1967 10 16CHANHASSEN VILLAGE COUNCIL MEETING OCTOBER 16, 1967
The Chanhassen Village Council met in regular meeting on October 16, 1967, at
8:00 P.M. The following members were present: Mayor Coulter, Councilmen
Hill, Pearson, Bennyhoff, and Klingelhutz.
The meeting was opened with the Pledge to the Flag. Councilman Pearson moved
that the minutes of the Sealcoating Assessment Hearing and Kerber Drive Sewer
Extension Assessment Hearing be approved as is except adding the date of
October 6, 1967 to each hearing, and that the October 6th Special Meeting and
the October 9th regular meeting be approved as submitted. Motion seconded
by Councilman Bennyhoff and unanimously approved.
CALLS TO ENGINEER AND ATTORNEY: The Clerk was instructed to write a letter
to the Attorney and Engineer advising them that the only people allowed to
make calls to either one are the Councilmen, Engineer and /or Attorney,
Henry tirurase, and the Clerk. This will cut down on the nuisance calls that
are being made. The Clerk is instructed to make a list of all the calls
that are - received concerning either the Engineer or the Attorney.
PLANNING COMIaSSION TIEPORT: Councilman Rennyhoff read the minutes of the
Planning Commission. The Planning Commission referred a request for a variance
on Lot 1 _t, Block 2, to the Council for action.
VARIANCE REQUEST: A letter was read from Wally Hanson requesting a variance
of footage on Lot 1, Block 2, Highland Park to enable a deluxe double bungalow
to be built on said lot. A $25.00 deposit accompanied the letter. On a
motion made by Councilman Bennyhoff and seconded by Councilman Pearson to
authorize a public hearing for a variance on Lot 4, Plock 2, Highland Park_
to be held on November 6, 1967 at 7:00 P.M. at the Village Hall. Motion
unanimously approved.
GR,EEI -^'OOD SHORES PARK VACATION: Attorney Larson upgraded the Council on
the meeting the Park and Recreation Committee had with the Greenwood Shores
people. Mr. Larson also stated that he has talked with Gene Kelly who has
been head of the Parks and Recreation for Bloomington for the past 18 years.
He has inspected the property in concern and is very impressed. Larson also
stated that to date there has not been much progress made in regard to
reaching a settlement. Much discussion follo;,Ted.
I,a.yor Coulter read a letter he sent in answer to Bud Andrus' letter. On a
motion made by Councilman Bennyhoff and seconded by Councilman Pearson to
defer any action on said Park until the next Council meeting. Motion
unanimously approved.
RLULr VIEW: Mr. Hoppie appeared before the Council desiring approval of road
previously discussed. On a motion made by Councilman Bennyhoff and seconded
by Councilman Klingelhutz to table said approval of road until the proper
documents are received. Motion unanimously approved.
ORDINANCE #10 INDIVIDUAL SFUkC -E DISPOSAL: On a motion made by Councilman Hill
and seconded by Councilman Rennyhoff to adopt, Ordinance #10 Individual Sewage
Disposal. A discussion followed on continuous inspection and who should be
authorized to make such inspection and the fee to be charged for a continuous
inspection... Councilman Bernyhoff withdrew his second and Councilman Hill
withdrew his motion.

Councilman Bennyhof f and seconded by Councilman Klingel - approving the
forms suggested by the Engineer on - Certificate of Survey and Percolation
Test. Motion unani,r�ously approved.
DOUBLE BUNT AIIA : On a motion made by Councilman Pearson and seconded by
Councilman , ennyhoff to issue a Build•i_n ; Pe rn.I.t to Donald P,ippel to erect
a double bungalow on Tract E, Registered Land Survey ,18. The following
votes were racorded. Councilman 3ennyhoff - aye, Councilman Hill - aye,
Councilman Pearson - aye, Councilman Klingelhutz - no. Motion carried.
_RCIER AND LRIC %SOTd :vTATERSTEDS: Engineer Flatebo gave his report on the
Fortier and Erickson watersheds. The appr oximate cost for the Forci er
watershed will be $4,850.00, the Erickson watershed $6,500.00. A discussion
followed. Hansen and Klingelhutz were present, their property Western Hills
will. drain into the Forcier watershed. Tom Klingell:utz-stated that they
loi*ll be i-rilling to nay their fair share of the storm sewer cost. The
completion date for said project should be on or before October 1, 1968
The Couaicil stated that the Public Hearing date will be determined at a
later date.
The Erickson watershed creates a little more of a problem. Ken Erickson and
Mr. and Mrs. Scott ;•were present. The financing end of it was the big concern
being as thou.bh the watershed area lies mainly in an undeveloped area. On
a ~motion made by Councilman Bennyhoff and seconded by Councilman Klingelhutz
to defer action on the Erickson watershed until the next Council meeting to
enable the Council to consult with the Fiscal Agent. notion unanimously
approved. Mayor Coulter to contact Fiscal agent.
:iSSLSSmENT ROLLS: The Engineer presented each Councilman with the Assessment
Rolls for the 1967 -2 L 3 - Curb and the Sunrise Hills and adjoining area sewer
and water extension. Any comments on the rolls will be deferred until next week.
UPESTERN HILLS: Engineer Fla presented a Registered Land Survey to the
Council for approval. On a motion made by Councilman Hill and seconded by
Councilman Pearson approving the Registered .Land Survey # Motion unanimously
approved. Councilman Klingelhutz abstained from voting. (Note: thissho -,s the

On a motion made by Councilman Hill and seconded by Councilman Bennyhoff
authorizing the Clerk and Mayor to sign the hard shell of <<Jestern Hills
First Addition as soon as the contract has been: signed. Motion unanimously
approved.
TELEPHONE COMPANY: Northwestern Bell is asking for Council approval to place
a bur ied cable on the north end of Lotus Lake. Pleasant View Road as shown
on drawing ' date 10/13/67. On a motion made by Councilman Klingelhutz
and seconded by Councilman Hill giving approval for buried cable on Pleasant
View Road provided that within thr=ee months they file with the Village an
as built .location plan with reference to property comers and certified by a
good registered sorveyor or engineer. risciassion followed. Councilman Hill
wi thdrew his second and Councilman Klingelhutz withdrew his motion. .
On a motion made by Councilman Bennyhoff and seconded -b Councilman Klingelhutz
authorizing the attorney to prepare a contract with Northwestern Bell Telephone
Company subject to Council's approval and with the cost of preparation to btu
borne by the Telen'rone Company. Motion unanimously approved.

TEEN CENTER: Police Chief Francis Klein: and Deputy Al Otterdahl asked
permission of the Council to open a teen center in the basement of the
Village Hall. This center would be open between the hours of 7 :00 - 11:00
P.M. every Saturday night and will be chaperoned by adults. The Chanhassen
Lions Club will sponsor the center. On a motion made by Councilman Hill and
seconded by Councilman Pearson that the Lions Club be authorized to sponsor
a teen club every Saturday night in the basement of the Village Hall.
Motion unanimously approved.
POLICE CONTRACT: On a motion made by Councilman Pearson and seconded by
Councilman Hill to approve the Police Contract with Carver County for the-
year 1968 as amended. Motion unanimously approved.
FI OF VILLAGE I-ULL: Each Councilman_ was liven a list of expenditu-res
anticipated to make the Village Offices livable so that regular office
hours and staff can be maintained. The figure also includes some landscaping
and other necessary miscellaneous items. On a motion made by Councilman
Hill and seconded by Councilman Bennyhoff that the figure of "35,000.00 be
placed on the ballot at the November 7, 1967, Village Election. notion
unanimously approved.. Details of question on file. On a motion made by
Councilman Klingelhutz and seconded by Councilman Bennyhoff that this notice
appear in the Yjinnetonka Herald and Chaska paper. Motion unanimously
approved.
CENSUS: The fi obtained from the recent census taken in the Village is
47092 population.
_- nINEXATION: Attorney Larson upgraded the Council regarding the annexation
of Cedney Pahl, Fink Requet et al. This matter is scheduled on the Court
Calendar tomorrow ;Horning at 10:00 A.M. The Engineer and Mayor will be
called to testify.
7�r ATNTENANCE EQUIPMENT: Henry 11rase was present. A discussion was held on
the maintenance equipment needed for the Village. This figure will be pint
on a Certificate of Indebtedness. The Council decided to table the issue
until more facts are obtained on the issuing of a Certificate of Indebtedness.
Mayor Coulter to obtain said facts from the Fiscal Agent.
STREET S'�,- EPING: On a motion made by Councilman Klingelhutz and seconded by
Councilman Pearson authorizing Henry Wrase to make arrangements to have the
street swept where needed in the Village. Motion unanimously approved.
E xUIPP.ENT STORING: On a motion made by Councilman Pearson and seconded by
Councilman Hill authorizing the storing of Village equipment on Henry Wrase's
premises. Councilman Klingelhutz to work out the details with Henry Wrase.
Motion unanimously approved.
SNO PLOW: Mr. Wrase asked the Council if he could sell the old Village Snow
Plow for 750.00. The Council consented.
O- RDINAIdCE #10 - SEPTIC SYSTEM: On a motion made by Councilman Bennyho.ff and
seconded by Councilman Pearson approving the Septic System Ordinance #10 with
changes. Motion unanimously approved.

ORDINANCE #r - FIRE PREPVENTION CODE: On a motion made by Councilman
Klingelhutz and seconded by Councilman_ Pearson approving the Fire Prevention
Ordinance X11. I unanimously approved.
ORDINANCE #'12 - VOLU11TEER FIRE DEPARTMENT: On a motion made by Councilman
Klingelhutz and seconded by Councilman Bennyhoff approving Volunteer Fire
Department Ordinance #12. Motion unanimously approved.
PIONEER TELEPHONE: On a motion made by Councilman Bennyhoff and seconded
by Councilman Pearson instructing the Clerk to vote yes on the ballot from
Pioneer Telephone approving the Metropolitan calling system. Motion unanimously
approved.
BUILDING INSPECTOR: A bill from the Building Inspector for inspections made
during September for the amount of $112.50 was submitted to the Council.
On a motion made by Councilman Klingelhutz and seconded by Councilman Hill to
approve payment of the building inspections. Motion unanimously approved.
1967 -2 & 3: On a motion made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff authorizing partial. payment as recommended by the
Engineer, on a warrant to J. V. Gleason Company, Check #74 Construction
Account for the amount of $58,630.41. Motion unanimously approved.
On a motion made by Councilman Klingelhutz and seconded by Councilman Pearson
meeting adjourned.
