For the purpose of correcting the error and straightening out title on that 1 property, I have drafted a Resolution to correct the error in the legal description. That Resolution is enclosed herewith and I recommend that it be placed on the agenda for the Council's consideration. 1 Obviously, since the enclosed Resolution simply corrects an error, I recommend 1 the Council approve the Resolution. In the event the Council does approve the Resolution, please send a certified 1 copy of the approved Resolution to me and I will record it with the County Recorder's Office. If you have any questions, please feel free to call me. 1 Very truly yours, CAMPBEL UTSON, SCOTT 1 & FUCHS, A. 1 By. ja G 'Fu s GGF:cjh t cc: Mr. Don Ashworth Suite 317 • Eagandale Office Center • 1380 Corporate Center Curve • Eagan, MN 55121 1 CITY OF CHANHASSEN ' CARVER AND HENNEPIN COUNTIES, MINNESOTA Date Resolution Motion By Seconded By A RESOLUTION CORRECTING THE LEGAL DESCRIPTION OF DRAINAGE ' AND UTILITY EASEMENTS PREVIOUSLY VACATED ON LOT 1, BLOCK 2, WEST VILLAGE HEIGHTS 2ND ADDITION, CARVER COUNTY, MINNESOTA WHEREAS, pursuant to Resolution No. 94 -84 passed and adopted on August 22, 1994 the Chanhassen City Council vacated certain drainage and utility easements over portions of Lots 1, 2, 3 and 4, Block 1 and Lot 1, Block 2, West Village Heights 2nd Addition; and WHEREAS, it has come to the attention of the City Council that there was an error in the legal description of the drainage and utility easement intended to be vacated ' onLot 1, Block 2, West Village Heights 2nd Addition; and WHEREAS, it is in the public interest to accurately describe the vacated easement ' and to correct the error in the legal description of the vacated easement as it appeared in Resolution 94 -84. NOW THEREFORE BE IT RESOLVED that the City uncil of the City of ' �' t3' Chanhassen approves the vacation of that portion of the drainage and utility easement on , Lot 1, Block 2, West Village Heights 2nd Addition legally described as follows: All that part of the 10 -foot wide drainage and utility easement which lies northerly ' of a line running parallel with at a distance 10 feet southerly from the following described line: commencing at the northwest corner of Lot 1, Block 2, West Village Heights 2nd Addition; thence south 87 degrees 41 minutes 43 seconds east ' a distance of 217.89 feet; thence on a tangential curve concave to the southwest with a radius of 330.00 feet and an arc of 41 degrees 30 minutes 00 seconds and length of 239.02 feet; thence continuing on a tangent line south 46 degrees 11 ' minutes 43 seconds east a distance of 201.17 feet and there terminating.
