1967 04 24MINUTES OF THE APRIL 24 1967 VILLAGE COUNCIL MEETING The Chanhassen Village Council met in regular meeting at 7 :30 P.M. at the Village Hall. All members present. Mayor Coulter called the meeting to order. The Pledge given. The minutes of the last meeting were read and Councilman Roeser and seconded by Councilman Tessness proved as read. Motion carried no negative votes. on April 24, 1967 to the Flag was on a motion made by the minutes be ap- LOAD LIMITS: Police Officer Klein - present requested the Council to raise the load limits at this time on the Village Streets from 1 4 to 6 ton. He stated the County is doing the same. On a motion made by Council- man Hehl and seconded by Councilman Roeser that all Village Streets be posted at six ton. Motion carried no negative votes. A discussion was bled on parking on main street. It was decided that the parxallel parking must be enforced and that "no truck parking °signs should be placed in front of the Windschitel house east to the D X Station. Hank Schutrop and Roger Bongard were present. A discussion was held on their merchandise prices. Mayor Coulter read a letter from Hansen and Klingelhutz requesting that tho . lots in Highland Park which have not previously been assessed for sewer be assessed at $4..00 per foot and put on the tax rolls and paid over a 20 year period at 6% interest. On a motion made by Councilman Tessness and seconded by Councilman Hehl that these assessments be placed on the tax rolls over a 20 year period. at 6% interest. Motion carried, no negative votes. (Lots are as follows: Lots 7. 8 9 9 9 10. 11, Block 3; Lots 2. 3, 4 9 5 9 6, 7 Block 4 Highland Park ) Hansen & Klingelhutz also requested that their firm be allowed to use T. Flatebo,Engineering for developing the land they have just purchased. On a motion wade by Councilman Roeser and seconded by Councilman Erickson that the Village Council has no objections if T. Flatebo Engineering is employed by Hansen & Klirg elhutz Const. Inc. if they so desire. Motion carried, no negative votes. On a motion made by Councilman Tessness and seconded by Councilman Hehl whereas, it is to the best interest of the Millage of Chanhassen that the Operating revenues of the water and sanitary sewer systems be merged into one fund to,be known as the Water and Sewer Operating Fund. Motion carried, no negative votes. (Copy of resolution on file.) LANDSCAPING BID - SEWER PLANT On a motion made by Councilman Erickson and seconded by Councilman Roeser to accept the lowest bid for landscaping at the Sewage Disposal Plant which was Halla Nursery for $2 Motion carried, no negative votes. HEALTH OFFICER: The clerk read a letter from the Village Health Officer, Dr. C. R. Heinzerling. Letter on File. It was suggested that copies be made of the letter and sent to those involved. The Council would like to have George Shorba attend the next regular Council-'.Meeting. SAINT JOHNtS STREET: Tom Faust and Frank Bjornson were present wordering *F1WiA^ 8ing done with the finishing of the West End of St. Johnts Street. A letter was read from Attorney Larson. If this matter has not been taken care of by May 1. 1967 the Village will proceed to call the bond. t 52 Minutes of the April _24 Meeting continued: CHANHASSEN ESTATES: On a motion made by Councilman Tessness and seconded by Councilman Erickson that the Village Council accept the letter from Robert Mason RE: Chanhassen Estates and said letter to become part of the minutes. Motion carried no negative votes. LETTER AGREED UPON BY ALL: 1. Consideration was given the cost of the installation of the future 15" trunk sewer line to be installed at the south end of Chanhassen Estates (Flatebo Engineering Plat No. C- 102/EL 16 June 4. 1966). It was agreed subject to the approval of the Councilp that the developer should pay its share of this cost based on flow and usage and computed with relation to the area the trunk sewer line is designated to serve. 2. The Village has agreed at its expense to restore and rehabilitate the existing fence surrounding the sewage disposal area. In- additions the Village will join with the developer in a mutual effort to landscape the area including the planting of trees and shrubs with the expense to be borne equally between the developer and the Village. The cost shall be established through the letting of bids with the right reserved to the Village to reject all bids in the event reasonable prices cannot be ob. tained. The developer has requested that the Village discontinue use of the Sewage drying beds and the Village has agreed to comply with this request by June 1. 1967. 3. The Village will approve an easement 30 feet wide for road purposes for access to the adjoinkhg land west of Chanhassen Estates the easement to be located within an =:area 650 feet south of the northwest corner of Chanhassen Estates and the northwest corner of the addition. This ease- ment is to be broad enough to include the installation operation and maintenance of all utilities. The cost of the construction of the road- way on said easement shall be at the expense of the benefited parties,. 4. By Council action on April 14 1966, the zoning of Outlot 1 and Out. lot 2. Chanhassen Estates was changed to a commercial district. Further the Council granted the developer permission to install a subdivision sign in the addition. The sewer hook -up charge per residential lot shall be $250.00 per lot. This charge is separate from the cost of the installation of mains, in Chan- hassen Estates which are assessed separately on a 15 year basis. 5. The water hook -up charge is established at $250.00 per lot. The devel- oper has paid the Village $14 as a 10% good faith deposit'and this $14 is to be credited to the developer at the rate of $250.00 per residential lot hook -up. In the event of the payment of any hook -up charges by third parties the developer shall receive credit therefor at the rate of $250.00 per residential lot. 6. The Village will tentatively approve the developer's preliminary Plat No. 2760. 7. The location of the future 15" main trunk sewer line proposed at the south end of the addition is to be ,established by the Village Engineer , after study and surveys. This planning will necessitate the granting of an easement by the developer outside the boundaries of the existing plat for a lift station site, force main and sanitary sewer line including an access easement 20 feet wide for maintenance purposes as shown on preliminary Plat No. 2760. 1 1 1 WATER SCHOOL: The water committee desires to have Doug Fritz attend the water school. The Council agrees to send Mr. Fritz to water school only. "13 MINUTES OF THE APRIL 24 1967 COUNCIL MEETING CONTINUED TELEPHONE COMPANY: The Telephone Company desires to have Council approval to place a buried cable to the Municipal Building. On a motion made by Councilman Roeser and seconded by Councilman Erickson that the Council give approval to Northwestern Bell Telephone Co. to bury the Cable to the Municipal Building on the Village Engineers recommendation. Motion carried, no negative votes. 3*? LIQUOR LICENSE On a motion made by Councilman Tessness and seconded by Councilman Erickson that the Village Council approve the applications and grant a 3.2 On Sale Non Intoxicating Liquor License to: Ann Koltyk - -- Jerry's Old West Bar Harry Pauly - -- Pauly's Bar Inc. Val Heutmaker - -- Pine Grill Cafe Chanhassen American Legion Post #580 and approve the applications and grant a 3.2 Off Sale Non — Intoxicating Liquor License to: Ann Koltyk - -- Jerry's Bar Harry Pauly - -- Pauly's Bar Inc. Kay Kling ,lhut Village Clerk 1 JUSTICE OF THE PEACE: On a by Councilman Roeser that a motion letter made by Councilman Tessness and seconded be sent to the Justice of the Peace stating he is violating the law by not turning in his reports every thirty days, and that the Village Council expects an up to date report by the May 10, 1967 Village Council meeting.
