1967 10 30CHANHASSEN 1ILLAGE COUNCIL i� ;T�NG OCTOBER 30 1967 The Chanhassen Village Council met in regular meeting on October 30, 1967, at 8:00 P.M. The following members were present: Mayor Coulter, Councilmen Pearson, Klingelhutz, Hill, and Bennyhoff. The meeting was opened with the Pledge to the Flag. MIKUTES: The minutes of the last meeting were discussed. Councilrr;an Hill moved that the October 36th minutes should reflect that the Assistant Clerk be paid the same as the Deputy Clerk and that subject to this amendment the minutes be approved as submitted. Seconded by Councilman Pearson and unanimously approved. PT I BII�TG PER °B_T: A discussion was held on the violations made by Stein Plumbing Co. 1 1 On a motion made by Councilman Hill and seconded by Councilman Bennyhoff that we suspend the license of Stein Plumbing until further notice. Motion unanimously approved. GREENTZOD SHORES PARK: Rich Lyman, Chairman of the Park and-Recreation Corirmittee upgraded the "ounci.l on the meetin held between the representatives from reenwood Shores, Chanhassen. Park and Recreation Committee and the Attorney's from both sides. Russ Larson told the Council that with Council approval Mr. Glaser, Attorney for Greenwood Shores Association and himself will work out the details concerning this project. It was stated that at this time the agreement is suitable to both sides. The Park will revert back to the ! "reeni , Shores Association for park purposes only subject to that when the Village desires to acquire this land it will be able to through the right of eminent domain, at no cost other than the Village paying the actual costs of the improvements. On a motion made by Councilman. Bennyhoff and seconded by Councilman Pearson that Attorney Larson negotiate with tir. Glaser regarding the ^reenwood Shores Park. The following; votes were cast: Councilman. Bennyhoff - yes; Councilman Klingelhutz - yes; Councilman Pearson - yes; Councilman Hill - no. motion carried. Councilman Hillis no is based on that he has no objection to the general scheme but does object to turnin the title over to the Association. PAP.K AND RECREATION cm iaTTEE: Rich Lyman asked Council permission - tc purchase several publications and apply for a membership in the National Recreation_ and Park Association. On a motion made by Councilman Bennyhoff and seconded by Councilman Pearson approving the request from the Park and Recreation Committee. Motion unanimously approved. qr. Lyman also requested an aerial map. He was instructed to contact Mr. Hawks and find out if the County has such a map. MRS. GRACE: Mrs. Grace and Mr. Wannis were present requesting permission to have the Village plow the snow to Mrs. Grace's home. The road is a one rod road and has not been accepted by the Village. A discussion followed. Councilman Hill moved that we refuse the request. Motion died for a want of a second. Councilman Pearson moved that the Maintenance Department plow snow as long as the Maintenance Department feels its feasible and only as long as Mrs. Grace is using it. Councilman ?ernyhoff seconded the motion. Discussion followed. Councilman Bennyhoff withdrew his second and Councilman Pearson withdrew his motion. Councilman Pearson moved that the request be denied to plow snow on a 16 foot wide road. Councilman Hill seconded the motion. The following votes were cast: Councilman Klingelhutz - yes; Councilman Hill - yes; Councilman Pearson - yes; Councilman Bennyhoff - no. Motion carried. October 30, 1967 - minutes continued (page 2) NORTHTTESTERN BELL TELEPHONE COMPAVY: MY. Helwig was present from the Telephone Co. requesting permission'to lay buried cable on Pleasant View Road. This same request had been made at a previous meeting. A lengthy discussion followed as to mhat the Village expects of the Telephone Company when digging in the Village streets. Councilman Bennyhoff moved that for the time being we grant the request to Northwestern Bell Telephone Company to place buried cable on the north end of Lotus Lake - Pleasant View Road as shown on Drawing #3711 dated October 13, 1967, and upon including the following requirements: 1. Tie in of line to center line of the road on other suitable monuments. 2. Proper backfilling. 3. Furnishing of as built plans. All the foregoing conditions to be approved by the Village Engineer. Seconded by Councilman Pearson. Motion unanimously approved. It was suggested that a copy of Edina's Ordinance for underground utilities be obtained. Engineer to obtain such. KOEHNEN S7BDISTrSION,- ROAD: Mr. Hanson and another gentleman were present requesting the Village to maintain two roads in the Koehnen Addition. On a motion made by Councilman Hill and seconded by Councilman. Klingelhutz to refer this to a committee to study and bring a report on it at they next Council meeting. Motion unanimously approved. On a motion made by Councilman Pearson and seconded by Councilman. Klingelhutz appointing Councilman Bennyhoff, Councilman Hill, and Henry Wase to the committee. Motion unanimously approved. It was also brought to the Council's attention that in one of the double bungalows three families are living there and that the residents living in the addition are not too happy with all the double bungalows being 'Quilt there. Council instructed the above named committee to check into this. 1967 -4 - ASSESSMENT ROLL: Mr. Silas Peller submitted a letter to the Council which was read by the Clerk regarding the Sewer and Etter Assessment. A discussion followed as to the rights of the Council and the property owner. Attorney Larson advised that the Council assess MY. Peller for two lots instead of the four listed on the Assessment Roll. But that by doing this it will not change the figure assessed per lot. The Village will have to carry the balance until the property becomes developed. On a motion made by Councilman Pearson and seconded by Councilman Bennyhoff that if Hri Peller agrees, he be assessed for two lots and the balance be deferred under applicable statutes of the State of Ilinn.esota. Motion unanimously approved. Note: Mr. Peller agrees to the above motion. HANSEN & KLINGELHUTZ: Doug Hansen and Tom Klingelhutz were present requesting a special use permit to build a two family dwelling on Lot 5, Block 3, Highland Park .Addition. Plans were submitted. It is noted that this was approved for a two family dwelling by the old Village Council on April 21, 1966. On a motion made by Councilman Hill and seconded by Councilman Bennyhoff that approval be given for a special use permit for a two family dwelling as per plans submitted on Lot 5, Block 3, Highland Park Addition. Motion unanimously approved. Councilman FlinSelhu.tz abstains from voting: III 1 (Meeting October 30, 1967 DELINQUE1:T SEidER BILLS: On a motion made by Councilman Lennyhoff and seconded by Councilman Pearson directing the Clerk to place the delinquent sewer bills of Leon Powers for $45.00 and Pauly Office Building for $73.50 on the Tax Rolls to be collected along with the Real Estate 'Faxes payable in 1968. ?Motion unanimously approved. 1967 -4 - S E J - Z & WATER ASSESSMEYT ROLL: On a motion made by Councilman Hill and seconded by Councilman Kli.ngelhutz to ,dace the two assessments (2 for sewer and 2 for water) on the Kruse and deLancey property on Lot 13, Auditors Sub. ; {2. Motion unanimously approved. On a motion .made by Councilman Pearson and seconded by Councilman Klingel'nutz that all lots which have a home on it will have the unit charge for sewer and water placed on the Assessment Roll along with their assessment now. - '70'61011 unanimously approved. FINANCING ACING T' TRUCK AND SPREADER: A discussion c -ras ?Meld on the financing of above mentioned vehicles which the Village has agreed to buy. On a motion made by Councilman Pearson and seconded by Councilman Klingelhutz that a Conditional Sales Contract be draian up for the two trucks and the spreader. ?Motion unanimously approved.
