1967 08 07MEETING AUGUST T, 1967 The Chanhassen Village Council met in regular meeting on August 7, 1967 at 8 :00 P.M. at the fire hall. The following members were present: Mayor Coulter, Councilman Klingelhutz, Bennyhoff and Hill. Absent: none. The minutes of the July 31st meet- ing were discussed. On a motion made by Councilman Bennyhoff and seconded by Councilman Klingelhutz. The minutes of the July 31st meeting be approved. BLOOMBERG Herb Bloomberg presented final plans for his dining theatre to be built in Chanhassen. He explained to the new Council his outlay of the project. It is noted here that the Old Village Planning Commission and Council had given prelim- inary approval to these plans and that the Liquor License has been granted. On a, motion made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that seeing as that the Old Chanhassen Village Council and Planning Commission have given their approval to said plans, that this Council grant preliminary approval for the dining theater plans submitted tonight and that these plans be turned over to the Planning Commission and requesting them to return to us their recommendation. 3 yes votes 1 negative vote. Motion carried. PUBLIC HEARING On a motion made by Councilman Klingelhutz and seconded by Council- man Hill that the minutes of the Public Hearing held on July 25, 19671 Sewer and Water extension be approved. Motion carried, no negative votes. WATER Attorney Larson reported that a Mrs. Sheehan telephoned him in regards to when they will receive Sewer and Water to their property. This project has been in the Active file since February. The Council has been waiting for the railroad easement right of wa.y of which has to be obtained before hikgg -)ean be done. At the present the street in front of these properties belongs to the railroad company. The Council instructed t'rm Engineer to write a follow up letter to the railroad to see what has happened. BLDG. INSP. A question was raised as to whether the Bldg Inspector is covered by insurance under the Village Policy and if he is subject to PERK._ The attorney is to check this out. Adolph Tessness was present. He presented to the Council several application forms for approval. On a motion made by Councilman Klingelhutz and seconded by Councilman Hill that the Village Council approve forms 67 -1 through•67 -6 and authorizing the bldg inspector to have said forms made up. Motion carried, no negative votes. A discussion was held on the Violation of the Codes at Animal Fair. On a motion made by Councilman Bennyhoff and seconded by Councilman Hill that the Village Engineer check into this problem. Motion carried, no negative votes. The Council instructed the Bldg. Inspector that he will have to turn in weekly reports. Renting the Village Hall for an antique shop was discussed. Councilmen Klingelhutz and Bennyhoff are the authorized committee to negotiate with these ladies as far as price and etc. ROLLING HILLS Attorney Larson read a letter from Wm. Kelly attorney requesting approval of the registered Land Survey for Rolling Hills. On a motion made by Councilman Bennyhoff and seconded by Councilman Hill that approval be given for the registered plot of Rolling Hills. Two yes votes, 2 negative votes. Motion does not carry. o 0 BOND- BUNGER ADDITION Attorney Larson advised the Council that the Bond for Street Improvement is expiring on Cedar Crest addition on August 11, 1967. On a motion made by Councilman Hill and seconded by Councilman Bennyhoff that the Village Attorney be authorized to take what ever steps necessary to institute action against Mr. and Mrs. Bunger to enforce the provisions of the Contract of August 11, 1961. Motion carried, no negative votes. AUGUST 7, 1967 - minutes continued (page 2) - 1967 -2 and 3 : Attorney Larson reported to the Council the status of the State and County Aid Project. He read the agreement entitled Cooperative Construction agree- ment between the State and the Village. He also stated that the Village should not award the Contract until we have written Concurrance of the proposed award from the State of Minnesota. The amount the State will participate in at the present is $44 At this point the hold up is with the railroad. On a motion made by Councilman Bennyhoff and seconded by Councilman Hill that the Village approves the Resolution entitled Cooperative Construction Agreement between the State and the Village and authorizing the Mayor and Clerk to sign it. Motion carried, no negative votes. - Roads in Pleasant Acres were discussed. The Attorney advised that a check should be made of the Township minutes of late 1956 and 1957 and this should reflect whether the roads have been accepted as public street. POLLING PLACES On a motion made by Councilman Hill and seconded by Councilman Bennyhoff that the voting place for the west precinct be the former Old Town Hall or the present Village Maint. Bldg* and that the voting palace for the east precinct be the new Village Hall. Motion carried, no negative votes. A liquor License Application was read. The Council stated that no action will be taken in regards to issuing any new liquor licenses until after the census has been taken. TELEPHONE COMPANY: On a motion made by Councilman Bennyhoff and seconded by Councilman Hill that the Council °gives permission to Northwestern Bell Telephone Company to lay Buried Cable on Bardwell Road, Hillside Avenue, Pleasant Avenue and Orchard Land. Sketches on file. Motion carried, no negative votes. N.S.P. On a motion by Councilman Bennyhoff and seconded by Councilman Hill that the Village Council give their permission for underground primary and secondary wire crossings on Beach Haven Road. and also within a ten foot easement of lots 1 thru 12, Block 1 and Lot 4. Block 2 adjoining public streets in Colonial Grove , at Lotus Lake. Prints on file; Motion carried, no negative votes. The clerk was instructed to send to all those companies that have had a franchise with either the Old Village or Township a letter stating that we believe that since the new Village formation its incumbent that a new franchise be negotiated. BLDG. PERMITS Councilman Klingelhutz movers that all building for which permits have been issued subsequent to May 8 or buildings under construction as of May 8th, 1967 and do not have final inspection completed„ will be inspected. Seconded by Councilman Bennyhoff. Motion carried, no negative votes. The Council desires to have the maintenance man check into obtaining signs reading Village of Chanhassen - Building Permits Required, to be placed on all roads leading into the Village. METERS On a motion made by Councilman Bennyhoff and seconded by Councilman Klingelhutz that on all water meters a deposit be made for the cost of the meter of the next nearest dollar. Motion carried, no negative votes. On a motion made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that all approved bills be paid as submitted per itemized sheet and that Allied Blacktop for the amount of $1,972.76 Ck# 1154, and Karl Krahl Exe. Co. for the amount of $4 Ck# 1153 be paid by warrants. Motion carried, no negative votes. Motion to adjourn made by Councilman Klingelhutz and seconded by Councilman Bennyhoff.
