SUBJ: Error in Municipal Annexation Process, Cox Property, 6200 Cardinal Drive
Hopefully the attached letter from Shorewood is self - explanatory regarding the oversight which
occurred in the friendly annexation/deannexation process agreed to this past spring by the Cities
of Shorewood and Chanhassen. I should note that the property owners, the Cox's, were
concerned because they had been receiving two tax bills and were fearful that the annexation
would complicate the process. The worst of their fears did in fact become reality in that now
they will get three tax bills, each of which bringing in the question as to which portion of the
property receives homestead credit and which parts of the property are billed at 2% versus 1%.
The County Assessor Orlin Schafer has assured me that if we can correct the original oversight
and thus create one parcel, even though such would be lying in two counties, that there are
means by which one tax bill can be achieved.
Please prepare whatever form of resolutions are needed to correct the oversight. After I submit
them to our council and Shorewood's and obtain respective approvals, I would anticipate that
your office would process these through the Municipal Annexation Board. .

As I believe you are aware the detachment/annexation process recently completed by
Shorewood and Chanhassen did not include a portion of the Cox's property. The result of
which is that their garage is still located in Shorewood. Since one of the objectives of the
process was to simplify the property tax status of the Cox property the detachment should
have included the parcel on which the garage is located.
Would you please ask Roger Knutson to research whether the legal description can simply be

amended to include the subject property, or is it necessary to go through the entire process
again? The Cox's do have a survey of their property from which a new legal description can
be drafted.

participation of the City of Chanhassen as a part of Hennepin
County in the Community Development Block Grant (CDBG) program. '
Based on information obtained from the Census Bureau, the
Department of Housing and Urban Development (HUD) provided '
guidance to the City on the action it needed to take to have the
annexation it completed reflected in the 1990 census data. It is
our understanding that the Census Bureau has received and is
processing the information provided by the City for this purpose. ,
Therefore, at present, it appears that HUD should have the
information it needs from the Census Bureau in time to reflect
the population count for Chanhassen when calculating Hennepin '
County's CDBG allocation for Fiscal Year 1994.

Thanks in large part to the efforts of the Mayor and City Manager, Chanhassen has a Year XX
Block Grant allocation. Now we must face the annual task of allocating the funds. As always,
there are a large number of conditions on utilizing the money. In general, we can only spend
it on projects that serve low /moderate income households, the elderly and the handicapped. As
before, there is a preference for spending money on projects that actually buy something rather
than pay for services. The overall program has a 15% cap on service type expenditures.
Chanhassen has typically exceeded this amount but the overall Hennepin County average has met
the goal and allowed us to do this. Their staff has informed us that this flexibility is unlikely
to continue. Thanks to increased federal funding for the CDBG program, Chanhassen's allocation
has increased to $48,544. The funds will be available for approved projects in July of this year.
A formal public hearing must be held on the proposed allocations. This has been scheduled for
your March 14 meeting. Should you desire to discuss this further, you can continue the item to
your March 21 meeting. However, you must act on the allocation prior to the end of March to
maintain the required schedule. fus
PROPOSED ALLOCATIONS
Chanhassen Senior Center Operations
For the past year, CDBG funds have been used to support the staffing of the Chanhassen Senior
Center. Dawn Lemme has been assigned to the role which occupies 50% of her time. We are

proposing to continue this funding at the Year X1X level since this appears to be adequate to
cover expenses. FUNDING: $17,000
South Shore Senior Center ,
The city has used CDBG funds to support this center for many years based upon the premise that
many of our residents use it. When we opened the Chanhassen Center, the annual allocation was '
halved. Yet it was continued since many residents continue to use their services at least part of
the time.
We have received a funding request for Year XX of $6,000, which represents a $2,000 increase ,
over last year (refer to the attached letter). Staff took this request up with the Chanhassen Senior
Commission. In recent months, they have expressed reservations with the lack of '
communications and support we have received from their parent organization, Senior Community
Services.
Staff advocated continued funding, albeit at a level somewhat lower than is being requested.
Submitted information indicates that a number of our senior residents continue to use that center.
They are a very mobile group and may visit several centers regularly based upon program '
offerings and friendships. We also pointed out that we would have lost our CDBG funding
entirely if it was not for the support of the city of Shorewood. Their support was predicated
upon the fact that Chanhassen has had a history of funding programs that served their community
as well as ours. We believe we owe them a good faith effort to continue this support at whatever
level is deemed appropriate.
The Senior Commission agreed. They proposed a funding level of $5,000 but with several
conditions attached. They wanted South Shore and their parent organization to meet at least four
times a year to discuss coordination and program integration, and they also wanted to see '
improved communications and transportation. Staff is recommending that this funding level be
approved with these conditions and that South Shore be so notified in writing. It was clear that
the Senior Commission expects progress on these conditions during the year. Failure to meet '
these goals will jeopardize funding for the program in the future. FUNDING: $5,000
Sojourn Adult Day Care '
In the past, Chanhassen has funded a number of items for * ; vital service. However, they had
to relocate outside the community and have not requestei runding this year. Staff has held
preliminary discussions with them concerning their starting a new program in Chanhassen in the
future. The new senior housing project is one possible location. Thus, we hope to be able to '
help support them in the future.

' Chanhassen Accessibility Improvements
Chanhassen has recently completed an audit to review improvements to city facilities required
' under the Americans with Disabilities Act (ADA). We are proposing to use the balance of the
funding to undertake priority level one improvements mainly in park areas. These improvements
include such items as providing accessible trails, upgrading play areas and seating areas,
' providing fully accessible parking, providing tactile identification where appropriate and the
upgrading of rest room facilities.
STAFF RECOMMENDATIONS
Staff recommends that the City Council adopt a resolution allocating Year XX CDBG funding

Chanhassen, since opening a senior center in its facility, has continued to provide
some funding for the Southshore Center, but at a lesser level than full share. The
amount requested is not the full amount based on this proportion, but about half-
, way between what the City's share should be and the City's level of support in
CDBG Year XIX.
' For almost ten years now the Southshore Senior Center has served as the service
and information focal point for the area's seniors. Classes, trips, congregate dining,
transportation and information about a very broad range of topics are some of the
activities available through the Center. The partnership of support provided
by the cities has been the cornerstone that enables Senior Community Services to
leverage other funds from the United Way, Title MB (to subsidize the cost of
transportation) and Title IIIC (to subsidize the cost of meals). This arrangement has
served the area well and, with the possibility of new Center construction, can
continue to provide a very cost effective way to provide these much needed
' services in the future. If there is additional information desired please let me

Dear Mr. & Mrs. Cox:
The certification process to insure that Chanhassen would continue to receive Community
Development Block Grant monies took far longer than I originally anticipated. That process did
not conclude until nearly the end of 1993. Additionally, I did not anticipate that the finalization
of your property description as to which parts would be in Shorewood versus Chanhassen would
take as long as it did. It is my understanding that you met with representatives of Shorewood
and that you and they agreed that the original description, as proposed by Shorewood, was in
error and should be modified. Their resolution supporting a modification of your property
description was received in late 1993 and the attorney drafted the new resolutions/application to
the Municipal Annexation Board in January. I would anticipate having the Chanhassen resolution
supporting the modification on the March 28, 1994 City Council agenda.
In the meantime, the worst of all of your fears will occur for taxes payable in 1994 in that you
will be receiving three property tax statements which in all likelihood will be calculated
incorrectly as it deals with the 1 %/2% tax rate issue.
I have met with the Carver County Assessor to review the dilemma we have placed you in and
to seek his assistance in attempting to rectify such. He assures me that there is a means to insure
that your property tax statements are correct, that they will not need to be resubmitted for
recalculation, and that the number of statements can be reduced to two --one from Hennepin
County using the raw land value and the second from Carver County for the home and garage.
The land in Hennepin County would be calculated at the 1% rate. The property in Carver
County would be calculated at the 1%/2% rate and could take into consideration the value in
Hennepin County so as to assure that you are not paying more or less than you should pay. Mr.
Schafer assures me that he has discussed this with the Hennepin County Assessor and that
Hennepin County is amenable to his proposed solution. To insure that the current problem does
not reoccur in 1995, he would suggest that we complete all necessary paperwork prior to mid-
year /fall 1994.

will technically work. Anticipating such, I asked Mr. Schafer if he could be available at 6:30
p.m. on April 18. I suggested that time and place as Mr. Schafer needs to be here at City Hall
to conduct the annual Board of Equalization and Review meeting starting at 7:00 p.m. that
evening. Mr. Schafer stated that he could be available. I explained to him that you are both
school teachers and if the April date did not work that we would probably look to a daytime visit
at Mr. Schafer's office some time after school was out this spring.
