The applicant, Mr. Greg Reed, is proposing to final plat the Second Addition of the Church Road subdivision. FINAL PLAT UTILITIES The City is in the final stages of adopting the Surface Water Management Plan (SWMP). One of the conditions of approval for the preliminary plat was for the applicant to provide a cash contribution into the City's SWMP fund in lieu of constructing on -site retention ponds. The SWMP proposes a water quantity pond along the southerly portion of Lot 3, Block 1, adjacent to Trunk Highway 7. However, staff feels at this time it would be better to collect a cash Church Road Second Addition March 23, 1994 Page 2 dedication and work with MnDOT in the future to create the storm water quantity pond when ' Trunk Highway 7 undergoes upgrading in 1996. In order to provide sufficient room for the pond, staff recommends the applicant dedicate a drainage and utility easement over the south 20 feet of Lot 3, Block 1 and relocate the berm and any landscaping outside the easement area. Based on the SWMP, staff has calculated the applicant's share of cash contribution for water quality and quantity purposes less the dedication of land (easement) for the retention pond at ' $5,461.00. Detailed construction plans and specifications have been submitted and reviewed by staff. The site will be served by extending utilities from Church Road east along the north property line of Lot 1, Block 1, Church Road Addition. Since this work will be outside the plat, the applicant will need to obtain the necessary drainage and utility easement from the property owner. Staff ' is aware that the easement has been prepared and signed by the property owner and is awaiting the mortgage company's consent. CONDI TIONS OF PRELIMINARY PLAT APPROVAL Following is a list of the conditions of the preliminary plat. The conditions have been modified as shown. 1. Compliance with the flag lot standards in the RSF district. 2. The applicant shall enter into a development contract with the City and provide the City with the necessary financial security to guarantee proper installation of the public improvements in compliance with the conditions of approval for final plat. 3. Park and trail fees shall be paid 1 WA WE the rate then in force, upon building permit application. A trail easement shall be granted along the frontage of Church Road. The applicant shall obtain and comply with the appropriate permitting agencies i.e. MnDOT, Watershed District, MPCA, Health Department, MWCC. 5. The developer shall construct the public utility improvements. The individual house services outside of the easement shall be privately owned and maintained by the property owner. ' This condition has been modified. ' 6. The construction plans and specifications for the public improvements shall be in accordance with the City's latest edition of Standard Specifications and Detail Plates. , Detailed construction drawings and specifications shall be submitted for staff review and City Council approval. This condition has been met. 7. In lieu of constructing on -site retention ponds, the applicant shall provide the City Storm ' Water Management Fund with a cash contribution in the amount of te be deter-mined by staff in accordance with the City Storm Water Management Plan. This condition has been modified. 8. The applicant shall name the private driveway and City shall install the appropriate street , signage. The cost of the sign shall be billed back to the developer in accordance with the development contract. ' 9. A cross access or driveway easement including a maintenance agreement shall be drafted for Lots -r, 3 and 4- r /m /I , This condition has been modified. 10. The City will not permit open cutting all the way across Church Road for extension of ' utilities. The applicant will be required to extend the existing water stub across from Meadow Lane on the east boulevard of Church Road along the private into the development. This condition has been met. ' 11. The proposed private driveway shall be built to the City's private driveway ordinance ' standard which is a 20 foot paved surface to a 7 ton design. This condition has been met. 13. Erosion control measures shall be consistent with the City of Chanhassen's Best Management Practice Handbook. ' This condition has been met. 14. All drain tile systems disturbed in conjunction with site improvements shall be reconnected or relocated to maintain the existing drainage through the site. ' RECOMMENDATION Staff recommends the City Council adopt the following motion: ' "The City Council approves the final lat for Church Road Second Addition as shown on the plat P P ' dated February 4, 1994 and subject to the following conditions. 1. Compliance with the flag lot standards in the RSF district. ' 2. The applicant shall enter into a development contract with the City and provide the City with the necessary financial security to guarantee proper installation of the public ' improvements in compliance with the conditions of approval for final plat. 3. Park and trail fees shall be paid to the City pursuant to the Chanhassen City Ordinance and City Council resolutions at the rate then in force, upon building permit application. 4. The applicant shall obtain and comply with the appropriate permitting agencies i.e. MnDOT, Watershed District, MPCA, Health Department, MWCC. 5. The developer shall construct the public utility improvements. Access to Lot 1 shall be via the private driveway access off of West 62nd Street. Lot 3, Block 1 shall have no access onto State Trunk Highway No. 7. 11. All drain tile systems disturbed in conjunction with site improvements shall be reconnected or relocated to maintain the existing drainage through the site. 12. The final plat shall dedicate a drainage and utility easement over the west 10 feet of Lot 1, Block 1 and the south 20 feet of Lot 3, Block 1. 13. The applicant shall provide the City at no cost a 30 -foot wide drainage and utility easement over the property where the utilities are being extended from Church Road through the lot immediately north of Lot 1, Block 1, Church Road Addition."
