not require City ' Council action. Gt_- S e Sc e City of Chanhassen ' Page 2 5) Stormwater Pond (Water Quality and Quantity): We wish to specify that the stormwater ' facilities and pond are for the entire subwatershed basin associated with the DataSery property, and that related stormwater fees and credits should be identified prior to the ' preparation of construction plans. 6) Outlot A Property Line: The easterly property line of Outlot A will be adjusted 5 feet to the ' west as part of the final plat. This is in response to Condition Number 21 of the aforementioned staff report. 7) Dell Road Upgrade and Financing: Condition Number 10 on page 16 of the staff report states ' that the applicant will upgrade and extend Dell Road south of Lake Drive east to the south City limits as well as install a storm drainage system to Lake Drive east to the regional pond site. No provision as part of Condition Number 10 is made relative to the financing of these improvements and how CSM will be reimbursed for this work. On page 8 of the staff report it is inferred that Tax Increment Financing may be used for the upgrade of Dell Road. We believe that the matter of financing the upgrade of Dell Road and related improvements need to be addressed at the November 27th City Council Meeting. We ask that the City Council either commit to using Tax Increment monies for the purpose of upgrading Dell Road, and/or the City. ' Council direct staff to resolve this matter as part of the Developers Agreement. This should not be interpreted as CSM being reluctant to upgrade Dell Road rather, the matter of financing needs to be addressed commensurate with CSM Corporation's commitment to complete the Dell Road ' related improvements. Again we appreciate the staffs diligent work on addressing many of the issues concerning the above referenced development.
