As of this fall, the West 78th Street and 0'0 nt wn improvement project is substantially
completed. One of the primary elements of. project was the upgrading of the segment of
West 78th Street between Powers Boulevatif (CSA 17) and Kerber Boulevard to an urban
roadway section with concrete curb and gutter. Prior"' to this improvement project, this segment
of roadway was a two lane rural road with a posted 'peed limit of 45 m.p.h. The 45 m.p.h.
speed designation was appropriate for tk I' roadway in if revious condition since there were no

I am certain that all of the Council in ers e w ll, �prev "ious discussions with me
concerning speed complaint issues, that regula bns�ps`f speed limits on all highways, county roads,
and local streets within the state rest with th'keii6issioner of Transportation. However, in a
few unique situations, the local authority is gin the jurisdictional privilege of establishing a
speed limit. Minnesota State Statute 169.14, Subd. 5b, states that "....the governing body of the.
city or town may by resolution declare the segment to be an urban district and establish on the
segment the speed limit for urban districts...." Where no special hazard exists, the local authority
may establish a speed limit of 30 m.p.h. on a roadway traversing through a designated urban
district as per MSA 169.14, Subd. 2(1). According to MSA 169.01, Subd. 59, "an urban district

means the territory contiguous to and including any street which is built upon with structures
devoted business, industry, or dwelling house situated at intervals of less than a 100 feet for a
distance of a quarter of a mile or more ". Without question, the segment of West 78th Street
between Powers Boulevard (CSAH 17) and Kerber Boulevard meets the criteria for an urban
district.
In order to maintain a consistent and safe speed limit designation along West 78th Street through
the downtown, it is recommended that the City Council designate the segment of West 78th
Street between Powers Boulevard (CSAH 17) and Kerber Boulevard as an "urban district" with
a maximum speed limit designation of 30 m.p.h.

WHEREAS, the City of Chanhassen has recently upgraded West 78th Street between
Powers Boulevard (CSAH 17) and Kerber Boulevard from a rural roadway section to an urban
roadway section, and
WHEREAS, MSA 169.14, Subd., 5b allows the local governing body to declare by
resolution a qualifying segment of road to be an urban district, and
WHEREAS, this segment of West 78th Street complies with the definition of MSA
169.01, Subd. 59 as an "urban district ", and
WHEREAS, MSA 169.14, Subd. 2(1) allows for the establishment of a maximum speed
limit of 30 m.p.h. in an urban district
NOW, THEREFORE, BE IT RESOLVED that the segment of West 78th Street between
Powers Boulevard (CSAH 17) and Kerber Boulevard is hereby designated as an urban district,
and
BE IT FURTHER RESOLVED that the maximum speed limit for said segment of West
78th Street be established at 30 m.p.h.
