This letter is to inform you that today the Carver County Board of
Commissioners voted to fund a new prosecutor and a support staff
position for 1996. This means that there will be no surcharge for
1996. The contract that you will receive in December for the 1996
prosecution services will read essentially the same as the 1995
contract.
Under the provisions of the 1995 contract, our office receives a
one -third share of the fines in exchange for our providing the
municipal prosecution to the cities. This fine split will continue
under the 1996 contract.
I want to thank all the city councils for allowing me to address
them about the staffing problems facing our office. I think the
system is a good one and am thankful it will continue.

SUBJ: The LCMR and the Bluff Creek Watershed Plan
On August 23, 1995, we had the opportunity to tour the state legislators on the Legislative
Committee for Minnesota Resources (LCMR) along the Bluff Creek corridor. The meeting
gave us an opportunity to discuss natural resources and development issues associated with
Chanhassen. We presented them with a handout summarizing the Bluff Creek Watershed
planning process and maps created on GIS of the watershed and the trail system.
The tour began on the southern end of the City where we identified some of the few
remaining native habitats in the county, Seminary Fen and the unique aspect of the bluffs.
We then drove along the corridor to the Pillsbury property where they could view the creek as
it travels through rolling hills, wetlands, and agricultural fields. At the same time, they could
see the future of this area for the Creekside Development has been mass graded.
We discussed the importance of trying to get a step ahead of development in order to best
preserve and protect the natural features of the City, provide open space, protect habitat, and
help to make the City a place where people want to stay. It was an excellent opportunity for
the City's public relations and hopefully they will take a second look next time we apply for
an LCMR grant!

Scott I just wanted to write you expressing my over
all appreciation to you and the city of Chanhassen for
giving our department the opportunity to participate in
the traffic detail that Trooper Sutherland has organized.
The "Laser" is a perfect tool for traffic enforcement.
Many of my contacts during the detail were not all that
positive but people made comment after comment with regard
to seeing the numerous squad cars in the Chanhassen area.
I think those people were somewhat more careful in their
driving habits after the contact.
' I know there has been talk of purchasing a "Laser" in
the near future. Along with the traffic shifts in
Chanhassen and Safe & Sober shifts I think we could set -up
' a traffic detail every week through out the year to combat
the number one problem in Chanhassen, that being speeding.
' I would be more than willing to help organize a
traffic detail program with yourself and Bob if requested.
In closing the traffic detail has inspired me to get
' back into the enforcement mood to be more aggressive
toward this major problem.

On August 9, 1995, Julie Schoenecker of the Office of Information Systems Management audit
staff conducted a CJIS and NCIC compliance audit at your agency. Upon completing the audit,
Ms. Schoenecker produced a written report and then reviewed it with your TAC, Leslie Michel.
The audit was favorable in several areas.
All terminal operators are certified.
CJIS Connections Newsletters are routed to the terminal operators, and are retained in
a readily accessible area for future reference.
Operating and Code manuals are current and accessible.
Criminal history inquiries are according to CJIS /NCIC policy and procedures.
All terminal operators have their own password for Criminal History inquiries.
Criminal history printouts are destroyed as recommended (by shredding).
The agency was able to document all Criminal History inquiries.
During the audit, Ms. Schoenecker also noted NCIC's security policy which requires your
agency to send two sets of applicant fingerprints to the BCA for all new hires who might access
your CJDN terminals. Your agency is now responsible for ensuring that all future hires who
have access to the CJDN terminal are screened, including fingerprint identification for criminal
history checks.
The auditor did identify some areas where your agency needs to make improvements to fully
comply with NCIC operating standards and procedures. These standards have been established
so that criminal justice agencies can utilize information from CJIS and NCIC to its fullest
potential and so that the members of the criminal justice community can rely on that information
as being complete, accurate and timely. Ms. Schoenecker identified the following concerns:

' 1. Standard Operating Procedures Manual: The agency should have a Standard Operating

' Procedures Manual (SOP) which could be kept at the terminal sites and used for
employee training. The SOP manual should explain the use of the CJDN system in the
areas of CCH /III and driver's license inquiries. The manual should explain such items
' as how to do inquiries, what is to be done with hard copies of the information received
from the CJDN, what the CJDN information is to be used for, whether or not
information received from the CJDN is to be given to other authorized agencies, logging
' of secondary dissemination, system confidentiality, etc. The procedures should also state
what message keys and purpose codes are to be used for the different types of inquiries.
For example, when inquiring for criminal justice employment, the Purpose Code must
' be "J "; when inquiring on out -of -state driver license record, the message key must be
KQ, etc. Having internal written procedures ensures that persons performing CJDN
functions know and understand these functions and may help to protect the agency if
' misuse of the system occurs.
As indicated to Leslie Michel in the report that was left with your agency, you need not respond
' in writing and address the above areas of concern. Future audits will look for improvements
in the areas of concern cited above.

especially like to thank Ms. Michel who took the time to answer the pre -audit questionnaire,
retrieve case files, and answer Ms. Schoenecker's questions during her visit. I appreciate your

I am writing to you concerning the McGlynn's/Pillsbury bakery located at One McGlynn
Drive off Audubon Road.
The concern is about the safety of residents farther down Audubon Road. Last year I was
driving home from work and was almost struck by a semi -truck pulling out of the shipping
dock driveway. I could not see the truck and the truck driver could not see me due to the
fact that there were other semi - trucks lined up along the shoulder of Audubon and
blocking the view from an already poorly engineered driveway. Luckily, I am a cautious
driver, having two children in the car with me most times, and when I see there are trucks
lined up I drive at 20 miles per hour, rather than the posted 45.
Recently, I have noticed new signs posted stating a no parking zone on either side of the
driveway, but that is not enough. The driveway is blocked by the height of the semi's and
the hill that has recently been built up with the new construction that has been going on at
the bakery.
I would like to propose that Audubon Road be a no parking zone from Highway 5 to
Lyman Boulevard. It may be only a matter of time until injuries or death occurs at this
location. It doesn't matter how slow a semi -truck is going, it will always win the battle
over a car.

SUBJ: Meeting with Animal Control Representatives
Following are several things that came up during our meeting that we should discuss with the
CSOs:
1. The cities appreciate information being faxed to them on such issues as kennels
being full, etc. Let's take every advantage we can to keep in touch with the cities
through faxes.
2. I will ask you to either check on it or assign someone to check on finding out
what other cities do with DOA animals. Greenwood had a particular concern
about how they were disposed of, what records were kept, etc. Also, we need to
make a formal policy on what to do with dead animals, domestic or otherwise, on
highways, city streets and county roads.
3. I 4bsolutely want animal control personnel assigned to the cities to get up to each
of their cities at least once a week -- no exceptions. Calls on occasion would be
nice, too.
4. The cities requested handouts on the more typical animal control problems, such
as raccoons, etc. Can we get a packet for each city?

Southwest Corridor Transportation Coalition Update
1. Board Elects Officers.
I At the July 28, 1995 board meeting the coalition's board elected the following officers.

2. Minnesota Department of Transportation (MnDOT) Releases Toll Road Request for Proposal (RFP).
' MnDOT has released a two phased RFP for toll roads. The first phase permits developers to identify
projects and attempt to obtain community support for the project. If the developer or community
has support for the project and the project is still considered to be feasible the developer can
complete the application. A tentative schedule identifying the major dates for the RFP are as
follows:
' 1. RFP issued. July 31, 1995
2. Pre proposal conference. August 30, 1995
3. Initial proposal deadline. November 17, 1995
' 4. Community support proposal deadline. March 1, 1996
5. Schedule set for interviews. April 1, 1996
6. Commissioner approves proposals for negotiation and 30 day veto May 10, 1996
period commences.
' 7. Thirty -day local veto period expires and final application fee due. June 10, 1996
8. Negotiation of development agreements commence. June 24, 1996
' 9. Proposal protection period expires. May 19, 1997
MnDOT plans to make up to $10.0 million available annually for projects. The funds, however, are
not specifically appropriated but are anticipated to come from motor fuel tax revenue.
' 3. Board to Examine Alternative Funding Mechanisms.
The coalition board has begun a study of alternative funding sources for the Highway 212 project.
' Among the alternatives being studied are increased state funding sources, special highway districts,
and authority to raise local revenues. At the membership's August 18, 1995 meeting, several

alternatives will be presented for review and comment.
4. Highway 7 Coalition Update.
The Highway 7 Coalition, in cooperation with MnDOT, has initiated a study of Highway 7 to
determine traffic volume, types of traffic and volume, and the cost of improving Highway 7 to a '
"super two" design. The coalition anticipates project funding within the next few years.
A joint meeting with the Highway 7 group is being planned for this Fall. In addition to providing '
information on the progress of each coalition, the meeting will also attempt to identify ways the
coalitions can cooperate. ,
5. House Committee to Conduct Hearings on Transit.
The House Local, Urban Affairs Committee, and the Transportation Committee are jointly '
conducting a series of hearings regarding metropolitan transit. The hearings which will be held
throughout the legislative interim will attempt to obtain information on the transit system in the '
metropolitan area as well as general transportation issues. The committees anticipate the hearings
will lead to legislation for introduction in the 1996 Session.
