SUBJ: Award of Bid, Ice Hockey/Inline Skating Rink Improvements, North
Lotus Lake Park and Chanhass n Recreation Center, City Project RA -492
Plans and specifications for this project wer oved and authorization to advertise for
bids was granted by the city council on Sep b 11, 1995. These authorizations were
given with the expectation that answers to w ee i es be delivered with a
recommendation for award of bid. First, sweOl the outstanding issues.
1. Concrete to Asphalt: The court, is correct their recollection that the issue of
concrete vs. asphalt was disc „ ed. Specific , the question at hand is, "Which
would make a better surfac, r the interior of rinks?" The issues are: 1)
longevity; 2) investment-s,_ 1�th short and long to �, 3) surface maintainability; and
4) color. At the time ,CA was designing the ree ation center, my demand of
them was straightf ard. If they could design a ncrete cross - section and sub-
base that wout 100% guaranteed not to heave, would recommend concrete.

has a concrete surface that is use is winter and inline skating
in the summer -The John Rose Ov seville. The Oval is a highly
' engineered, refrigerated concrete sl ecifically designed for its use.]
Asphalt costing $30,000+ less than concrete is the next best alternative. It's
' elasticity provides a uniform surface for inline skating. Surface oxidation can be
kept in check with periodic sand sealing and the rinks will either be painted or
covered with white paper to address the issue of color.

2. The cost of administering the project through a consulting engineer. The
engagement estimate for professional services of not to exceed $30,800 with
$4,000 in direct expenses was reviewed (scrutinized) by staff. Staff is certainly
aware that the council is sensitive to these costs. I prefer to administer all projects
(and keep them in- house) when feasible. With a project of this size and detail,
this approach would have been counter- productive. To put Mr. Horn's proposal
in perspective, I compared it to a proposal received on an unrelated project earlier
in the year. The ratio of engineering costs to project costs on the comparison
project was approximately $16,000 to $50,000. This proposal was rejected and
staff is completing the project in- house.
It is stars opinion that Mr. Horn has presented an accurate proposal to the City of
Chanhassen, the value of which will be enjoyed by the residents of Chanhassen
for years to come.
3. Financial issues relating to the ability of TIF District to finance this project and
the status of change orders (contingencies) on the Bluff Creek Elementary
School/ChanhassenRecreation Center project. The completion of the Chanhassen
Recreation Center exterior recreation components has been programmed since the
inception of this project. My analogy is that it is senseless to march 99 yards
down the field only to step out of bounds. The parking lot is in, the warming
house is built, the hockey lights are installed, and it snowed today. We need
hockey boards. I have always been hopeful that the district could finance this
project. As it goes with most projects, things get tight towards the end. The
ability to finance even $150,000 worth of hockey boards for the Recreation Center
was in question up until last week. However, with their work and calculations
completed, Managers Ashworth and Gerhardt are comfortable assigning this cost
to the district. Any costs associated with an arbitration settlement have also been
considered.
In closing, a summary of change order activity on the Bluff Creek Elementary
School/Chanhassen Recreation Center has been requested of Mr. John Gockle, the
owner's construction consultant. To date this information has not been forwarded.
Attached please find a letter from Gregory Brown of BRW detailing the results of the
September 21, 1995 bid opening for City Project RA -492. I am pleased with the base bid
of $128,080 from Finley Brothers, Inc. It is $18,990 lower than the bid from Hardrives,
Inc. Finley Brothers is a reputable contractor who has performed admirable for the city
on past park and recreation department projects. I also find Bid Alternate No. 1, the
Chanhassen Recreation Center rinks, to be a favorable bid for the city. Bid Alternative
No. 2 asked the bidders to submit a price for using wooden posts as an alternate to metal

posts in the rink board assemblies. This alternate would save the city $4,000 to $5,000
per rink. It would be my recommendation not to consider Bid Alternative No. 2
RECOMMENDATION
It is recommended that the city council award City Project RA -492, Ice Hockey and
Inline Skating Rink Improvements, North Lotus Lake to Finley Brothers, Inc. with a base
bid in the amount of $128,080. Furthermore, it is recommended that the city council
award Bid Alternative No. 1, Chanhassen Recreation Center to Finley Brothers, Inc. in
the amount of $149,295.

Both'bids were submitted with bid guarantees as required by the Project Manual.
A bid tabulation was performed to verify the total bid amounts and a minor error
was found in the Finley Bros., Inc. bid. Hardrives bid contained a minor error
and mistakes in their bid summary. All other bid amounts were correct and the
errors discovered did not change the low bidder. A copy of the bid tabulation
is attached for your information.
The base bid amounts detailed above included improvements to North Lotus
Lake Park, The improvements include the construction of one hockey rink,
parking lot /entrance driveway improvements and pathway construction.
The low bid amount is approximately seven percent (7 %) greater than the
Engineer's Estimate. The bids may be higher due to the proximity of the project
period to the end of the construction season and the tight time constraints
required for the project completion.

As a part of their bid, each contractor was required to submit unit prices for two
bid alternates. Bid alternate one included construction of two additional hockey
rinks at the Chanhassen Recreation Center. Bid alternate two included prices for
constructing all three hockey rink board assemblies using wooden posts instead
of the steel posts specified in the base bid. The following is a summary of the bid
alternate costs received from each contractor:

It should be noted that the cost difference between using wooden posts and metal
posts in the rink board assemblies is $4,000.00 to 5,000.00 less per rink for the
wood alternate. The City should consider the additional costs and savings
associated with the Bid Alternates and decide whether it is feasible to include
them in, the project.
Finley Bros., Inc. has significant experience constructing hockey rink facilities
similar to those included in this contract and should be capable of performing the
work required by this contract.
We, therefore, ' recommend the award of the Ice Hockey /In -line Skating Rink
Improvements, City Project RA -492, to Finley Bros., Inc., for the total amount
of $128,080.00. If the Bid Alternate 1 is accepted, the contract amount would be
$277,375.00. If both Bid'Alternates are accepted, the contract amount would be
$264,375.00.
Finley Bros., Inc. proposes to use the following subcontractors to perform the
