On Monday, May 16, 1994, a Ms. Nancy Vollmer called Kim Meuwissen, City Engineering staff,
' to report a spill/stain on the road in front of her house at 6440 Fox Path. I was called by Kim
to investigate.
' Observation at site: An area approximately 8' x 8' was stained with a possible petroleum-or
hydraulic liquid. There was also a storm sewer inlet in the same area. The asphalt when poked
with a knife showed signs of getting soft. Diane Desotelle, Water Resources Coordinator, was
' called to the site for her evaluation. She concluded there was not enough product floating on the
water to pick up, and the amount left would evaporate and degradate through the wetland system
before entering Lotus Lake. She advised flushing the storm sewer with fire hydrant water, which
was done for approximately 15 minutes.
' The Fire Department applied "Power Sorb" (1 bag) on the spill area, swept it up, and rinsed area
with a booster line.
A Mr. Sheldon Swenson from Quality Waste Control was notified and informed me a truck lost
10 - 12 gallons of fluid on Wednesday, May 11, 1994. Mr. Swenson was advised to call the
Minnesota State Duty Officer to report the spill.

As we discussed last Friday, I am requesting a grant from Carver County for the City of
Chanhassen in the amount of $1,000 to permit the city to offer mulching blade converter kit
coupons for up to 100 city residents for their mowers. This grant will be used to continue
our joint efforts to promote waste reduction, reuse, and recycling.
We will be providing these coupons through the month of June, 1994. Merlin's Ace
Hardware and Chanhassen Lawn and Sports have agreed to work with the city on this
program.

The City of Chanhassen and Carver County are teaming up to provide 100 coupons
worth up to $10.00 for Chanhassen residents to purchase converter kits for their lawn I
mowers.
Merlin's Ace Hardware and Chanhassen Lawn and Sports in Market Square have '
agreed to work with residents in choosing the converter kit that is right for their lawn
mower.
Coupons may be picked up at Chanhassen City Hall after Monday, May 30, 1994. A
limited number are available. One coupon per household please.
Coupons must be redeemed during the month of June, 1994 at either Merlin's Ace '
Hardware or Chanhassen Lawn and Sports in Market Square Center on Market
Boulevard and West 78th Street. '

I have recently been informed by Barton - Aschman, Associates, the project engineer for the Trunk Highway 5 South
Frontage Road project east of Galpin Boulevard (County Road 19) adjacent to the proposed elementary school site,
that grading activities which have recently begun have encountered peat and other organic subsoil in the area of the
proposed frontage road. The extent of the poor soils within the frontage road are estimated to be 15 feet in depth
over a length of approximately 350 feet.
In order to remove these poor soils for the construction of the frontage road, approximately five mature trees (Elm
and Ash) and other volunteer growth within the City property north of Timberwood Estates would be lost. The
project engineer estimates that the tree loss area on the City property would be approximately 20 feet in width by
350 in length. Approximately 1,700 feet of woody vegetation exists along the common property line with
Timberwood Estates and it is estimated that a 50 -foot width of trees and woody vegetation would still remain south
of the excavation area providing buffering and screening for Timberwood Estates.
The plans for the frontage road in this vicinity initially included a retaining wall at an estimated cost of $150,000
to preserve the full width (approximately 70 to 80 feet) of tree and woody vegetation buffer strip for Timberwood
Estates. Given the poor soil excavation work necessary, this retaining wall would no longer be needed. A portion
of this cost savings could be used for relandscaping the area of City property south of the frontage road where trees
and brush would be lost.
Staff has considered putting this on as a Council agenda item but "there really are no other alternatives for removing
this extent of poor subsoils from the. proposed 'frontage road. If the Council wishes to .pull this off of the
Administrative Section for individual or group discussion, staff would be more than happy to accommodate.

Re: Independent School District #112 Site Grading
' Dear Mr. Folch:
' As you are aware, grading activities recently began on the Independent School District #112
site southeast of the Galpin Boulevard/M 5 intersection. While performing subgrade
correction work along the south frontage road alignment between Stations 16 and 18, the
contractor discovered approximately 15 feet of peat and other organic material (see attached
' figure). Soil boring ST -12 had indicated a 7 -foot depth of organic soils. The geotechnieal
consultant for the frontage road, GME Consultants, did have a soil boring (taken April 1,
1994) in the vicinity of ST -12 which indicated a 17 -foot organic soil depth.
' To excavate the organic soils as necessary for construction of the frontage road, removal of
approximately five mature trees (elm and ash) and other , ;volunteer growth north of the
' Timberwood Estates property line would be required as shown on the attached figure. The
total length of tree and brush removal along the property line would be $50 feet.
Approximately 1,700 feet of woody vegetation exists along the property line. The frontage
' road alignment had previously been shifted to the north to preserve the trees.
It is recommended that the City of Chanhassen approve the removal of brush and trees in
' the highlighted area of the attached figure. In addition to allowing for adequate excavation
of organic soils, roadway embankment slopes could extend to the property line, thereby
eliminating the need for a retaining wall. The feasibility study for the frontage road
included an estimated $150,000 cost for the retaining wall. Some of the cost savings could be
utilized for relandscaping the area where trees and brush would be removed.
Please contact me with your decision on this issue.
Barton- Aschman is also working on determining the right -of -way requirements for TH 5
along the north side of the school site. Based on a site grading plan prepared by HGA in
' December 1993, it had been determined that a 45 -foot width of additional right -of -way would
be adequate.

PERSONAL /PROFESSIONAL SERVICE AGREEMENT
THIS AGREEMENT IS made and entered into by .Ad between the COUNTY
OF CARVER, STATE OF MINNESOTA (County), and the City of
Chanhassen (Provider).
W I T N E S S E T H ,
WHEREAS, the County, throuqh the Environmental Service Department
wishes to distribute funds to the City of Chanhassen; and ,
WHEREAS, there are funds available to subsidize backyard
composters, operate a yardwaste drop -off site and general '
environmental education materials ; and
WHEREAS, the Provider warrants and represents that they are '
qualified providers.
NOW, THEREFORE in consideration of the mutual undertakings and
agreements hereinafter set forth, the County, through the Depart- '
ment, and the Provider agree as follows:
1. TERM AND COST OF THE AGREEMENT '
The provider agrees to furnish City residents the services and
supply the County documentation verifying expenditures by
December 31, 1994. The scope of services to be provided include:
- Subsidizing the purchase of 400 backyard compost bins '
- Continue funding of city compost site
- General environmental education materials ,
The Provider shall be paid by Auditors Warrant upon approval of
the claim by the Environmental Services Department as follows:

The Provider is an Independent Contractor. ,
Nothing contained in this Agreement is intended or should be con-
strued as creating the relationship of co- partners or joint ven-

turers within the'County or the Department. No tenure or any
rights or benefits, including Worker's Compensation, Unemployment
Insurance, medical care, sick leave, vacation leave, severance
pay, PERA, or other benefits available to County employees, shall
accrue to the Contractor or employees of the Contractor perform-
ing services under this Agreement.

3. DATA PRACTICES
All data collected, created received, maintained or disseminated
for any purposes by the activities of the Provider because of
this contact is governed by the Minnesota Government Data Prac-
tices Act, Minnesota Statutes 1984, Sections 13.01 through 13.87,
'
as amended by the Laws of Minnesota 1985, Chapters 293 and 298,
the Minnesota Rules implementing such Act now in force or
hereafter adopted, as well as Federal regulations on data
privacy.
,
4. RECORDS - AVAILABILITY
' The Provider agrees that the County, State Auditor, or any of
their duly authorized representatives at any time during normal
' business hours and as often as they may reasonably deem neces-
sary, shall have access to and the right to examine, audit, ex-
cerpt and transcribe any books, documents, papers, records, etc.,
which are pertinent to the accounting practices and procedures of
' the Provider and involve transactions relating to this Agreement.
5. MERGER AND MODIFICATION
It is understood and agreed that the entire Agreement between the
parties is contained herein and that this Agreement supersedes
' all oral agreements and negotiations between the parties relating
to the subject matter hereof. All items referred to in this
Agreement are incorporated or attached and are deemed to be part
of this Agreement.
Any material alterations, variations, modifications or waivers of
provisions of this Agreement shall only be valid when they have
' been reduced to writing as an amendment to this Agreement and
signed by the parties hereto.
6. DEFAULT AND CANCELLATION
If the Provider fails to perform any of the provisions of this
Agreement or so fails to administer the work as to endanger the
' performance of the Agreement, this shall constitute a default.
Unless the Provider's default is excused, by the County, through
the Department, may upon written notice immediately cancel the
Agreement in its entirety.
This Agreement may be canceled with or without cause by either
party upon ten days written notice.
7. OWNERSHIP
Upon completion of all work,the County shall be the sole owner of
all accompanying documents.

S. INDEMNIFICATION
The Provider agrees it will defend, indemnify and hold harmless
the County, its officers and employees against any and all
' liability, loss, costs, damages and expenses which the County,
its officers or employees may hereafter sustain, incur, or be
required to pay arising out of the Provider's performance or
' failure to adequately perform its obligations pursuant to this
contract.
9. SUBCONTRACTING AND ASSIGNMENT

Provider shall not enter into any subcontract for performance of
any services contemplated under this Contract nor assign any
interest in the Contract without the prior written approval of
the County and subject to such conditions and provisions as the
County may deem necessary. The Provider shall be responsible for
the performance of all Subcontractors.

On Monday, May 16, 1994, city staff inspected Lots 12 and 13, Block 3, Lake Susan Hills
West 9th Addition. At that time, we discovered that building trusses are being stored in an
area that is protected by a tree preservation fence. No equipment, chemicals, soil deposits,
or construction materials shall be placed within the protective barriers.
Since the damage has already been done to the root zone by the trusses, the city will require
deep root high pressure fertilization on three foot centers in the root zones of the impacted
trees, numbers 595, 596, 598, and 626. (Note trees 595 and 596 are actually on Lot 11.)
This process should be completed soon after the trusses are t+emoved from the area and
installed on the structure. Please provide the city with documentation .that the
fertilization/aeration has been completed.

Thank you for your cooperation in this matter. We are aware of the difficulties involved in
implementing and maintaining a tree preservation program - in a construction area. We cannot
over - stress the importance of establishing and maintaining the integrity of .tree protection
zones.

JOINT PLANNING OF SHAKOPEE MEDICAL CAMPUS ANNOUNCED
St. Francis Regional Medical Center, Park Nicollet Medical Center, HealthSpan
Health Systems Corporation and Benedictine Health System have announced a preliminary
agreement for joint construction of a new medical campus in Shakopee.
Groundbreaking is expected early next year. The campus will be located along
County Road 17 in Shakopee and will include Park Nicollet Shakopee Clinic, a new facility
for ambulatory and hospital services for St. Francis and a medical office building to house
other independent physician groups. Other clinics supporting St. Francis are being encour-
aged to become part of the campus as the project moves forward.

Because it includes both hospital and clinic facilities, health care providers be-
lieve the new campus will be more cost effective and will enhance health care quality as well as
the availability and convenience of appropriate services. Joint planning by the clinic and the
hospital will benefit the local community and patients by encouraging shared services and tech-
nology.
A nationwide trend toward outpatient care and the size of the current hospital contributed
to the need for a new medical campus. The current St. Francis site is landlocked and leaves no
room for critical expansion necessary to accommodate an expected 15 percent increase in the
population of the service area over the next five years.
"The new campus ensures that area communities will continue to have available local
hospital care, which ultimately improves the quality of life for area residents," said Don
Leivermann, CEO of St. Francis.
"We identified a need within the community to expand our Shakopee office some time
ago," said Joseph Mitlyng, chief operating officer, Park Nicollet Medical Center. "The collabora-
tive effort to locate both clinic and hospital services within one medical campus meets our
ongoing commitment to do what's best for our patients and for the community."
This announcement comes after several years of strategic planning to make the vision of
the new medical campus a reality. Last October, St. Francis and its Duluth -based parent com-
pany, Benedictine Health System, developed a joint sponsorship agreement with HealthSpan
Health Systems Corporation. This partnership will enable St. Francis to continue to provide
medical services to Shakopee and surrounding communities.

The Metropolitan Council gave special permission to extend water and sewer service to
the new site in June 1992. Last May, the hospital purchased the 60 -acre site directly south of the
,
future Shakopee Bypass on County Road 17 where the new medical complex will be built. In
August, the hospital began looking for a buyer for the existing facility. The scope of the new
campus will depend in part on the identification of a new use for the existing hospital facility.

Minneapolis, and Benedictine Health System, Duluth. With 423 employees and 225 physicians

On Monday, May 9, 1994 at approximately 9:30 a.m., I was requested by Scott Gerber from
Carver County to meet him at the intersection of Red Cedar Point and Juniper regarding a liquid
spill.
Upon arriving at the site I observed a petroleum or hydraulic fluid spill on Juniper and part of
Hickory. The spill measured approximately 850' (feet) in length and the width varied from 3'
(feet) to 8' (feet).
I was told by the homeowner at 7201 Juniper, Joan Detello, that she had first noticed the spill
on Friday, May 6, 1994 between 10:00 a.m. and 1:00 p.m. She was unsure of the exact time.
The majority of the liquid had soaked into the asphalt road surface with a small amount (less
than 4 tablespoons) on top of manhole covers.
Upon the recommendation of Kevin from the Minnesota Pollution Control Agency, 1 dump truck
load of sand was spread on the spill and was then swept up with the city's street sweeper. All
the licensed garbage haulers were contacted to determine whose truck had the spill. It was
determined that Aagard West Inc., P.O. Box 115, Norwood, MN 55068 (332 -8412) had vehicle
problems on Friday, may 6, 1994 at approximately 1:00 p.m. to 2:00 p.m. This information was
provided to me by a representative from Aagard West Inc.
CONCLUSION: C USION: The sand and sweeping appeared to have some effect on the spill. A video was
' taken by the 2800 car and still pictures were taken by Mark Littfin, the Chanhassen Fire Marshal.
Both are on file. Aagard West will be billed for the cost of the dump truck, street sweeper and
sand.

It has come to my attention that the City may be considiring a moratorium on development in the Hwy. 5
Corridor Study Area f �S

When the Study Area was first delineated, my property was NOT Included
Subsequently, I discovered that the boundaries. had been revised to include my property. I have Target ^
and Ryan between my property and Highway 5 but somehow I was pulled into the Corridor.
The practical effect of including my property ( Lots 1,2,3 of West Village Heights 2nd Addition) in the
Corridor Area and therefore subsequently In any moratorium would be to deny access to TIF. Any delay
In developing my property will shorten the period during which TIF benefits can be spread; with the
further damage that I would have to continue paying assessments during the moratorium period !
I urge you to share my concerns with the Mayor, City Council, Planning Commission, and staff. A
moratorium will have unfair and undue consequences for those properties which He within the TIF
District because of the "beat the clock" aspect of TIF.
Further, I don't think the real issue Is the downtown area of Highway S. The real areas of concern are
east and west of downtown. Please don't allow the development of downtown to be put on the same
schedule as the development of 5 and 41, for instance.
We have discussions on a daily basis with multiple parties who are interested in our remaining land. I can
not negotiate or plan under a cloud of uncertainty.

I wanted to take this opportunity to bring to your attention the efforts that Fire Marshal Mark
Littfin and the Fire Department are making to plan for effective responses to petroleum spills.
It is rather amazing to me that while spills of varying degrees have been occurring on roadways,
highways and private property since cars have been driving and businesses have been operating,
it has only been recently that communities have realized that. just washing the spill into the storm
sewer is not appropriate.
As the Surface Water Management Task Force has taken water quality more seriously in
Chanhassen, we have joined forces with the Engineering Department to take steps to deal with
the huge costs to the City associated with the inflow and infiltration problems from the illegal
discharge of sump pumps into. the : sanitary: sewer., system., Fire Marshal Mark Littfin has
creatively established a spill control program by which the Fire Department can respond to such
calls.

SUBJ: Funding for Spill Control Response Trailer
Approximately 3 years ago, the Chanhassen Fire Department started to get involved with mitigation procedures
resulting from petroleum spills. To date, the "Surface Water Management Task Force" (S.W.M.T.F.), has
provided us with $2,000.00 to purchase containment and absorbent material to minimize spill damage.
Currently, the containment equipment is stored in the back of the Fire Station, and on 3 separate. fire vehicles.
In order to maximize efficiency and manpower, we are currently recruiting funds from petroleum companies,
railroads, and Williams Pipeline, for the purpose of a trailer.. ,,
So far to date, we have raised $3,400.00, ($3,000.00 came from the Chanhassen American
Legion). At this
time, I would like to request the additional $3,600.00 from the S.W,.M.T.F, to reach our goal of $7,000.00. This
would allow us to purchase a trailer plus some additional equipment.
Currently, approximately 80% of the Fire Department members are..tertified Haz Mat Level 1, two members
1 at Haz Mat Level II, and future plans are for a Haz Mat Level II class being offered at our Fire Station in the
Fall of 1994. So you can see,' there is a commitment.from the firefghters in our City for continued training
in hazardous materials.

With a combination of frefiAiers trained at Level H, and a fully equipped spill control tirailer, the Chanhassen
Fire Department should be able to respond with ,firefighters and equipment minutes after we receive a call.
For your information, we are working closely with Mike Wegler from the Public Works Department, who along
with the Fire Department, would be instrumental in providing heavy equipment and working knowledge of the
City's storm sewer and drainage systems.

blessed with water resources for our residents to enjoy. I am aware that the city's Park and
Recreation Commission reviewed the possibility of installing a pier at North Lotus Lake Park
in January of this year. The commission could not recommend that the city pursue a pier at
this location for three reasons:
1. The remoteness of the site.
2. The nearest parking area is over 800 feet away.
3. To gain access to the lake, a dock over 190 feet in length would need to be installed
through the cattails just to reach open water..
However, I will ask the commission to consider applying for a fishing pier grant (they are
supplied through the Department of Natural Resources) for South Lotus Lake Park. The
depth of water which can be reached at this location is much better for fishing and the park
contains adequate parking for vehicles. I will place this item on the May 24, 1994, Park and
Recreation Meeting. You will receive notification of this item.. .

The original estimate for this phase of the well field study was $25,000. The possible
additional costs are due to possible additional borings required and higher than anticipated
drilling costs. The higher than anticipated drilling costs are the result of using split tube or
Rotosonic drilling instead of the originally proposed rotary e added costs.
As more
alternate
i nformation obtained from the more costly drilling is worth
to the split tube drilling we could use standard mud rotary drilling at a cost of
approximately $4,000 per boring (compared to $7,700 per boring for the split tube).
However, the information obtained from the mud rotary drilling is much less useful.
Please note that the originally estimated engineering t r have.sts have not increased; only the
' drilling costs of the independent drilling contractor
We recommend that the City authorize the minimum required drilling at this time. The
potential additional borings could be approved later if they are found to be necessary. We
anticipate that the drilling could begin later this month and be completed by mid -July. At
that time, we will begin Phase IV of the study, preparation of the final report.
