1967 12 11CHANHASSEN VILLAGE COUNCIL MEETING DECEMBER 11, 1967
The Chanhassen Village Council met in regular meeting on December 11,
1967, at 8:00 P.M. The following members were present: Mayor Coulter,
Councilmen Pearson, Bennyhoff, and Klingelhutz. Councilman Hill was
absent. The Mayor opened the meeting with the Pledge to the Flag.
Councilman Pearson moved that the minutes of the December 4 meeting be
approved as submitted. Motion seconded by Councilman Klingelhutz and
unanimously approved. It is noted that because of the absence of a
Council member Mayor Coulter will vote on all issues.
1967 -4 PROJECT: The Clerk reported that she had received a Ball from
Mr. Allan Davis, who owns property in Auditor's Sub. #2 and he
requested that his water and sewer assessment for this year be removed
from the tax rolls because the sewer and water have not been made
available to his property. The Clerk reported that she referred him
to the Attorney. The Attorney and Engineer are aware of the existing
problem and are working on it.
PLANNING COMMISSION: Councilman Bennyhoff read the minutes of the
December 5, 1967, Planning Commission meeting.
GASOLINE BIDS: Councilman Pearson moved that the Village Council
advertise for bids for 12,000 gallons regular gasoline and 5,000 gallons
diesel fuel #2 to be used in the year 1968 which will be publicly
opened on December 26, 1967, at 2:30 P.M. at the Village Hall on Kerber
Drive. Motion seconded by Councilman Klingelhutz and unanimously
approved.
INSURANCE BIDS: Councilman Pearson moved that the Village advertise
Tor bid for purchase of insurance coverage for the year 1968 to be
publicly opened at 2:00 P.M. at the Village Hall on Kerber Drive on
December 26, 1967. Motion seconded by Councilman Klingelhutz and
unanimously approved.
SKATING RINK REQUEST: Mr. Ralph Kant was present requesting permission
to use Village water to provide a skating rink on the Zetah property in
Scholer's Second Addition, to be maintained by the residents of
Scholer's Second Addition at no responsibility to the Village. Mr.
Kant had a petition signed by several residents in the area. The
Council told Mr. Kant that there is no need for a petition to be
presented because the Village is in the business to sell water,
therefore, giving permission to use the water provided it is metered.
The Council also stated that they cannot direct either the maintenance
people or the Fire Department to flood these rinks.
BUILDING PERMIT: Mr. Lewis Woitalla appeared before the Council
requesting permission to remodel a home in Carver Beach. Building
Inspector, Adolph Tessness, presented specifications for the remodeling.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Pearson that the Building Permit be granted to remodel home in Carver
Beach to Lewis Woitalla as per specifications submitted, with a
completion date of June 1, 1968. Motion unanimously approved.

BUILDING INSPECTOR: The Building Inspector requested that the Village
purchase a polaroid camera which he feels will be a great asset
especially when issuing remodeling permits. On a motion made by
Councilman Bennyhoff and seconded by Councilman Pearson that the
Building Inspector be authorized to purchase a suitable polaroid
camera provided he can find one between $15.00 and $30.00. Motion
unanimously approved.
PARK AND RECREATION: Mayor Coulter read the December 7, 1967, Park
and Recreation minutes. Each Councilman was given a proposed ordinance
approved by the Park and Recreation Committee to be studied and discussed
at the December 26th Council meeting.
BUILDING INSPECTION: The Building Inspector reported that he is
checking with the League on a sample ordinance re: Condemnation of
Homes.
ASSESSOR'S REPORT: A discussion was held on urban and rural taxation.
Councilman Klingelhutz and the Assessor to check this out further.
Adolph Tessness, Assessor, explained to the Council how the mill rate
and sales tax is applied to the assessed valuation of a home to
arrive at the amount of tax due.
MUNICIPAL BUILDING BONDED INDEBTEDNESS: A discussion was held on the
Bonded Indebtedness on the Municipal Building. It was agreed by all
that it would be completely unfair for the taxpayers of the old Village
to assume the responsibility of paying off the bonds on the Municipal
Building alone when the entire new Village are deriving the same
amount of benefits.
Pursuant to due call and notice thereof, a regular meeting of the
Council of the Village of Chanhassen was held at the Village Hall,
on Kerber Drive, the 11th day of December, 1967 at 8:00 P.M., with the
following members present: Mayor Coulter, Councilmen Klingelhutz,
Pearson, and Bennyhoff, and the following members absent: Councilman
Hill. Member Bennyhoff introduced the following resolution and moved
its adoption: BE IT RESOLVED By the Council of the Village of
Chanhassen, Minnesota, as follows: (1) That there is now on hand in
and is hereby irrevocably appropriated to the sinking fund for the
retirement of principal and interest on 105,000.00 Sanitary Sewer
Bonds - 1958 dated May 1, 1958, the sum of $3,400.00. (2) That the
County Auditor of Carver County is hereby requested and directed to
reduce by $3,400.00 the taxes levied for collection in the next
ensuing year for payment of the said principal and interest. The
motion for the adoption of the above resolution was duly seconded by
Councilman Pearson, and upon vote being taken thereon, the following
members voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Pearson, and Klingelhutz, and the following voted against the same:
none. Whereupon said resolution was declared duly passed and adopted.

for payment of the said principal and interest. The motion for the
adoption of the above resolution was duly seconded by Councilman
Pearson, and upon vote being taken thereon, the following members
voted in favor thereof: Mayor Coulter, Councilman Bennyhoff, Pearson,
and Klingelhutz, and the following voted against the same: none.
Whereupon said resolution was declared duly passed and adopted.
Pursuant to due call and notice thereof, a regular meeting of the

Hill. Member Bennyhoff introduced the following resolution and moved
its adoption: BE IT RESOLVED By the Council of the Village of
Chanhassen, Minnesota, as follows: (1) That there is now on hand in
and is hereby irrevocably appropriated to the sinking fund for the
retirement of principal and interest on Municipal Building Bonds,
dated October 1, 1966, the sum of $4,652.00. (2) That the County
Auditor of Carver County is hereby requested and directed to reduce
by $4,652.00 the taxes levied for collection in the next ensuing year
for payment of the said principal and interest. The motion for the
adoption of the above resolution was duly seconded by Councilman
Pearson, and upon vote being taken thereon, the following members
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Pearson,
and Klingelhutz, and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Pearson that $4,652.00 be taken from the Sewer and Water Operating
Fund to pay the 1966 -2 project payment payable in the year 1968.
Motion unanimously approved.
Mayor Coulter was given permission by the Council to check with the
Bonding Attorneys to see if there is a method of consolidating the
two bonds on the Municipal Building and what the cost would be and
report back to the Council.
AUDIT:" On a motion made by Councilman Klingelhutz and seconded by
Councilman Pearson that the firm of Hoffman and Hoffman Accountants
be hired to audit this years books. Motion unanimously approved.
TYPEWRITER: Councilman Pearson is to check out the details on the IBM
Typewriter and report back at next regular council meeting.
APECO COPY MACHINE: Councilman Pearson moved that the Apeco duplicator
which has been used on a trial basis for the past two weeks be purchased.
A contract written up to be paid over a 60 month period but to be
negotiated at the end of a one year period and that the Village trade
in the Kodak Copier and supplies for credit to be applied against the
Apeco. Motion seconded by Councilman Bennyhoff. Motion unanimously
approved.

On a motion made by Councilman Klingelhutz and seconded by Councilman
Pearson that anyone requesting copies pay a fee as follows: 25G for
the first copy and 10� per copy thereafter. Motion unanimously
approved.
PLUMBING VIOLATIONS: It was called to the Councils attention that
Town and Country Plumbing and Westonka Plumbing firms are in violation
of the Code. The Clerk is instructed to check into this matter.
JUNK CARS: Many complaints have been received on the junk cars on
the Roy Kelm property. The Council instructed the Attorney to take
immediate action on the removal of said cars.
SKATING RINKS: A letter was read from the Fire Chief. "As of December
1, 1967, the Chanhassen Fire Department equipment will no longer be
available for flooding skating rinks. If we do it or let our equipment
out for one party in the area we will have to accommodate the entire
Village and this we cannot do, especially with the Village as large
as it is. As I understand, it is also necessary to have Village
permission for private use of a hydrant."
The Clerk was instructed to answer his letter as follows: "We
acknowledge receipt of your letter stating that the Fire Department
equipment will not be available for flooding skating rinks. The
Village Council feels it will be necessary to use the fire hose to
flood the Village Skating Rink periodically."
After much discussion on private skating rinks the Village Council
decided that all private skating rinks will have to be flooded from
private homes by a private hose hook up due to the danger of freezing
of hydrant and meter. The public rinks will be flooded by Village
Maintenance men.
ANNEXATION: A letter was read from Attorney Larson stating that the
petition has been granted by the Minnesota Municipal Commission to the
Village of Chanhassen to annex those lands lying south of the existing
Village boundary and extending to the main channel of the Minnesota
River. On a motion made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz authorizing the Village Attorney to proceed with
the ancillary part of this proceeding. Motion unanimously approved.
MAINTENANCE: Henry Wrase, Maintenance Superintendent, informed the
Council he has ordered 12 more signs; Village of Chanhassen, Building
Permits Required. The Village Council authorizes the Maintenance
Superintendent to plow out his driveway with Village equipment because
he is responsible for plowing the Village streets and has to be able to
get out of his driveway. The Council advised the Maintenance Department
that the roads in Chanhassen Estates and Western Hills will have to
be plowed.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Klingelhutz authorizing the Maintenance Department to purchase an
acetylene torch for $65.00 and tank lease contract. Motion unanimously
approved.
Mr. Wrase informed the Council that the Sewer King needs a cable. The
cost now would be $473.00. The Council decided to table this until
Spring.

FIRE DEPARTMENT: The Clerk is instructed to send a letter to the
Fire Department requesting the presence of the officers only at the
next Council meeting, December 26, 1967.
The Council instructed the Clerk that before the radios can be paid
for a letter must be obtained from the Fire Department stating that
all radios have been received and are in good working order. The
Council desires to have the radios paid on a contract for deed with
the State Bank of Chanhassen, payable in three equal payments, 25%
down, balance in July and December.
BILLS: On a motion made by Councilman Pearson and seconded by
Councilman Klingelhutz that the bills be paid as adjusted. Motion
unanimously approved.
COUNCIL MEETINGS: The regular Council meetings for January will be _
held January 2 and January 15, 1968.
1967 -2 & 3: The Clerk is instructed to check with the Engineer to see
why payment has not been made from Gleason to the Church and Fire
Department for damages when the basement of the Sisters House was
flooded.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Pearson the meeting adjourned.
