It is my pleasure to forward the attached letter to you from Mr. Wagner. What I find most
noteworthy about receiving this letter, along with the generous donation, is that if anyone should
be in a legitimate position to complain about governmental red tape, it's Mr. Wagner. Instead,
he has continued to stand out as a resident who understands government, and works with it.
I say that he is in a legitimate position to complain, because a number of his contacts with us
have been over issues that did not, at least initially, easily result in what he had hoped for. In
each of these situations that I have been involved with in dealing with Mr. Wagner, there have
been legitimate issues that brought the City into the picture. Every single time Mr. Wagner
responded to our requests, worked with us, and obviously, felt satisfied with the results.
It is easy for anyone to become frustrated with government because of the occasional problem.
We know that the vast majority of people we deal with are happy with the results of their
interaction with the City., Unfortunately, we are far more likely to hear from the individuals that
have had a negative experience than those, like Mr. Wagner, who have been pleased with the
results. I did speak with Mr. Wagner about how he would like the donation spent, and he felt
that using it for crime prevention material would be a very positive use.

Dear Scott,
This 'Letter is to c onfirm to you and the other employees of the
City of Chanhassen the feelings of appreciation and cooperation
that my family has received from city staff over the years.
A little history is in order here and I would like to name some of
the ones such as yourself that I can remember and apologize for
those whose names may have escaped me.
Earliest on my list would have to be Joanne Olson who helped me to
build a house for my family on part of my Great Grandfather's farm.
Joanne helped us turn a unusable lot into a home clearing the way
to city approval. Once we were established in our residence, we
found ourselves before our city council on a matter of property
taxation. Again, common sense prevailed by a council that listens
to it's citizens.
Some years later I found myself discussing with you matters dealing
with federal regulations. You went out of your way at that time
' and many others to follow.
Most recently my mother had passed away. Karen Engelhardt helped
me to utilize one of my families plots in the Pioneer Cemetery. As
anyone who has been through having to make these arrangements
knows, this process is filled with grief but must be addressed
quickly. Karen showed true concern and even gave me her home
number for last minute concerns I had. During my mothers
unexpected passing, we had been planing a deck having waited seven
years to afford this luxury. While making funeral arrangements,
our contractor began with neither he nor I having filed a permit.
Here the building inspection department rightfully intervened. My
wife and I expected to be treated rudely for our error. To our
surprise Steven Torell and Doug Hoese showed us genuine concern for
our design arid helped us work out our errors in a most timely
manner. If the city staff has an unspoken motto it must surely be
"The Citizens Are Kings ". Other cities could learn from your
vision.
To back up our feelings of thanks with more then words, please

The Postal Service has been evicted from the present postal facility located on Second
Street, Excelsior, MN. Since we are experiencing severe space deficiencies at
Chanhassen, Chaska and Victoria, we are looking at combining all carrier operations
into one facility. Each city would retain their present main post office for all the services
they are presently receiving. Excelsior would be provided a replacement facility as close
as possible to the downtown area. This plan would allow the Postal Service to improve
working conditions for our employees.
We have determined that the new building should contain, ideally, approximately,
23,000 square feet of net interior space on a site of between 180,000 and 200,000
square feet. Also, we propose that the new facility be located within the following
preferred area:

I am compelled to formally commend Kate for the way she handled an issue with a resident
and the National Weather Service. I have seldom seen anyone go to such lengths to assist
parties in conflict try to reach an accord.
Briefly, the facts are that an antenna was erected some 70 feet from where Kate had
originally approved. Due to no fault of Kate's, the drawing showing the new location was
not forwarded to her. When a resident inquired of the City what additional towers would be
erected on the National Weather Service site, Kate personally worked with this person to
show what the future held. The person then purchased the lot based on, at least to some
degree what Kate had told her. When the new antenna went up in a different location than
the resident expected, this resident became extremely angry taking it out on Kate. Kate then
tried to work with the Weather Service, who took out their frustration on her as well.
Kate spent an extraordinary amount of time mediating the situation. Frankly, during the
process, she took considerable undo criticism from both parties (the resident and the Weather
Service.) I know that this made her feel very badly.
We all find ourselves in frustrating positions with people that may not understand the efforts
made to try to serve their best interest. In this case, I imagine that neither side felt
vindicated, but not because of a lack of effort, or concern, on Kate's part. She really did a
nice job on this.

Dear Mr. Dimler:
This letter is in follow up to our phone conversation on July 19, 1995 concerning the location
of your two "Corn Huts" in the City of Chanhassen. As I indicated on the phone, the Corn
Hut located in front of Lotus Lawn and Garden must removed by Sunday, July 23, 1995. This
property is located in a BH - Business Highway zoning district which does not allow produce
sales or any other type of temporary sales.
Concerning the other Corn Hut located downtown, I had indicated that the present location
next to the Century Bank building presented potential public safety concerns because of the
lack of parking and turn around area, which would force people to either park or back onto
West 78th Street. Accordingly, I asked you to either find a new location or make site
improvements to the existing location. I offered the suggestion of locating next to
Chanhassen Bowl off of Market Blvd.
Since you have operated your Corn Hut for a number of years in the downtown area, staff
will allow you to continue to operate this year, provided that you locate on a suitable site.
You relocated your Corn Hut this year because your past site is being developed, therefore,
you have technically lost your non - conforming rights to operate without bringing your
operation into compliance with applicable ordinances. However, there seemed to have been a
misunderstanding between you and the city staff concerning this matter. Accordingly, staff
will continue to let you operate this year. If you wish to continue to operate in future years,
you will be required to comply with all applicable city ordinances.
The Chamber of Commerce has brought forward a proposal to amend the City Ordinance to
allow for temporary outdoor sales. A public hearing has been scheduled for the Planning
Commission on August 16, 1995. Your comments and participation would be greatly
appreciated.
I hope you can understand the City's position regarding this matter. We continually receive
requests from local businesses and other vendors to have outdoor sales or displays. The city

staff and Council have both consistently denied these requests. In an attempt to be fair and
' equitable, we believe that we must be consistent when enforcing city ordinances. We are
hopeful that we can reach some sort of agreement on the proposed temporary outdoor sales
ordinance which would benefit all parties involved.

On Monday, July 10, I was contacted by Jon Rabie from Minnetonka Community Services.
He informed me that picnickers have contacted him with complaints of stolen food at Lake
Ann Park. Apparently while coolers have been left unattended, thieves have stolen the food
and left the empty cooler behind. Jon believes that the teens that we have had problems with
in the past are responsible. I just wanted to bring this to your attention.

Re: Proposed Traffic Signal Installation at the Intersection of Trunk Highway 41 and West

Dear Bill:
' I recently Pp had the opportunity to review a letter you sent to City Manager Don Ashworth
regarding the proposal for cost sharing a traffic signal at Trunk Highway 41 and West 82nd
Street.
I can certainly empathize with the traffic issues that you are experiencing due to the growth and
' development in and around the area. The City of Chanhassen is facing similar traffic safety and
service level concerns at its unsignalized intersections along Trunk Highway 5. Unfortunately
for Chanhassen, MnDOT's previous proposal to upgrade Trunk Highway 5 from County Road
' 17 (Powers Boulevard) to Trunk Highway 41 has been delayed from fall of 1994 to post -year
2000. However, each year the traffic volumes on Trunk Highway 5 continue to grow and traffic
volumes on the minor legs of these intersections continue to increase with the residential and
commercial development in the community.
One of our worst intersections on Trunk Highway 5 is Galpin Boulevard (County Road 19).
Over the past two years, the City and Carver County have worked persistently with MnDOT to
have this intersection signalized particularly since the new elementary school located in the
southeast quadrant of the intersection will be opening this fall. I am pleased to be able to say
that a joint cooperative effort among the State, County and City have resulted in the in- progress
construction of this signal improvement this summer.
' The next priority intersection for signalization in the City of Chanhassen is Audubon Road at
Trunk Highway 5 along with the elimination of the direct access from Lake Ann Park to Trunk
' Highway 5. This intersection is experiencing poor service levels during both the peak and many

off -peak hours of the day and is a site of weekly accidents. The City is constantly receiving
complaints from residents and businesses within the community concerning the problems and
safety at this intersection. Similar to your West 82nd Street intersection, funding for this
improvement is a major obstacle to overcome.
At this time City staff is continuing to work on options to make this signal improvement at
Audubon Road a reality. Given the high priority of this intersection, I think it would be very
difficult for both staff and the City Council to divert time and financial efforts to signalize
another intersection in the city until this project has been undertaken.
In your letter you referenced the undeveloped Gateway West property (zoned office /industrial)
in Chanhassen and it's potential future impact at the West 82nd Street intersection. One option
that could be explored further is for Chanhassen to be able to establish an "impact fee" at the
time of development of this property which would provide some dollars to assist in funding a
traffic signal at this intersection. I would anticipate that this future impact fee would be derived
based on the ratio of Gateway West properties contributing traffic volume to this intersection as
compared to the overall traffic volume at the intersection. Should a tax increment district be
created over the Gateway property some additional dollars from Chanhassen could be pledged
for this improvement. However, the actual development of this property is not known and is the
controlling factor.
In conclusion, there may arise some opportunity in the future to financially assist with the signal
improvement at the Trunk Highway 41 and West 82nd Street intersection; however, at this time
it is important for Chanhassen to maintain and complete its current commitments on capital
improvements. If I can be of support in any of your upcoming meetings with MnDOT pertaining
to this intersection, please feel free to let me know.

Dear Resident:
We would like to update you on the status of the above - referenced project as it affects you
' and your neighborhood.
' PHASE 1
Phase 1 of the project includes installation of a trunk watermain from Lake Susan Drive
along T.H. 101 to 86th Street, easterly on 86th Street and then southerly to Lyman
Boulevard. The existing watermain on Tigua Lane will be energized as part of this phase.
' PHASE 1 CONSTRUCTION
Construction for this portion of the project is complete to approximately 800 feet south of
86th Street. Final restoration will be done along Trunk Highway 101 in the next week to
10 days. The watermain along Tigua Lane will be turned on in the next couple of weeks.
The remaining portion of the watermain on this phase, between the proposed Trunk
Highway 212 corridor and Lyman Boulevard, has been delayed until a suitable alignment
' is reached with the property owner.
PHASE 2
' Phase 2 of the project includes installation of trunk sanitary sewer and watermain along
Trunk Highway 101 from the vicinity of Great Plains Boulevard to Lyman Boulevard. This
phase includes the reconstruction of Lyman Boulevard from Trunk Highway 101 to the
' eastern city limits. The reconstruction of Lyman Boulevard will include the installation of
sanitary sewer, watermain, and storm sewer utilities. A bituminous trail and street lighting
is also proposed along Lyman Boulevard. Part of this project will include the installation
I of watermain along Lake Riley Boulevard south of Lyman Boulevard.
PHASE 2 SCHEDULE
' The design of the improvements proposed in this phase is nearly complete. The City is
currently in the process of acquiring easements from the necessary properties adjacent to
the project. These easements provide the City with the space required to construct the
' improvements. We anticipate submitting the plans to the City of Chanhassen for approval
in August or early September. Upon approval, the plans will be submitted to the Minnesota
Department of Transportation for its approval and to other regulatory agencies to obtain

the necessary permits. We anticipate the approval and permitting process to take four to
six weeks. It is the intent of the City to open bids from potential contractors in early
October with an award of a construction contract sometime in October. This is the schedule
we are on at this time. There are a number of project issues to resolve that may affect this
schedule.
There is a possibility that we will be doing some soil correction work prior to the schedule
outlined above. The areas of concern are in the northwest corner of the Lyman Boulevard
and Lake Riley Boulevard intersection and an area on the south side of Lyman Boulevard
across from the existing ponding area. The work required in these areas involves
surcharging the existing soils in an effort to consolidate them to minimize future settlement.
In simpler terms, we will pile four to six feet of soil in the areas of concern to speed up the
settlement. The soils engineers feel that if this is done for about one year, the long term
settlements in the area will be minimized.

This letter serves as a formal response to your letter of June 8, 1995,
' which appealed the Metropolitan Council Environmental Services (MCES)
decision to close the temporary septage disposal site in Chanhassen.
Based on information provided,, in your letter and my knowledge of the
wester: Metropolitan Area, I understand the special traffic issues
involved in transporting waste to neighboring disposal sites in Shakopee
and Minnetonka. In addition, my staff informed me that round trip
' travel times from Chanhassen to the Blue Lake Treatment Plant alone are
in excess of 60 minutes. It is because of such reasons that MCES staff
are continuing efforts to locate a permanent site in the Chanhassen
' area. However, the fact remains that the temporary disposal site which
you have been utilizing resides on private property, for which no
easement rights or permission for this use have been obtained.
Furthermore, because permission has not been obtained, the City of
Chanhassen refuses to approve use of the temporary site. Therefore, I
cannot arant the continued extension that you requested and must deny,
' your appeal.
I can assure you that closure of the temporary disposal site in
Chanhassen will not impair the efforts of MCES staff to secure a
' permanent site within the community. The MCES understands the need for
a disposal site within this area and is committed to working with the
City Planning staff to develop a permanent site. I understand from my
' staff that oral approval has been received from City staff to proceed
with more formal design plans for a site on Park Place near Park Road.
MCES engineering personnel are now working to develop these design
plans. Please be aware, however, that this process takes time and that
' design plans will need to be approved by the City's Planning Commission
and City Council before any construction can begin.
' The MCES appreciates your understanding and cooperation in this matter.

SUBJ: Kerri Nolden, Community Service Officer
We want to commend Officer Kerri Nolden for her conscientious and professional attitude. On
Monday, June 26, we received a series of animal control calls, including one concerning a
severed deer head, one concerning a seriously injured dog, and one concerning an unfriendly dog
at large. All three of these calls came in within minutes of each other. Kerri had to deal with
all three at the same time. When I, Elizabeth, relayed the calls to Kerri she took each one
without complaining and stated what she intended to do regarding each one. This professional
manner of handling complaints we have found to be typical of Kerri. We know we can depend
on her. She also willingly helps out at the reception area answering phones, scheduling
inspections, and taking care of customers at the front desk when it is necessary. We continue
to be impressed with her confident and caring attitude toward whatever task she is asked to do.

REF: BICYCLE SAFETY CITATION

The parents of one of the bicyclists I had issued a safety
citation to stopped me to comment on the program. The whole
family had just come from McDonalds where their son used his
citation. The parents were very impressed with the program
and had expressed that to the manager at McDonalds. They also
wanted me to know that because of the program their older son
was going to continue to wear his helmet. Also several of the
neighbor children were asking their parents to buy them helmets.
The parents also wanted to thank the person that had started the
program in Chanhassen. They were advised that Beth Hoiseth would
be made aware of how much they appreciated the program.
