SUBJ: Order Stage I Improvements for Lyman Boulevard/Lake Riley Area Trunk Utilities
Project No. 93 -32
The continuation of the Lyman Boulevard/Lake Riley AreamTrunk Utilities Improvement Project No. 93 -32 was held
' at the City Council's last meeting on Monday, July 25, 1994, At that meeting, staff presented a Stage I portion of
the proposed project to begin construction yet this fall and be completed by early next summer. It was pointed out
to the City Council that additional time (approximately 3{1 days) would be needed to define the remaining stage or
stages of this improvement project. However, staff felt comfortable recommending the Stage I portion of the
improvement project be ordered and that associated plans and specifications for this project be authorized.
State Statute 429 regarding specially assessed public improvement projects requires that a 4/5 majority Council
' approval be obtained to formally order an improvement project. Due to the absence of two Council members at the
previous meeting, the 3 -0 vote (even though unanimous) did not meet the 4/5 requirement. As such, the City
council was able to authorize preparation of plans and specifications::for the Stage I improvements to the Lyman
Boulevard/Lake Riley Area Trunk Utility .Improvements, Project 14 ,93 -32, and it was agreed that the official
ordering of this segment of the improverndttt project would be consrdered at the City Council's regular meeting on
Monday, August 8, 1994.
I It is therefore recommended thatthe City Council officially order the Stage I portion of the Lyman Boulevard/Lake
Riley Area Trunk Utility Improvement Project No. 93 -32 as defined in the attached staff report dated July 19, 1994.

SUBJ: Continuation of Public Hearing on Lyman Boulevard and Lake Riley Area Trunk
Utility Improvement Project No. 93 -32 (Continued from 7/11/94)
' At the previous public hearing for this project held on July 11, 1994, City staff presented
information to the Council that representatives .of two large acreage properties zoned for high -
density residential (Charles Adelman and Lakeview Hills Investment Group) had contacted the
' City just prior to the hearing indicating that they had experienced difficulties in the hearing
notification process and did not have sufficient time to review the feasibility study and respond
to the project accordingly. Written letters from these representatives were presented to the
' Council requesting that action to order this project be delayed in order to allow them additional
time to review the study. Subsequently, testimony was given by other property owners and/or
developers associated with this project as to whether or not it was justified to delay this project
' for one or two properties. As a result of discussions that ''occured, the City Council continued
the public hearing to their July 25, 1994 meeting and directed staff to review the project elements
to determine if a phased approach to the project could be implemented whereby improvement
' elements which are tied to critical timepath modes could be accomplished and remaining work
staged as appropriate.
' Staff and the project engineer have reviewed this phasing issue and have also met with
representatives of the two properties, i.e. Lakeview Hills Investment .Group and Mr. Ernie
' Peacock representing the Charles Adelman property. It is apparent that phasing of this overall
improvement project can be prudently made and yet meet the timing and needs of the developing
and petitioning properties.
The first phase which would begin construction yet this fall would involve the installation of
trunk watermain from its current terminus on Trunk Highway 101 at Lake Susan Drive and
' extend north along Trunk Highway 101 to the new 86th Street alignment then east through the
Mission Hills development, then south through the proposed Lake Riley Hills (John Klingelhutz)
development temporarily terminating at Lyman Boulevard. This stage will be compatible with

the timing and needs of the Mission Hills development located on 86th Street and will provide
some advanced utility accessibility for the proposed Lundgren development south of Lyman
Boulevard early next summer. The remaining work associated with the proposed project could
be constructed under a phase II or could potentially be split out into phases H and phases III. '
As indicated earlier, staff and the project engineer have met last week with the owner and
representatives for the Lakeview Hills Investment Group to discuss their issues and concerns.
Discussions at this meeting were considered positive and it is believed a mutually agreeable '
resolution regarding their concerns will be formulated within the next 30 days. Being able to
arrive at an agreeable resolution will determine whether the remaining work is completed all as ,
a phase II contract or whether it will be split into two more phases. In any case, a phase H
portion of this project is expected to be presented to the City Council for ordering plans and
specifications in the next 30 days. '
At this time, it is staffs' recommendation that stage I consisting of the trunk watermain
installation as described above be authorized for the preparation of plans and specifications with ,
the understanding that within the next 30 days or so staff will bring back a recommendation on
phasing the remaining work on the project and requesting authorization for preparation of
additional plans and specifications accordingly for Project No. 93 -32. '
