December 11.
To date, I have managed to avoid conflicts between my course work and evening meeting

' I received a copy of your letter to Mr. Ashworth dated November 19, 1995. Mr. Ashworth
forwarded a copy to me because of your comments and concerns regarding the city operated
compost site. In addition to providing daily services to residents on planning issues, I also
' oversee operation of the compost site. My reason for writing this letter is to respond to your
concerns and inform you of proposed changes to the compost site.
I made the decision to close the compost site in the middle of November. Historically, we
receive heavy usage towards the end of October and the first part of November. A review of past
records shows that usage drops off drastically after November 1. During the first two Saturdays
' in November, we had a total of 22 people use the site. Fourteen people used the site the first
weekend and eight the second. Considering past trends and the low turnouts during the first two
weekends in November, I decided it was time to close the site for the season. Closing the city
' operated compost site does not leave residents without a method of disposing of yard waste.
Local haulers will dispose of yard waste, or other privately run compost sites are available in the
' metro area.
In your letter you also expressed a concern over having to pay user fees. The city currently
' subsidizes approximately 60% of the cost to compost yard waste. Currently, we do not have the
appropriate equipment or available land area needed to process on site. Therefore, the materials
must be hauled off -site to a recycling facility. This is done each week over the 29 weekends that
' the site is open. Our records indicate that on average approximately 30 people use the site per
week. With approximately 5,000 households in Chanhassen, only 0.6% of households are using
this service on a weekly basis. In my opinion, a service which is used by less than one percent of
' the households on a weekly basis should be required to offset some of the cost through user fees.
Fees are also necessary to offset the cost associated with paying the Site Attendant. Over the
' years we have found it necessary to have an attendant on hand to insure that only organic

materials are disposed of, as well as assist customers in dropping off their yard waste. Each year
we have to pay to dispose of illegal junk and garbage which is dumped at the site. This year
alone I had to replace the gate three times because people broke it down to dump unauthorized
materials.
I would like to address one final comment you made regarding city staff. Included in my duties
of overseeing the compost site is the hiring of an attendant. Because of low pay and short hours,
it was very difficult to find an employee to work at the site. After advertising in the paper,
calling the local high schools and posting notices, we found an employee. Before this happened,
I worked at the compost site during three Saturdays in May to ensure that the site was available
to residents in the spring of the year when it receives the most use. I also assisted on various
Saturdays throughout the summer. This is why it was disheartening to read your comment about
city staff working at their convenience. In my short time with the city, I have witnessed
numerous occasions where city employees have spent personal time serving the residents of
Chanhassen.
In this time of fiscal conservatism we are trying to offer expanded services for less money. We
recognize that yard waste is becoming more difficult and expensive to dispose of properly. The
Planning Department has requested additional funds for 1996 to increase compost site services.
We are looking into opening the site on Wednesday evenings to make the site accessible to those
who can not make it on Saturday. In addition, we are looking to relocate the site to provide
expanded services and products by processing on site. This was recently discussed at the
November 13, 1995, City Council meeting.
We appreciate your efforts in reducing and disposing of yard waste properly. Hopefully, our
efforts to expand the compost site services in the coming years will make the site more
convenient and accessible to residents of the city. Thank you for taking the time to notify us of
your concerns regarding the compost site.

Dear Mr. Ashworth:
Thank you for personally opening the compost site yesterday so I could dispose of my yard waste.
My check in the amount of $10.00 is enclosed for the fee as posted. I have disposed of fall yard
waste at the site for the last several years and believe it is an appropriate facility for the citizens of
Chanhassen. By the way, I only dispose of grass clippings in the fall when I reduce the height of
my lawn. The remainder of the year I use the compost feature of my mower or use the clippings
as garden mulch.
In planning to go to the site I relied on the information on the sign and in the fall newsletter to
residents. Both gave reason to expect that the site would be open throughout the fall. I do not
expect that it would be open only when fees are certain to cover the wage of the person attending
the site. I think a small amount of net wages from our taxes is reasonable to provide the facility.
If the facility were open 12 weeks and weekly received on average only the $10 I paid, the net
tax funded cost should only be about $300.00. As residents, we expect that not all city services
are funded by fees on the user. I believe the site is considered an environmental benefit,
something this city places a great deal of emphasis on.
The site being closed yesterday was a small element of what many people I talk to in the City feel
is a lack of attention to and performance of basic services. Hours of operation appear to be set
for the benefit of staff, not the residents who are to be served. I called the Public Works number
before I called you yesterday. Hours of operation were stated to be 7:30 to 3:30. Unless these
people go without a lunch break, their work day is no more than 7.5 hours. So many things seem
to be geared toward the needs of "THE CITY ", but what is the city other than the residents?
Cities exist to serve residents. We do not create taxing entities and bureaucracies because we lack
things to do. Senior housing, downtown development, investing in bonds, etceteras are fine. But
it is not the basic services the city should be very good at all the time.

I am one who would like to see a reduction in refuse collection trucks on our streets, but not if
the city staff is in any way involved in managing it. There is not a general feeling among many
people that the managers of this city are up to the job.
I won't go on with the many items that tend to be discussed in our neighbor and others in which it
is the general sense of a need to get back to basics. Please accept that it is very real. On last
thing. Regarding the bond problem. A simple "OOP's, we goofed, we're sorry, we'll work hard to
fix it" would have gone over much better. Mistakes are made, however defending it was
considered another mistake. Losing interest is losing money, it counts as much as the principal.
The City of Chanhassen has so much potential. Much of it has yet to be realized. I intend to stay
here and see it be realized.

On November 13, 1995, the Chanhassen City Council approved the Stipulation
of Settlement, a copy of which is enclosed for your file.
I am also enclosing a Stipulation of Dismissal with Prejudice and Order which I
request that you sign and return to our office. I will file the Stipulation of Settlement
and Order and the Stipulation of Dismissal with the Court.
The amount to be paid pursuant to paragraph 2 of the Stipulation including
accumulated interest to November 17, 1995 at the judgment rate is $18,038.80.
Please forward a check to our office for this amount.
The Stipulation provides that Beddor would obtain a title commitment
establishing marketable title to the street right -of -way property and give us a Warranty
Deed within 60 days. To expedite matters, I have gone ahead and ordered the title
binder and will forward it to you along with the invoice for payment.
Finally, I am enclosing a copy of Beddor's Letter of Credit for the $10,000
deposit for the Nez Perce extension required by the Troendle Addition. It expires
December 31, 1995 and has been renewed on an annual basis. Please provide us with

today released details of five potential toll road projects that have been submitted by '
private developers for further consideration under the agency's "TRANSMART" toll ,
financing initiative. Identification of the proposed toil projects launches the second phase

Toll financing is seen as a viable option in funding major transportation capital
projects throughout the state that likely could not be funded with existing state
transportation revenue streams. Toll financing also offers greater financial flexibility and
' the opportunity to establish and expand public - private partnerships for the purpose of
providing government service.
' "We know today's announcement will create a great deal of discussion about the
merit of tolls and their applicability in Minnesota," said Adeel Lari, director of Mn/DOT's
' Office of Alternative Transportation Financing. "We encourage communities to view tolls
objectively and think about the options and benefits toll financing can provide."
' The state Legislature has strongly encouraged the consideration of tolls through

from Cologne to Wallace Road in Eden Prairie, and a freeway section from Wallace Road

Enclosed herewith a copy of the above proposal which was submitted to MNDOT
on November 22, 1995. After you have had an opportunity to review this information
let me know what questions you may have. On December 14, 1995 at Eden Prairie
City Hall, beginning at 7:30 a.m. , Interwest will be present to describe and discuss
its proposal to build New T.H.212 as a tollway. Interwest representatives are
scheduled to be present until 10:00 a.m. in order to provide ample time for a
thorough discussion. I hope you will be able to attend.
At the November 17, 1995 meeting of the Southwest Corridor Transportation
Coalition, the Coalition membership adopted the enclosed resolution to express its
general support for the proposal. However, the resolution provided that neither the
Coalition nor its members would be precluded from commenting upon the specific
details of the proposal.
Enclosed is a list of the Board of Directors of 212 Community Highway
Association, proposed owner of the New 212 Tollway. You will notice that Don
Chmiel, Al Klingelhutz, Jim Curry, Brad Johnson, Marcy Waritz and Frank Sherwood
are members of the Board. Kennedy & Graven is counsel to the Association.
I hope you are able to attend the meeting on December 14, 1995 and that you
or your staff are able to review the proposal in detail so that any issues raised by
the proposal may be resolved as early as possible.

' Thank you for your letter regarding sidewalks and trails in the City of Chanhassen. Here are the answers
to your questions:
1. The City of Chanhassen does not have an ordinance requiring residents to shovel the sidewalk in
' front of their house. Sidewalks were relatively few until recent times in Chanhassen. I suspect
the current or previous city councils have not seen or heard the need for such an ordinance.
' As director of the Parks and Recreation Department, I favor the implementation of a snow
clearing ordinance. I will discuss this with our Mayor and city council. I encourage you to call
them and express your opinion. I have attached a phone list for the Mayor and city council.
2. In regards to the water seepage onto the Kerber Boulevard Trail, I will inspect this site this
afternoon to determine if a problem currently exists. I will continue to monitor this site
' throughout the winter. If a problem is encountered in the winter season, the trail will be
sanded /salted as is deemed appropriate. When spring arrives, the Park and Recreation
Department will carry out permanent corrective measures.

This note is to formally respond to your request for an outline of what the Public Safety Commission
intends to be looking at as they look toward the future. Because of my not getting the memo to Karen to be
included in the Commission packet, I acknowledge that you were at a disadvantage in not knowing ahead of
time what Commissioner Bill Bemhjelm was going to comment on.
In a nutshell, the Commission plans to spend every other month taking a look at the different divisions
under the Public Safety Department umbrella. Therefore, one month would be looking at the crime
prevention program, one month looking at the fire inspection/education components, the law enforcement
contract with the County, the Community Service Officer program, building inspections, etc.
I will see to it that agendas are sent out, as they usually are, so that any of the Council members who would
like to attend could. If you have any questions, please feel free to contact me.
