1967 08 14MEETING AUGUST 14, 1967
The Chanhassen Village Council met in regular meeting on August lr, 1967 at 8:00 P.M.
at the new Village Hall. The following members were present: Mayor Coulter,
Councilmen Klingelhutz, Bennyhoff and Hill. No members absent.
Mayor Coulter called the meeting to order. On a motion made by Councilman Hill
and seconded by Councilman Bennyhoff that the reading of the minutes be dispensed
and discussed. Motion unanimously carried. On a motion made by Councilman Hill
and seconded by Councilman Bennyhoff that the minutes be approved subject to
discussion with the Engineer on Rolling Hills Addition. Motion unanimously carried.
MAINTENANCE Mr. Al Otterdahl was asked to be present at this meeting. The Council
asked him who gave him the authority to haul black dirt on -the sewer line behind
the Martin Schlenk home. Mr. Otterdahl replied that a previous Councilman had
given him the order. The Council then stated that hereafter all orders must come
through the Maintenance Foreman only.
TRUCKS A discussion was held with the Foreman regarding the bid proposal form
advertising for a new truck of which each Councilman had received in the mail. On
a motion made by Councilman Hill and seconded by Councilman Bennyhoff that the
Village take bids on two trucks with appropiate trade -ins and the bid form be worked
out with the Village Attorney. Bids to be opened on the 28th of August, at 7:30.P.M.
at the new Village Hall. Plans and specifications to be picked up from the Maint-
enance Foreman. Motion unanimously carried.
Wrase related to the Council the need of the Village to obtain some tools. Council-
man Hill suggested that Wrase list all the tools that are needed at this time.
ROLLING HILLS On a motion made by Councilman Hill and seconded by Councilman
Bennyhoff that the-Village approve the proposed registered land survey track A
and B lying on Rolling Hills subdivision - Carver County.
Motion unanimously
CENSUS Engineer Flatebo presented-the census map. On a motion made by Council-
man Klingelhutz and seconded by Councilman Bennyhoff that the Village approve payment
of $873.00 to be made payable to Census, Department of Commerce.
Motion unanimously carried, no negative votes.
EASEMENTS A discussion was held on the easements on the Forcier and De Lancey
property. On a motion made by Councilman Bennyhoff#adts�aon8� byCegpe�e:an
Hill that the Village Attorney procede to writeup easements for the Forcier and
De Lancey properties to the effect that the easement be made public and given to
the Village. Motion unanimously carried.
ANIMAL FAIR ADDITION Engineer Flatebo explained after study and inspection of the
structure meets the Building Code and was built according to plans and specifications
approved on May 26, 1966, by the Planning Commission and Village Council.
On a motion made by Councilman Hill and seconded by Councilman Klingelhutz that
construction of the storage addition to the Animal Fair building is approved as
a varience to the building -code after review by the Village Engineer as set forth
in plans dated 5/27/66. Motion unanimously approved.
On a motion made by Councilman Bennyhoff and seconded by Councilman Klingelhutz
that all structures other than single family resident dwellings must have plans
and specifications approved by the Village-Engineer. Motion unanimously carried.

BUNGER ADDITION Attorney Larson updated the Council on the Bunger Addition, The
Council approved that T. Flatebo Village Engineer to inspect the streets in the Bunger
Addition when work begins.
RENT VILLAGE HALL Two ladies were present who are interested in renting the Village
Hall for an antique shop. The Council stated that the hall would be rented for $110.00
per month as is and that they are to insure the premises against public liability
with the Village named as additional insured on the Policy with the memorandum to be
filed with the Village Clerk and that this 'be rented on a month to month basis until
the 1st of the year and then negotiate on a yearly basis. This was agreeable to the
ladies. The Council instructed the Village Attorney to draw up the lease for renting
of the old Village Hall.
A check was received for $110.00 for the first month rent - paid in advance. No date
was set for tenants to take over. This will depend largely upon when the new Village
Hall will be ready to move the files and etc. in.
MINNEHAHA CREEK WATER SHED The Minnehaha creek water shed was discussed. The Council
desires to have a representative from the Village to attend these meetings.
P.E.R.A. P.E.R.A. was discussed as to who is eligible. On a motion made by Councilman
Klingelhutz and seconded by Councilman Hill to defer any agtion on the building and
plumbing inspection regarding P.E.R.A.,until the Attorney secures an opinion from the
Attorney General. Motion unanimously carried.
ASSESSOR The Attorney advises that the Assesor is eligible for P.E.R.A. The Council
instructed the Clerk to send A. Tessness a letter to the effect that it has been the
policy in the past that the Assessor and Building Inspector furnish his own bond and
that the Council wants to goy_ on record to continue this policy. It is noted here
that the Assessor must file his bond with the County Auditor and in turn the County
Auditor will advise the Village that the bond has been accepted, approved and filed.
ROSE LANE A discussion was held on Rose Lane. Attorney Larson suggested two solutions;
1. That a petition be circulated to the property owners on both sides to petition to
have the road turned over to private owners and they maintain said road.
2'. Barricade this road.
Francis Klein was present also stating that this area is becoming quite a policing
problem and he in behalf of the Sheriff's Department is requesting that something be
done very soon. After lengthy discussion Councilman Bennyhoff moves that no parking
signs be placed all the way to County Road 17 and to barricade to the lakewood side
(just east) of the last driveway and that the Mayor be authorized to consult the County
Commissioner asking them to post County Road 17 with no parking signs adjacent to
Rose Lane. Councilman Hill seconded the motion. Motion unanimously carried.
The Clerk is instructed to place on the reverse side of all applications for sewer and
water permits that pit run sand or gravel must be filled in the trench when digging
occurs in the street and have applicant sign for it.
FISCAL AGENT :,,.On a motion made by Councilman Hill and seconded by Councilman Bennyhoff
that Don Noltf be appointed as the Village Fiscal Agent. Motion unanimously approved.
COUNCILMAN: On a motion made by Councilman Hill and seconded by Councilman Bennyhoff
that R. W. Pearson be appointed Councilman to fill the unexpired term of Adolph Tessness.
Aye votes, Councilman Hill and Councilman Bennyhoff and Mayor Coulter. Negative votes,
Councilman Klingelhutz. Motion carried.

GREENWOOD SHORES: On a motion made by Councilman Hill and seconded by Councilman
Bennyhoff that the petition from Greenwood Shores re: Vacating of park land be
turned over to the Planners. Motion unanimously carried.
PLANNING COMMISSION: On a motion made by Councilman Bennyhoff and seconded by
Councilman Hill that the minutes of each Planning Commission meeting be sent to
the Council within a week after each of their meetings. Motion unanimously carried.
LICENSE FEE: On a motion made by Councilman Bennyhoff and seconded by Councilman
KK inngelhutz that Ordinance #4 Section 4 LICENSING FEE be amended to read $5.00.
Motion unanimously carried.
DEPUTY CLERK: On a motion made by Councilman Bennyhoff and seconded by Councilman
Hill that Janet Thomas be appointed Deputy Clerk during the absence of the Clerk.
Motion unanimously carried.
BILLS On a motion made by Councilman Klingelhutz and seconded by Councilman
Bennyhoff all bills submitted as per itemized sheet be paid. Motion unanimously
carried.
